LAND SALE
By virtue of the power and author
ity contained in a certain security
deed executed by J. A. Booher and
wife, Mattie Booher, under date of
May 22 nd, 1925, recorded on the 26 ,
day of October, 1926, in Deed Book
16, Page 87, Office Clerk Superior
Court Chattooga county, Georgia, re
ference to which is hereby made for
full and complete recitals of its pro
visions, the makers of said deed hav
ing defaulted in the payment and com
pliance with the terms and provisions
of said security deed and having fail
ed to make their payments according
to the terms and tenor thereof and
the undersigned having exercised his
option as contained in said deed and
having declared the entire indebted
ness secured by said deed due and
payable (the makers having remained
in default for more than the time
specified in said security deed) and
the said makers of said deed having
still remained in default. Now, there
fore the undersigned will offer for
sale and will sell on Monday, the 22
day of November, 1926, within the le
gal hours of sale, at the court house
door in Chattooga county, Georgia, at ,
public outcry to the highest and best
bidder for cash and in bar of redemp
tion and all other claims in accord- '

SALE UNDER SECURITY
' DEED.
Whereas, Fowler Brother, a part
nership, and J. S. Fowler, C. S. Fow
ler, Mrs. D. C. Fowler and Mrs. D. C.
Fowler, as executrix of the estate of
D. C. Fowler, deceased, did, on the
20th day of December, 1921, make
and execute unto the Rome Hardware
company, a corporation of Floyd
county, Georgia, a certain warranty
deed to secure a debt in the sutne of
$3,567.95, which deed is duly record
ed in the office of the Clerk of Su
perior Court of Chattooga, county,
Georgia, in Deed Book 11, page 384,
where it may be more fully seen; and
Whereas, the same persons did, on
the same day, make and execute to
the Simpson Grocery company, a cor
poration of Floyd county, Georgia, a
waranty deed to secure debt, on the
20th day of December, 1921, which
deed was duly recorded in the office
of the Clerk of the Superior Court of
Chattooga county, Georgia, in Deed
Book 11, page 387, where said deed
may be more fully seen, said deed hav
ing been executed to secure a debt of
$4,849.04, represented by promissory
notes therein described; and
Whereas, the same parties did on
the same day make and execute a
warranty deed to secure a debt to the
Exchange National bank, of Rome, Ga.
a national banking corporation, to se
cure a debt of $7,379.00, represented
by promissory notes mores particular
ly described in said deed, which deed
was duly recorded in the office of the
Clerk of the Superior Court of Chat
tooga county, Georgia, in Deed Book
11, page 379, where same may be
more fully seen; and
Whereas, each of said deeds recit
ed that they are of equal rank and
dignity with each other; and
Whereas, Rome Hardware company
did, on the 18th day of March, 1925,
transfer, set over and assign the said
deed to secure debt made to it, to
gether with all its rights, powers and
privileges under said deed and to the
property therein conveyed, and also
the notes therein described, to the
said Exchange National Bank of
Rome, Georgia; and
Whereas, the said Exchange Nation
al Bank of Rome, Georgia, did trans
fer, set over and assign the said deed
made to it, as well as the said deed as
signed to it by the Rome Hardware
company; and
Whereas, said Exchange National
Bank did heretofore transfer, set over
and assign unto the National City
Bank of Rome, Georgia, all of its
rights, title and interest in and to
the property conveyed by it as afore
said, as well as the property convey
ed to the Rome Hardware company,
and did sell, transfer and assign to
the said National City Bank of Rome,
Georgia, all of its rights, title and in
terest in and to said deed, and all its
rights and powers thereunder, as
well as its right and title in the notes
in said two deeds described; and
Whereas, Simpson Grocery comp
any did, heretofore to-wit, on the 15th
day of October, 1926, transfer and as
sign its said warranty deed to secure
debt, with all the rights, remedies and
powers included therein, and all its
rights, title and interest in and to the
property conveyed thereby, to the
said National City Bank of Rome,
Georgia, and did also transfer to the
said National City Bank of Rome,
Georgia, the notes therein described;
and
Whereas, the National City Bank
of Rome, Georgia, is now the true ow
ner and holder of all the notes des
cribed in the said three deeds, and is
the true owner and holder of the title
to the property under all of said three
deeds, and by assignment has all the
rights, powers and privileges given
under the said three deeds and does
stand in the place of the original
grantees under each and all of the
said three deeds;
NOW, THEREFORE, By reason of
the foregoing, and under and by vir
tue of the powers of sale contained in
the said three deeds, all of the notes
mentioned in the said three deeds be
ing long past due, the said National
City Bank of Rome, Georgia, will of
fer for sale, to the highest bidder for
cash, at the Court House door in Sum
merville, Chattooga county, Georgia,
on the 7th day of December, 1926, be
tween the legal hours of sade, to-wit,
between ten o’clock, a.m., and two
o’clock, p.m., on said date, the follow
ing described real estate conveyed in
the said deed, to-wit:
Those tracts or parcels of land sit
uated, lying and being in the county
of Chattooga, state of Georgia, des
cribed as follows:
Tract No. 2. Commencing on the
original line at the public road near
parsonage, running 66 rods due west;
thence South 87 rods to T. R. Mor
ton’s line at a rock corner; thence 66
rods in an Easterly direction with
Morton’s line to public road leading
from Sugligna to New; thence in a
[Northerly direction with said road to
starting point. Bounded as follows, on
the North by M. E. church property,
East by J. M. Keown, South by T. R. 1
I Morton. Said land lying and being in
' the 25th district and 3rd section, and
‘ containing 35 acres, more or less, of
land lot number 74.

undivided interest in lots of land num
bers 175 and 176, which lie on the

land supposed to contain 220 acres.

the North half of 88 acres, more or
less, of lot of land number 151, di
viding line of said 88 acres running

lands of Susan D. Salmon. Said road
having been reserved when deed was
made to Susan D. Salmon. This deed
is intended to convey all interest, tit
le and claim that said John W. Sal
mon has in said descried land.
