Ducktown Case Proves a Benefit
Atlanta, Ga.—lt is truly sel
dom that court litigation results ir
great benefit to not only plaintiff
and defendant, but to the public
at large, but such has been the
ease with the suit instituted and
fought successfully by the state
of Georgia and known as the
Ducktown copper fume ease. It is
conservatively estimated that the
farmers of Georgia alone will save
from two to three million dollars a
year by reason of the suit, a re
sult, however, that was not aim
ed at when it was begun. Not
only this but the primary result
desired has been practically ob
tained. Furthermore t h a t
copper companies which fought
the ease are making more money
than before it was begun and in
directly by reason of it, the val
ue of their property is said to
have been greatly enhanced as
a consequence.
The copper fume suits were in
stituted by Attorney General J.
C. Hart soon after he went into
the office he now holds, about
seven years ago. They were i>
the United States court, and of
a character little known to Amer
ican courts. They were brought
by the state on the
ground that fumes issuing from
the smeltering plants of the
Ducktown Cppper Company and
other companies, just across the
Georgia line in Tennessee, were
doing great injury to vegetation
on the land of the adjoining
Georgia counties. In fact, the
effect of the strong acids dis
tributed into the air in the shape
of fumes was calculated to*i,'.ke
the surrounding country a bar
ren waste because the acids
meant death to practically all
forms of vegetation. It was on
behalf of the property owners,
whose farms were being turned
into deserts that the state began
the suits. The defendant compa
nies being in another state made
it necesssary to sue in the United
States Supreme court.
The suits were in the courts
for several years before they
were finally decided, attorneys
for the copper companies fight
ing the state inch by inch. Mean
time, they took steps to allay the
evil complained of. Big smoke
stacks were erected so that the
fumes might be discharged in
the air at such a high altitude
that they would be of little ef
fect on t’ne surface. Scientists
were employed to make investi
gations looking to the utilization
of the acids the fumes contained.
The predominant component of
the fumes was known to be sul
phuric acid, an ingredient em
ployed to large extent in the
manufacture of commercial fer
tilizers. At that time practical
ly all of the acid used in Amer
ica, amounting io thousands of
tons annually, was being import
ed from Europe, where it is dug
directly from mines.
It was found that the acid es
caping from the smelting plants
could be utilized.
These facts, together with the
general business value of the cop
per plants to that part of the
state, were advanced before the
supreme court handed down a
decision sustaining the conten
tions of Judge Hart.
The court held that common
law principles gave the state of
Georgia the right to demand the
closing down of the copper plants
but took occasion to say that the
state might find it an economic
mistake to insist upon such rights
The copper companies claimed
that the greater part of the
fumes wonld be controlled, if
not utilized, so that surrounding
farms would not suffer. On
this statement, the state agreed
that the decree, which was in its
power to exact, be withhold in
definitely, that time might de
velop whether or not the pledges
of the companies could or would
be kept. The state was given the
right to demand the decree upon
giving thirty days notice.
The copper companies are said
to have soon demonstrated that
the large amout of sulphuric
acid wasted in the fumes could
be utilized To do so entailed the
expenditure of more than $1,000,-
000 on a plant. It is now in
working order, and is turning
out about 1,500 tons of the acid
daily. |
The acid is sold to fertilizers
manufacturers at about $3.50 a 1
ton, while the imported article
brings about SB. This is said to
be the reason for the big drop in
fertilizer prices during the pres
ent season.

town is but a bagatelle compar
ed to the possibilities in sight.
Judge Hart, whose fight in the
courts resulted >n the discovery
and the development of the pro
cess by which it is utilized, is eon
fident that within a few years
no more sulphuric acid will be
imported into America, but that
all that’s needed will be produc
ed here.
The output of the Ducktown
plants will be greatly increased
as the plants are perfected.
It is also said that the utiliza
tion of the fumes will do much
towards developing the copper
industry in North Georgia. There
are said to be thousands of acres
of copper lands in Georgia com
taining an almost inexhaustible
supply of ore as good as that at
Ducktown. The ore is of a low
grade, which accounts for the
fact that there has been little de
velopment.
English investors are said to
have already purchased options
on a great deal of North Geor
gia land preparatory to estab
lishing extensive mines. They
have been waiting to see if the
production of acid is a success,
in order that they may be assur
ed of got d earnings.
Owing to the unusual develop
ments growing out of the, litiga
tion, Attorney General Hart has
for the past two years resisted
all efforts to close down the
smelting plants. The fume ques
tion has been drawn into poli
tics in North Georgia, and a larg<
faction of the people there have
been demanding that the state
call on the federal supreme, court
to enforce the decree closing the
mines. An appeal to the attor
ney general failed, and two ap- |
peals to the legislature ’nave met
a similar fate. The governor has
declined to interfere. After win
ning his case, Judge Hart de
clines Hie actual reward of vic
tory.
He looks upon the litigation
as the most profitable the state
ever undertook, though the act
ual results were wholly unexpect
ed at the beginning.
