ing the quantity of the distilled
spirits contained therein and
evidencing payment of the tax
imposed thereon;
(d) To unlawfully, wilfully
and knowingly remove, deposit
and conceal and be concerned
with the removal, depositing and
concealing of distilled spirits
upon which a tax is imposed,
with intent to defraud the Unit
ed States of the tax so imposed;
te) Also to unlawfully, wilful
ly and knowingly carry and de
liver, aid and abet each other
to carry and deliver raw mate
rials and supplies consisting of
containers, coke, malt, yeast,
cans, firewood, syrup, and other
materials and supplies to dis
tillers set up for the production
of spirituous liquors which were
not registered as required by
law;
(f) Also it was a part of said
conspiracy, confederation, agree
ment and understanding that
the defendant Alexander H.
Glenn, as the duly elected and
acting Sheriff of Chattooga'
County, charged with the duties
of upholding the constitution
and laws of the United States
and the State of Georgia, would
accept and did accept certain
payments and contributions of
money, and also of illicit whis
key from the other defendants
and co-conspirators. for the con
sideration that he, as Sheriff of
said County, would not molest or
arrest said fellow conspirators
for violation of the State and[
Federal laws pertaining to illicit
nontaxpaid whiskey, and would
advise them of the arrival and
presence within Chattooga Coun
ty, Georgia, of any outside State
or Federal officers charged with
the duty of enforcing the rev
enue laws of the United States
pertaining to distilled spirits and \
particularly whiskey;
(g) Also that defendant Edd
Knight would manufacture and
have manufactured in Gilmer
and Fanning Counties, Georgia,
and deliver to the other defend
ants and co-conspirators large
amounts of illicit whiskey;
It was further agreed and un
derstood that when said defend
ant Edd Knight was without an
available supply of nontaxpaid
whiskey, he would act as a brok
er for the other co-conspirators
in locating, purchasing and
loading illicit whiskey from oth
er sources and distilleries with
in said Gilmer and Fannin
Counties, Georgia, all of which
illicit whiskey was to be trans
ported and sold at both whoe-

to your Grand Jurors unknown;
And the Grand Jurors afore
said charge that, having so con
spired, combined, confederated,
agreed and having made a tacit
understanding as aforesaid, the
defendants and their co-conspir
ators as aforesaid, in further
ance of said unlawful, wilful, fe
lonious, corrupt and and fraud
ulent conspiracy, confederation,
combination, agreement and un
derstanding, and to effect the
objects and purposes of the
same, defendants and other co
conspirators did commit numer
ous overt acts in the Rome and
Atlanta Division of the Northern
District of Georgia, and did aid
and abet and counsel each oth
er in the commission of said acts,
among which overt acts were
the following:
1. During the first part of the
year 1945, the exact date being
to your Grand Jurors unknown
co-conspirators David Koonce
and Earl Bramlett entered into
the retail illicit whiskey business
in Chattooga County, Georgia,
with defendant Alexander H.
Glenn, the sheriff of said county.
(2) On or about January 1,
1945, defendant General Gordon
Hartline solicited “donations” of
money from David A. Koonce for
defendant Alexander H. Glenn.
(3) On or about February 1,
1945, David A. Koonce paid de
fendant Glenn $150.00 in cash.
(4) On or about February 1,
1945, J. G. Teems, alias “Whiz
zer” Teems, paid defendant
Glenn $50.00 in cash.
(5) During the years 1945 and
1946, the exact dates being to
your Grand Jurors unknown, the
defendant Glenn collected vari
ous other amounts of money
from defenant General Gordon
Hartline and Bishop Koonce,
David A. Koonce, Earl Bunyan
Bramlett, the exact amounts be
ing to your Grand Jurors un
known.
(6) On or about May 1. 1945,
the defendant Edd Knight, in
Gilmer and Fannin Counties,
Georgia, began to manufacture
and have manufactured large
quantities of illicit whiskey for
the members of said conspiracy
and confederation.
(7) On or about May 9, 1945,
defendant Edd Knight deposit
ed and caused to be deposited
approximately 87 gallons of non
tax-paid whiskey on an automo
bile in possession of co-conspir
ator Robert Siffels and a lady
accomplice.
(8) On or about May 9, 1945,
; co-conspirator Robert Siffels

