WHEREAS, heretofore on June 30,
2008, ALAN MINKOVITZ did deliver to
JOANNA ATKINSON and DONALD AT
KINSON a Deed to Secure Debt con
veying the following described land, to
wit:
All that tract or parcel of land lying,
situate, and being in the 1639th G.M.
District of Jenkins County, Georgia,
designated as Lot 12, Section 2, of the
Subdivision of Lands of Sam J. Over-
street, as shown by a plat prepared by
Frank J. Ford, Surveyor, which is re
corded in the Office of the Clerk, Jen
kins County Superior Court, in Plat
Book 4, page 308. Said Plat is hereby
incorporated herein for a more full, com
plete and accurate description thereof.
Said lot fronts 60 feet on Ogeechee
Drive and runs back between parallel
lines a distance of 86 feet and is bound
ed as shown on said plat as follows:
North by Lot 10, Section 1 of said sub
division; East by the right-of-way of
Ogeechee Drive; South by Lot 14, Sec
tion 2 of said subdivision; and West by
lands of Earl Johnson.
There is also conveyed herewith all
of Grantor’s right, title, and interest in
and to a well use agreement recorded
at Deed Book 2F, page 578 of the Jen
kins County Deed Records, as well as
the agreement relating to access to the
waters of the Ogeechee River at Deed
Book 3V, page 295.
WHEREAS, the said Deed to Secure
Debt was executed to secure a date of
even date therewith, together with all
other indebtedness of the Borrower to
the Lender then due or that might there
after become due, or thereafter become
contracted, which was or would be evi
denced by a Note or Notes, all as
shown by this said Deed to Secure Debt
recorded in the Office of the Clerk, Jen
kins Superior Court, in Deed Book 6H,
pages 732-735; and
WHEREAS, the amount due,
$37,800.00 is now past due.
WHEREAS, notice has been given
as required by O.C.G.A. Ann. (44-14-
162 through 44-14-162.4 (Michie 1982).
NOW THEREFORE, according to
the original terms of said Deed to Se
cure Debt and the laws in which cases
made and provided, the undersigned
will expose for sale to the highest and
best bidder for cash, the property de
scribed in said Deed to Secure Debt
from ALAN MINKOVITZ to JOANNA
ATKINSON and DONALD ATKINSON,
after proper advertisement on the first
Tuesday in September, between legal
hours of sale before the Courthouse
door in Millen, Jenkins County Georgia.
Said sale will be subject to any out
standing ad valorem taxes, and the pur
chaser will be responsible for any Geor
gia Real Estate Transfer Tax. Proceeds
from said sale will be used first to pay
the cost and expense of said sale; sec
ond to pay the balance due on the in
debtedness mentioned above by Se
curity Deed from ALAN MINKOVITZ to

KINSON, and third, to pay the surplus,
if any, to the person or persons legally
