WHEREAS, heretofore on July 20,
2007, John A. Milton did deliver to Dur
den Banking Company, Inc. a Deed to
Secure Debt conveying the following
described land, to-wit:
TRACT ONE: All that tract or parcel
of land lying, situate and being in the
1640th G. M. District of Jenkins County,
Georgia, containing 2.27 acres, more or
less, and being Lot # 22 of the Oak Hill
Estates Subdivision. Said lot is bounded

WHEREAS, said Deed to Secure
Debt was executed to secure a Note of
even date therewith, in the original
amount of $10,425.18, with interest
thereon as set forth therein, together
with all other indebtedness of the bor
rower to the lender then due or that
might thereafter become due, or there
after become contracted, which was or
would be evidenced by a note or notes,
all as shown by said Deed to Secure
Debt recorded in the Office of Clerk,
Jenkins County Superior Court, in Deed
Book 6-C, Pages 544-547; and
WHEREAS, the debt secured by
said Security Deed has been and is
hereby declared due, because of,
among other possible events of default,
failure to pay the indebtedness as and
when due and in the manner provided in
the Note and Security Deed.
WHEREAS, notice has been given
as required by O.C.G.A. 144-14-162
through 44-14-162.4 (Michie 1982).
NOW THEREFORE according to the
original terms of said Deed to Secure
Debt and the laws in such cases made
and provided, the undersigned will ex
pose for sale to the highest and best
bidder for cash, the property described
in said Deed to Secure Debt from John
A. Milton to Durden Banking Company,
Inc. after proper advertisement on the
first Tuesday in April, 2009, between le
gal hours of sale before the Courthouse
door in Millen, Jenkins County, Georgia.
Said sale will be subject to any out
standing ad valorem taxes, and the pur
chaser will be responsible for any Geor
gia real estate transfer tax. Proceeds
from said sale will be used first, to pay
the cost and expense of said sale; sec
ond, to pay the balance due on the in
debtedness mentioned above from John
A. Milton to Durden Banking Company,
Inc., and third, to pay the surplus, if any,
to the person or persons legally entitled
thereto.

LEGAL NOTICE
In accordance with the Georgia Department of Natural
Resources’ regulations under provisions of O.C.G.A 12-7-6(15),
The City of Millen has requested a variance to encroach within
the 25-foot State waters buffer. This encroachment is asso
ciated with the Upgrade and Expansion of the Millen Water
Pollution Control Plant located within the City of Millen. The City
proposes to impact 1,000 linear feet of buffer along a tributary
canal to Buckhead Creek to place additional material and sta
bilize the toe of the existing dike for reinforcement against the
City’s existing wastewater treatment lagoon.
Interested parties can review the site plans at the Millen City
Hall. The public is invited to comment on the above mentioned
activity. Comments will be accepted for a period of 30 days fol
lowing the date of this notice. Written comments should be sub
mitted to the Program Manager, NonPoint Source Program,