from Gilmer County to Murray
County, Georgia.
(9) During July, 1945, defend
ant Hartline carried on a large
■ illicit retail liquor business at
his home.
(10» On or about July 1, 1945,
defendant Edd Knight made a
trip to Summerville, Georgia, to
discuss with other conspirators
their illicit whiskey business.
(11) On or about the Ist day
of September, 1945, Earl Bram
lett purchased a 1935 model
Chevrolet coupe for use in the
illicit whiskey traffic then being
conducted by these defendants
and co-conspirators, and to
transport nontaxpaid whiskey
'from defendant Edd Knight in
Gilmer County, Georgia, to Chat
tooga County.
(12) On or about October 27,
1945, Julian Russell Barnes
transported seventy - one and
one-half (7iy 2 > gallons of non
taxpaid whiskey from Gilmer
County to Murray County, Geor
gia, at which time Julian Barnes
had in his possession a check
book on the Commercial Bank
of Trion, Georgia, and personal
mail matter of Earl Bramlett.
j (13) On or about October 27,
1945, John W. Marshall also
‘transported one hundred four
1(104) gallons of nontaxpaid
whiskey on a 1934 Ford sedan
from Gilmer County, Georgia, to
Murray County, Georgia.
(14) During November, 1945,
the defendants Alexander H.
Glenn and General Gordon
Hartline and co-conspirators Da
i vid Allen Koonce, Bishop B.
Koonce and Tom Parham held
a conference in the private sec
tion of the Sheriff’s room in the
county courthouse at Summer
ville, Georgia, pertaining to their
illicit whiskey syndicate, con
spiracy and confederation afore
said.
(15) During the first part of
1946, the exact date being to
your Grand Jurors unknown, the
defendant Edd Knight and co
conspirators Earl Bramlett, Da
vid Koonce, John H. Marshal.
Robert B. Stiffels and George
W. Teems held and had a con
versation in the Gulf Service
Station at Summerville, Georgia,
concerning their illicit whiskey.
(16) During January, 1946, co
conspirators Robert D. Price and
Esley J. Bradley, under the di
rection of David Koonce, set up
an illicit distillery on the Da
vis Wells property in Dade Coun
ty, Georgia.
(17) On or about March 1,
|1946, defendant Edd Knight
[hired George W. Teems to trans
port illicit whiskey on a 1945
Chevrolet truck from Gilmer
County, Georgia, to Summerville,
Georgia.
(18» On or about March 1,
1946, Earl Bramlett went to the
.home of defendant Edd Knight,
[in Gilmer County, Georgia, in a
1945 Chevrolet truck purported
ly owned by co-conspirator
George W. Teems.
<l9> On or about March 2,
1946, between midnight and
morning, the defendant Edd
Knight supervised the loading of
three hundred (300) gallons of
nontaxpaid whiskey on a 1945
Chevrolet truck in the lower part
of Fannin County, Georgia.
(20) On or about March 2,
11946, John H. Marshal and Earl
Bunyan Bramlett, accompanied
by Helen Marshal and a Miss
Parker, between midnight and
morning patrolled the highway
in the vicinity of Morgantown,
in Fanning County, Georgia, for
the purpose of preventing the
arrest by Federal officers and
the Sheriff of said county of co
conspirator George W. Teems,
who at that time was transport
ing three hundred (300) gallons
of nontaxpaid whiskey for the
defendants in said county on a
truck owned by Earl Bunyan
Bramlett.
(21) On or about March 10,
1946, Earl Bunyan Bramlett fur
nished a 1939 Chevrolet coach to

two (42) gallons of nontaxpaid
whiskey from Gilmer County to
Chattooga County, Georgia.
(22) On or about February 22,
1946, David Koonce, Robert D.
Price-and Esley J. Bradley erect
ed and operated an illicit distil
lery in Dade County, Georgia.
' (23» On or about July 19, 1946,
Earl Bunyan Bramlett and Bish
op Blackman Koonce sold to an
undercover agent of the United
States Internal Revenue Service
eighteen (18) gallons of nontax
| paid whiskey in Chattooga Coun
|ty, Georgia.
(24) On or about August 2,
1946, Earl Bunyan Bramlett and
Bishop Blackman Koonce sold to
an undercover agent of the
United States Internal Revenue
Service twenty-four (24) gallons
of nontaxpaid whiskey in Chat
tooga County, Georgia.
(25) On or about August 2,
1946, Rufus Franklin Spain and
Earl Bunyan Bramlett had set
up and in operation a nonregis
tered distillery near the back
yard of Bramlett’s home at Ber
ryton. Chattooga County, Geor
gia.
I (26) On or about August 7,
1946, Earl Bunyan Bramlett and
I Rufus Franklin Spain carried on
the business of wholesale liquor
dealers without having regis
tered as required by law.
(27) During approximately the
period from March 1, 1945, to De
jcember 30, 1946, defendant Edd
Knight supplied approximately
3,325 gallons of illicit whiskey to
co-conspirator Earl B. Bramlett
for unlawful distribution in
Chattooga County, Georgia, and
also other large amounts to the
various other co-conspirators,
the exact amounts and dates be
ing to your Grand Jurors un
known.
(28) During the night of
March 11-12, 1947, defendant Edd
Knight held conference with co
conspirator David A. Koonce,
Earl Bramlett and others in
Room 340, Piedmont Hotel, At
lanta, Georgia, within hearing of
an agent of the Internal Reve
nue Service, at which time de
fendant Edd Knight discussed
the illicit whiskey business and
stated, among other things, that
“somebody has let the cat out
of the bag, but as soon as the
legislature is over I will fix
things in my section so nobody
will swear anything and you fel
lows fix up things over there.”
And so the Grand Jurors do
charge that all the overt acts
herein alleged to have been com
mitted were committed in fur
therance of the said described
wilful, unlawful, fraudulent and
felonious conspiracy, combina
tion, agreement, confederation
and understanding and to effect
the objects and purposes of the
same;
