These'gentleman were accommo dation endorsers on a bond of $33,- 000, a restraint warrant against tire C. il. & 0. R R. by the Rome railroad company for rents of ter minal property, leased by the C. It. & C in Rome. While the rents were accruing the Central bought the C. R. & C. and s"on after went into receiver’s hand. In the superior court of Floyd county a judgement was rendered for the Rome railroad to the extent of SIO,OOO. This was paid by King and Rhoades and the case was appealed to United-States court after the receivership. The decision of the court t> day is that Rhoades and King accepted the independent obligation of the C R. & C. and must come in as Inordinary creditors. }' Judge Speer decided tjiat Thos. j B. Rome, Ga.,Jan.2B. —Lester Ech ols was found guilty of murder and recommended to the mercy of the court this morning. lie was sen tenced to the penitentiary for iife. Ho received his sentence with the utmost indifference, and with a smile on his face. Hiscouns 1 will appeal for a new trial. The Bridges case was postponed until Monday. Ev»ns brought i in a verdict at 1 o’clock this after-j noon. He shot Wi.l Coleman in a beer saloon about two monlis ago. Coleman.died the next day. The jury has been out since last Fri day. The verdict was guilty of murder, with a recommendation to mercy. He was sentenced to life i m prison men t. Evans is an old newspaper man. He came hero four years ago ago. He worked on the Omaha World- Herald, -.nd had done work on all the Rome papers. He received his sentence bravely, but broke down when carried to jail. Splendid le gal talent was employed. Perhaps the worst feature about la grippe is that it is almost sure.to leave con sequences behind it which are far worse than that some things have been learned, during these sieges with la grippe. Untold thousands have learned thess things but a still greater multitude perhaps have these things yet to learn. Birmingham, Jan. 27. —The leg islature in session at Montgomery continues to transact much im portant business. This morning ; the house committee on revision of laws reported favorably the bill prohibiting the selling cf pools on races, and it comas up as a special order next Wednesday. A bill prohibiting the .operation of slot machines was also reported favor ably. Mr Nesmith followed up the moral reform by introducing a bill prohibiting the buying or sell ing of futures in the state. It is thought that all three of these bills will become laws. The house this morning declined to reconsider the bill passed yesterday providing for a back tax collector. The bill calls for the appointment of a state tax commissioner, who shall ap point a back tax collector in each county, whose duty it shall be to increase assessments as he sees fit and to collect all escaped taxes and licenses less than five years overdue. He is to be paid in fees. The house committee on com merce and common carriers repor ted adversely the bill to create a new railroad commission, and en act a new code of laws governing railroads. A minority report was also filed and placed on the calen dar. The senate today passed Mr. Hogue’s providing for the equaliza tion of the salaries of state officers. It does not affect the salaries of the Governor or judiciary, but fix es tkqxalaries of the heads of de partments at $2,000 each, and of solicitors SI,BOO each. There is no doubt, Georgia’s pen sion business is a much bigger i thing than any one has been antici- I pating. Since the last appropria tion by the legislature the indigent list is growing surprisingly. The probable increase of this list alone based on conservative estimates, in the state will he from 3.000 to 5,000 ver last year’s list, v> .9 . ’ was only 2,C00. Placing the increase fm the ’ st-.ffe at 3.000, the total number of applicants under the indigent act 'this year would be 5,00. Exactly ; one half of this number can be paid : with the ; made by the legislature. Here we i would have a deficit of a like i amount in this feature of Georgia’s pension business alone. Thepros i pects are that at least 2,500 old sol diers on the indigent list will not ’ get paid this year. The Columbus Enquirer-Sun ; while disclaiming no lack of feel ■ ing or interest for the old soldier, suggests that every possible reason able provision should be made to r -veiit unworthy or undeserving men from sharing in the bounty of the state. This is but just to the tax payers and to the deserving veterans as well. The law should be changed, thinks the Enquirer-San, so that every applicant for a pension should go before the grand jury of his own county and submit his proofs in person for the considera tion cf that body, before his name is entered on the list of pensioners. - In this way justice would be done - to the applicant as well as to the tax payers. A young man named Dave Hall, who, judging from the story below must be Jim Hall’s brother, has returned to Chattanooga from a trip to Georgia, and told this in teresting scientific problem: “Great excitement prevails in the mountain districts west of Cal houn over the discovery of a won derful petrified or fossil mule,” said Mr. Hall. “The discovery was made by Hip Scott and Lum Shaw, who believe that the fossil is at least a million years old. This opinion is sustained by an examination of tie animal’s teeth, which are said to be in a horrible state of decay. The discovery was purely accidental. Messrs Scott and Shaw, who are among the most prominent and reliable citi zens of that section, were, attempt ing to dig out a ground hog' from its den in the side of the mountain when they unearthed what appear ed to be the hind leg of a mule in perfect condition. This perfectly formed limb was neatly covered with fine black hair which seemed to have been formerly well curried and brushed. Scott tapped the fossil limb with the point of his pick aiid; a thrilling experience fol lowed. A gallon and suppressed snort came from under the ground the limb was suddenly drawn back into th* hillside, and the next in stant tons of dirt and rocks flew through the air in every direction. Scott and his companion fled for their lives, both narrowly escaping instant death at the heels of the kicking fossil. “After the thing had kicked it self loose from the limestone strata in which it was imbedded it gave a loud bray and trotted across the field and disappeared in the pine thicket. An alarm was given and the whole community turned out to hunt the animal. A few days ago it was seen quietly grazing in Tobe Simmon’s oat jaich, and on several occasions its hideous and unearthly brays have filled the in habitants with consternation and terror. Numerous posses of well anned uiifi aetermined men are scouring the country in search of the nefarious animal, and should he be captured will doubtless be lynched on the spot.” The Carroll county Times has sprung a new editorial on “Talk Up Your Own Town.” There cer} tainly can be no complaint against the weekly press on that score!. They “talk up” and hurrah for their town fifty-two weeks in the year, and usually do just fifty-two times as much of this kind of busi ness as they get thanks for their work. It is not an uncommon thing to see a bright, pushing week ly paper with scarcely a single ad. , from a home merchant. The boys of the weekly press deserve better treatment than they usually get from their home merchants and home people. The business men of a town can’t do too much for their home paper. In the year 1896 131 lynchings occurred in this country, only two years since and including 1885 showing a smaller number. Those years were 1887, when 122 persons were lynched and 1890, with 130 In 1892 the number was 235 and in 1893 it was 2CI. Os those whose lives were taken by mob vio lence last year, eighty were negroes - and fifty;one whites ; 122 lynchings occurred in.the south and nine in the north. The decrease’ in this form of unlawful killing is agree able, but there is still room for improvement. It is no more than fair to the state of Georgia to say that the general impression that she heads the list in this awful form of law-breaking is incorrect. Louisiana stands first with twenty five cases, Alabama next with fif teen, Tennessee third with fourteen and Florida with ten, while Geor gia and Kentucky have nine each to their credit. —Chicago Chroni cle. A Kansas editor wants to ex change an office chair for a piece of bacon and a red flannel shirt, and the Rome Tribune wants to know where he got the chair. Frank Evans was last week con victed of murder by a Floyd coun ty jury, and was sentenced to life imprisonment by Judge Candler. This is of the sad results of the excessive use oi strong drink, and the inexcusable habit ot car rying concealed weapons. Evans was seemingly one of the most quiet and peaceable men living, and yet, in a sudden impulse of passion, made worse no doubt by the whiskey he had drank, he de stroyed the life of his friend, and at the same time his own, for there is small choice between a hang man’s noose and a life spent in the convict camps.
