It being represented to the
Court by the petition of the
Bank of Cumming, a corpora
ion of this state, that on the
10th day of June 1922, T. W.
Gazaway executed and deliver
ed to said Bank five mortgages
aggregating the principal sum
of Four hundred and ninety
one dollars and thirty six cents
upon a parcel of land in the
14th district and first section in
said county, containing forty
acres, more or less, consisting of
2 acres in the southeast comer
of lot No. (750) seven hun
dred and fifty, and thirtyeight
acres of the western part of
No. (818) eight hundred and
eighteen, bounded on the north
and west by the lands of J. H.
Mathis; on the south by the
lands of J. H. Hubbard and on
the east by the lands of H. M.
Gazaway (this being the place
whereon the said T. W. Gaza
way lived at that time) to se
cure the payment of five prom
issory notes (said mortgages
being incorporated ii the same,
dated June 10th, 1922, one for
$91.36, due Oct. Ist; and four
for SIOO.OO each, one due Oct.
15th, one Oct. 30th, and two
Nov. 15th after date, each bear
ing interest from maturity at
8 per cent per annum, and
which sums are past due and
unpaid,
WHEREUPON, It is ordered
that the said T. W. Gazaway
do pay into this court by the Ist
day of the next term thereof
commencing on the 4th Mon
day in August, 1923, the full
amount of the principal and in
terest due cn said notes and the
costs of this proceeding, or
show cause, if any he has, why
he should not pay the same, or
in default thereof that judg
ment absolute i'l be granted
foreclosing 'id mortgage to
said Bank of Gumming, and
the equity of redemption of the
said T. W. Gazaway in the
land described in the same as
herein set out, be forever barr
ed. It is further ordered that
service of this rule be made
and perfected upon the said
T. W. Gazaway according to
law in such cases made and pro
vided. Granted in open court,
this 19th day of Feb. 1923.
