Local Man Sentenced to
25-Years Hard Labor
John Henry McCutchins, a
24-year-old black ex-soldier,
was sentenced recently to 25
years at hard labor by Col.
Richard L. Jones, military
judge.
McCutchins pleaded guilty
to rape and related charges in
an incident last Nov. 10 in
volving the white wife of a
lieutenant colonel.
The judge imposed sentence
after hearing evidence on
McCutchins’s prior criminal
record and his outstanding per
formance as a prisoner, in
cluding serving as vice-pres
ident of the Jaycees at the
disciplinary barracks.
An agreement was reached
between the defense attorneys
and the reviewing authority for
the court-martial, Maj. Gen. '
John J. Hennessey, that the |
sentence would be reduced to
15 years in exchange for the
guilty plea, according to court
sources. General Hennessey, [
commanding general of Ft.
Leavenworth, has the power of
review in all military trials.
Capt. Alan J. Chaset, the
military defense attorney, said
the case would be appealed to
the Court of Military Review.

civilian defense lawyers who

lenges to the Army’s death
penalty and the method of jury
selection in the court-martial
on charges of rape, attempted
murder, unlawful entry and
parole violation.
The sentence will begin
after McCutchins completes a
20-year sentence for the 1969
rape of a Ft. Lewis, Wash.,
woman. He previously was con
victed on two counts of as
sault. He was on parolee status
at the time of the incident
here.
In arguments today, Capt.
Chaset asked the judge for
leniency and compassion,
saying McCutchins’s guilty plea
had spared the woman victim
the emotional upset of appear
ing in a trial and describing the
। incident.
He said McCutchins already
has spent four years in jail and
should have the opportunity
for release before losing all
ability to function in society.
“This is a very atrocious
I crime,” Capt. Sandy Tucker,
the prosecutor, told the judge.

McCutchins briefly took the
stand and said he had partici
pated in sports activities in the
Seven Step Foundation pro
gram when he was in the
disciplinary barracks. He also
was a band member and a
blood donor. His foreman in a
barber shop, Sgt. I.C. Leonard
Bates, said he was an “out
standing worker” frequently
requested by customers.
Also testifying was an older
sister of McCutchins, Mrs.
Viola Price, of Summerville.
Their mother, who sat quietly
in the courtroom, supported
the family with welfare checks.
“He’s just so young to be
getting into some trouble like
this,” she said. “We need him
at home. I still can’t believe he
did it.”

Mrs. Dewey Ashworth, recent

day, March 11 at the home of
Mrs. Ernest Wofford, 707 W.
Washington St. Mrs. Betty Ash
worth assisted Mrs. Wofford.
Several interesting games
were enjoyed by those attend
ing, with Mrs. Wofford in
charge.

from ladies who were unable to
attend.
