Under and by virtue of an order
granted at the May term, 1933, of the
Court of Ordinary of said county,
there will be sold at public outcry to
the highest and best bidder for cash,
within the legal hours of sale on the
first Tuesday in November, 1936,
next, before the courthouse door of
said county, as property of the estate
of D. C. Greeson, late of said county,
deceased, the following described
tract of land, lying in Lot of Land
No. 83 in the Sixth district and
Fourth section of said county, to-wit:
A tract of one acre, more or less, lo
cated and bounded as follows, Begin
ning where the north line of a tract
called the Housch land in said lot of
land, strikes the west; edge of the
State Highway right-of-way; thence
running along the west edge of said
highway right-of-way 203 feet, north
wardly; thence running 217 feet,
westwardly to the east edge of the
right-of-way of the Central of Geor
gia Railway company; thence run
ning 203 feet, southwardly along said
edge of said railway right-of-way;
thence running 217 feet, eastwardly,
to the point of beginning at the west
edge of said right-of-way of .said
State Highway. No bid for less than
SSOO for said land will be accepted.

lines as follows: Beginning at 0. T.
House’s land line; thence running
north with the public road 146 feet
to an iron stob; thence south with
ditch 240 feet to O. T. House’s land
line; thence west 287 feet to starting
point, as described in the bond for
title made by F. S. Greer to Ernest
Graham and recorded in Book 20,
Page 495 of the Deed Records of
said county; the said Ernest Graham
being the same person as said Earnest
Arthia Graham, deceased.

Kelly, solicitor General of the Rome
Judicial Circuit, in the Superior
Court of Chattooga County, Georgia
against the Gore School District of
Chattooga county,, Georgia, wherein
the Judge of said Court has passed
an order| requiring all persons to
show cause on or before the 9th day
of October, 1936, at 10 o’clock a.m.
at his office in the court house in
said county, why an order should not
be entered in said cause validating
the issuance of bonds for the purpose
of building and equipping a school
house or houses in and for said
Gore School district in the amount of
$5,000.00 (Five thousand dollars) as
therein referred to. And notice is
hereby given that on above date at
the office of said Judge at the said
court house the hearing of said
course upon the question of the vali
dation of said bonds will be had.

Court of Ordinary of Chattoga Coun
ty, Ga., will be sold at public outcry
to the highest and best bidder for
cash, on the first Tuesday in Novem
ver, 1936, before the Courthouse
door in said County, within the legal
hours of sale, the following described
lands belonging to the estate of Miss
Judie Dunn, late of Chattooga Coun
ty, Georgia, deceased, to-wit:
An undivided one-half interest in
and to fifty-two (52) acres, more oi
less, of lot of land No. 84 in the 13th
District and 4th Section of Chattoo
ga County, Georgia, said 52 acres
being bounded on the West by the
LaFayette and Menlo public road, on
the South by the lands formerly be
longing to O. B. Chandler, now own
ed by John L. Yancey, on the North
by the road leading from the afore
said LaFayette and Menlo Public
road east to Summerville; and on the
East by the following described line:
Beginning at the South edge of the
aforesaid public road leading to Sum
merville, and on the north line of
said lot No. 84, at a point eight or
ten feet northeast of an old well in
the old barn lot of Valentine Ham
mond, which well is northeast of the
corner of the old V. Hammond barn
place; thence from said point south
wardly along the east line of the old
barn lot fence to the first corner;
thence, in order to inclose crib in said
52-acre tract, southwestwardly by
straight line to, and diagonally across
lane to where a fence runs westward
ly from the west side of said lane:
thence, westwardly along said
last named fence to the East line of
a fifty (50) acre tract surveyed by
F. E. Schmidt, and by Julius Rink,
severally; thenc'e South along said
last named lane to the original South
line of said lot No. 84; said East line
being run so as to include the dwell
ing house, bam and outbuildings, here
tofore belonging to Valentine Ham
mond. Said lands being those occu
pied by the said Miss Judie Dunn at
the time of her death.

