NOTICE OF SALES AND USE TAX
FOR EDUCATIONAL PURPOSES
ELECTION ON MARCH 17,2009
Pursuant to a resolution adopted by
the Board of Education of Jenkins
County (the “Board of Education”), the
managing and controlling body of the
Jenkins County School District (the
"School District”), on December 15,
2008, and a call of election issued by
the Judge of Probate Court of Jenkins
County, as Election Superintendent for
Jenkins County, notice is hereby given
as follows:
On March 17, 2009, an election will
be held in Jenkins County to submit to
the qualified voters of the School Dis
trict the following question:

Shall a one percent sales and use
tax for educational purposes be im
posed in the Jenkins County School
District for a period of time not to ex
ceed twenty consecutive calendar quar
ters and for the raising of not more than
$5,258,175 for the purpose of retiring
previously incurred indebtedness of the
Jenkins County School District and to
pay the costs of (i) construction and ren
ovation of athletic facilities at the Jen
kins County High School including, but
not limited to, new track improvements,
(ii) acquisition of school busses and oth
er necessary personal property and
equipment and (iii) acquisition of com
puters and related technology and safe
ty and security upgrades?
2. All qualified voters desiring to vote
in favor of imposing the 1% sales and
use tax for educational purposes (the
"Educational Sales Tax”) shall vote
"Yes” and all qualified voters opposed
to levying the Educational Sales Tax
shall vote “No.” If more than one-half of
the votes cast are in favor of imposing
the Educational Sales Tax then such
tax shall be imposed beginning July 1,
2010 or the first day of the calendar
quarter following termination of the Ed
ucational Sales Tax presently in effect
in Jenkins County and shall cease to be
imposed on the earlier of (a) twenty cal
endar quarters after the tax is imposed
or (b) as of the end of the calendar
quarter during which the Commissioner
of the Georgia Department of Revenue
determines that the Educational Sales
Tax will have raised revenues sufficient
to provide to the School District net pro
ceeds equal to or greater than the
amount specified as the maximum
amount of net proceeds to be raised by
the Educational Sales Tax.
3. The School District heretofore has
issued its $5,050,000 in principal
amount JENKINS COUNTY SCHOOL
DISTRICT GENERAL OBLIGATION
BOND, SERIES 2005 (the “Series 2005
Bond”) for the purpose of financing cap
ital outlay projects of the School District,
as authorized by a majority vote of qual
ified voters in Jenkins County voting in
an election held March 15, 2005. If re
imposition of the Educational Sales Tax
is approved by the voters of Jenkins
County on March 17,2009 and imposed
beginning July 1, 2010, proceeds to be
received from the Educational Sales
Tax of approximately $3,160,195 shall
be used to pay principal of and interest
coming due on the Series 2005 Bond
through December 1,2015, which is the
final maturity date for the Series 2005
Bond. The School District may apply
interest earnings or other funds avail
able in the debt service account main
tained for the outstanding Series 2005
Bond to assist in the retirement of such
bond.
4. In addition to the retirement of the
Series 2005 Bond, the Board of Educa
tion expects to use proceeds from the
Educational Sales Tax to fund all or a
portion of various capital outlay projects,
including architectural and engineering
fees and necessary contingencies
throughout the Jenkins County School
System, including (i) construction and
renovation of athletic facilities at the
Jenkins County High School including,
but not limited to, new track improve
ment, (ii) acquisition of school busses
and other necessary personal property
and equipment and (iii) acquisition of
computers and related technology and
safety and security upgrades.
5. To the extent available, the
School District may combine available
funds from the State of Georgia with
proceeds from the Educational Sales
Tax, and any other available funds, to
pay the costs of the above described
capital outlay projects. Plans and spec
ifications for these projects have not
been completed, and bids have not
been received. Depending upon acqui
sition and construction costs and avail
able funds, the School District may es
tablish or reestablish priorities and
choose which capital outlay projects to
undertake or not undertake, or to delay
until additional funding is available, to
the extent that proceeds of the Educa
tional Sales Tax, together with other
available funds actually received by the
School District, are insufficient to com
plete all of the capital outlay projects.
6. The last day to register to vote in
the election is Tuesday, February 17,
2009. Anyone desiring to register may
do so by applying in person at the voter
registration office located at the Jenkins
County Courthouse, Millen, Georgia, or
by any other method authorized by the
Georgia Election Code.
7. The election will be held on Tues
day, March 17, 2009. The polls will be
open from 7:00 a.m. until 7:00 p.m.
This December 16, 2008.

of land lying, situate and being in the
1640th G. M. District of Jenkins County,
Georgia, containing 3.14 acres, more or
less, and being Lot No. 23 of the Oak
Hill Estates Subdivision. Said lot is
bounded now or formerly as follows: On
the North by Stacey Road; on the East
by lands of William D. Matthews Sr.,
and Stacey Matthews; on the South by
lands of Spencer Way Estates; On the
West by Lot #22 of said subdivision. For
a more definite description of said lot,
reference is hereby made to a plat of
survey prepared by H. Lawson Graham
and Associates Ga. Reg. #2122, said
plat being recorded in the Office of Su
perior Court of Jenkins County in Plat
Book 12, page 178, and is hereby in
corporated by reference.
WHEREAS, said Deed to Secure
Debt was executed to secure a Note of
even date therewith, in the original
amount of $10,425.18, with interest
thereon as set forth therein, together
with all other indebtedness of the bor
rower to the lender then due or that
might thereafter become due, or there
after become contracted, which was or
would be evidenced by a note or notes,
all as shown by said Deed to Secure
Debt recorded in the Office of Clerk,
Jenkins County Superior Court, in Deed
Book 6-C, Pages 544-547; and
WHEREAS, the debt secured by
said Security Deed has been and is
hereby declared due, because of,
among other possible events of default,
failure to pay the indebtedness as and
when due and in the manner provided in
the Note and Security Deed.
WHEREAS, notice has been given
as required by O.C.G.A. 144-14-162
through 44-14-162.4 (Michie 1982).
NOW THEREFORE according to the
original terms of said Deed to Secure
Debt and the laws in such cases made
and provided, the undersigned will ex
pose for sale to the highest and best
bidder for cash, the property described