NOTICE OF SALE.
GEORGIA, Chattooga County:
WHEREAS, Heretofore, to-wit: On
the 2nd day of November, 1931, Mrs.
M. A. Ellison and J. E. Ellison did
execute to the Farmers & Merchants
Bank, of Summerville, Ga., a certain
security deed to the following de
scribed tract of land in the Thirteenth
district and Fourth section of Chat
ooga County, Georgia, to-wit:
Lot of Land No. 271 containing 160
acres, more or less, and Lot of Land
No. 270 contaniing 160 acres, more or
less, excepting from said last named
lot the tracts therein owned by E. S.
Taylor and George Agnew, the part
of said lot herein conveyed contain
ing 104 acres, more or less, bounded
on the North, West and South by
original land lines and on the East
by the lands of said E. S. Taylor,
which lies in the Northeast portion
thereof and by the lands of George
Agnew which lies in the Southeast
portion of said lot, to secure a note
described in said obligation and to
secure any other present or future
liability of the makers to the said
Farmers & Merchants Bank, which
said security deed is recorded in the
office of the Clerk of the Superior
Court of said County, Book 19, Page
132, and,
Whereas, on the 7th day of Octo
ber, 1936, the Farmers & Merchants
Bank conveyed to the undersigned
the said note and the said security
deed and the land therein described
and the undersigned, the said Chat
tooga County Bank is the owner and
holder of said deed and said note, and,
whereas, said note is in default as to
the principal thereof,
NOW, THEREFORE, according to
the terms of said security deed and
the laws in such cases made and pro
vided, the undersigned will expose
for sale to the highest and best bid
der for cash the lands above describ
ed on the first Tuesday in November,
1936, within the legal hours of sale
before the Courthouse door in Sum
merville, Chattooga County, Georgia.
One of the grantors, Mrs. M. A.
Ellison, in said deed to secure debt
having died since the execution there
of the above described property is
advertised and will be sold as the
property of J. E. Ellison and of the
estate of Mrs. M. A. Ellison, for the
purpose of paying the indebtedness
of the said J. E. Ellison and of Mrs.
M. A. Ellison to the undersigned.
A deed will be executed to the pur
chaser as authorized by the afore
mentioned loan deed.

By virtue of an order of the Su
oerior Court of Chattooga County,
Georgia, in the case Gridley vs. Star
bird, et al., there will be sold at pub
lic outcry, between the legal hours of
sale, on the first Tuesday in Novem
ber, next, before the courthouse door
in Summerville, Chattooga, Georgia,
to the highest bidder, for cash, all of
the property, lines and equipment of
the Summerville Telephone Company,
consisting of the telephone lines of
said Confpany, poles, wires, tele
phones, switchboards (except the au
tomatic switchboard at Menlo), also
all notes and accounts receivable of
said Receiver (excepting only such
claim as may be had by the Receiver’
against the bond of the previous Re
ceiver) ; the truck to be sold subject
to the balance of purchase money
due thereon, which is to be assumed
by the purchaser at said sale. Said
property to be sold free of all liens
and encumbrances, and the sale is to
be made subject to the confirmation
of the court after the report by the
Receiver of said sale to the court.

25 feet by 140 feet, and the building
thereon fronting on 7th avenue (Main
Street) adjoining the T. P. Baker

25, this lot being a part of the orig
inal land lot No. 249 in the Town of
Menlo, Ga., in the 13th district and
4th section of Chattooga Co., Ga.

sued from the Superior Court of

GEORGIA, Chattooga County:
Persuant to an order passed at the
September term, 1936, of Floyd Coun
ty Court of Ordinary, will be sold to
the highest bidder for cash, the fol
lowing described property, to-wit:
Two-thirds undivided interest in and
to lots of land No. 1 in the Twenty
fifth district and Fourth section of
Chattooga county, Georgia. Also lot
No- 324 in the Fifth district and
Fourth section of said county, ex
cepting from Lot No. 1 that part
owned and occupied by J. L. Coulter.
Said property known as the John
Barber place, containing 280 acres,
more or less.
Said property is sold as the prop
erty of Dr. L. A. Mallicoat in his life
time, and since his death the same is
the property of Ann Mallicoat (now
Plymer), Syible Mallicoat and James
Mallicoat, and is sold by order of
said court for the support and main
tenance of said three named minor
children.
The full interest to said land will
be obtained by the purchaser, the
said Daughtery Mallicoat and Mrs.
Gertrude Mallicoat agreeing to take
whatever sum that said land is
knocked off at, the extra two-thirds
to be paid to them.

said Receiver and the property in
the hands of the Receiver, with the
privilege thereafter given to any
person, within fifteen days thereaft
er, to file objections to such inter
ontion.
It is further ordered, considered
and adjudged by the Court That, any
creditor failing to file intervention
in accordance with this order, within
the time prescribed by this court,
shall be barred from any claim
against the assets of said estate in
the hands of said Receiver.

That a copy of this order be publish
ed in The Summerville News and
that the same be mailed by the Re
ceiver to all creditors listed by him
in his report heretofore made to the
