NOTICE AND INSTRUCTIONS
TO BIDDERS
March 3, 1975
1. Sealed b»ds will be received by
the Cloudland improvement Asso
ciation, Inc., Cloudland, Georgia,
hereinafter referred to as the
“Owner,” for performing the work
as set forth <n the Plans and Specif
• cations to be attached hereto, on
or before 10 00 a.m. (EOT) on
April 3, 1975 in the office of Wil
liams, Sweitzer and Barnum, Inc.,
Engineers. 2232 Redmond Circle,
Rome, Georgia, at which time and
place said bids will be publicly
opened and read.
2. Afi bids must be made on the
blank form of proposal to be fur
mshed. The work consists of the
following approximate quantities;
4” Water Main, 3,100 L.F.; 2”
Water Mam 4,610 L.F ; Pump
Station. 1 Each; Complete. Seal,
Existing Well, L.S.; Drill, Test,
Complete. Seal New Well, L.S.
Plus valves, fittings, connections
to existing system, and other asso
ciated work items
Proposals shall be submitted in a
sealed envelope addressed to The
Cloudland Improvement Associa
non, Inc., c/o Williams, Sweitzer
and Barnum, Engineers, P.O. Box
1386. Rome, Georgia 30161
And Marked "PROPOSAL FOR
WATER SYSTEM”
3. Each bid must be accom
panied by a certified check or
bidder's bond payable to the Owner
for live percent of the total amount
of tne bid As soon as the bid prices
have been compared, the Owner
will return the check or bond ol all
except the three lowest responsible
bidders When the contract is
awarded, the checks or bonds of
the two remaining unsuccessful
bidders will be retained until the
contract surety bond have been
executed and approved, after which
it win be returned.
4. A performance and payment
bond in the amount of 100 percent
of the contract price with a cor
porate surety approved by the
Owner and the Engineer, will be
required for the faithful per
formance of me contract, and the
bidder snail state in the proposal
the name and address of tne surety
or sureties who will sign this bond
m case the contract is awarded to
him. The Contractor will be re
quired to remedy any defects in the
work and pay for any damage to
other work resulting therefrom
which snail appear within a period
of one year from the date of final
acceptance of the work.
5. The party to whom the con
tract is awarded will be required
forthwith to execute the contract
and a performance and payment
bond within ten calendar days from
the date when the written notice of
the award of the contract is mailed
to the bidder at tne address given
by him. In case of failure to do so.
the Owner may at this option con
srder that the bidder has abandoned
the contract, in winch case the cer
tilted check or bidder’s bond
accompanying the proposal shah
become th* property of the Owner
6. Dre Owner reserves the tight
to reject any and all bids or to
accept any bid It is understood
that the work to be done is being
financed with a loan and grant from
the Farmers Home Administration,
U.S Department of Agriculture
Contractor's proposals shall hold
firn) for sixty days to allow the
Owner to complete its financing
arrangements. Mutually agreed
upon extensions of time may be
made, if necessary
7 Bidders must comply with the
President's Executive order Nos
11246. and 11 375, which prohibit
discrimination m employment re
garding race, creed, color, sex, or
national origin.
8 Bidders must comply with
title VI of the Civil Rights Act of
1964. and Anti Kickback Act and
the Contract Work Hours Standards
Act
9 Bidders must certify that they

10 Before the award of the con
tract, any bidder may be required
to furnish evidence satisfactory to

11 Prior to signing the contract,
the Contractor shall submit on a
form acceptable to the Owner and
Engineer, an overall construction
schedule for the project This con
struction schedule shall start with
the proposed date of signing the
contract, and the completion date
shall be the date specified in the
contiac t
12 Bidders must satisfy them
selves by personal examination of
the location of the proposed work,
by examination of the Plans and
Specifications and requirements of
the woik and the accuracy of the
estimate of the quantities of the
work to be done, and shall not at
any time after the submission of a
bid dispute or complain of such
estimate nor assert that there was
any misunderstanding in regard to
the nature or amount of work to be
done
13. The Construction Contract
and the Detailed Specifications con
tam the provisions required for the
construction ol the project No

officer, agent, or employee of the
Owner on any such matters shall in
any way affect the risk of obhga

17. The successful bidder will be
required to secure and maintain the
following types of insurance, which
are listed in detail in the General
and Special Conditions;
(a) Statutory Workers Coinpen

and Property Damage
(c) Automobile Public Liability
and Property Damage
(d) Fire and Extended coverage
(e) Builders Risk
18. Computation of quantities
that win be the basis for payment
estimates both monthly and final,
will be made by the Engineer.
19. The word “Owner” means
the Cloudland improvement Asso
ciation. Inc The Owner wilt be
responsible for payment in accord
ance with the terms ol tne contract.
The word "Contractor” means
the person, firm or corporation to
whom the award is made. Subcon
tractors as such wifi not be recog
nized.
The word "Engineer” refers to
the firm of Williams, Sweitzer and
Barnum, Inc. designated by the
Owner as its engineering representa
five during the course of construc
tion to make appropriate inspec
tions and computations of pay
ments.
The word " Representative"
means the State Director of the
farmers Home Administration or
his designee.
20. Plans and Specifications may
be obtained from Williams,
Sweitzer and Barnum, Inc,. F. O.
Box 1386, Rome, Georgia, 30161.
A payment of $20.00 will be
required for the Plans and Specifi
cations. SIO.OO of which will be
refunded to those returning them in
good condition within ten days
after the date of the bid opening.
Successful bidders will receive full
refund.
21 Should a bidder find
discrepancies in, or omissions from,
the Plans, Specifications or other
documents, or should he be in
doubt as to their true meaning, he
shah at once notify the Engineer. If
necessary a written addendum will
be sent to each bidder, Neither the
Owner nor tne Engineer will be
responsible for any other explana
tion or interpretation.
22. The contract for each
Section will be awarded. if
awarded, ttj the lowest qualified
bidder or bidders complying with
these instructions. The Owner re
serves the right to judge the qualifi
cations of any bidder and to deter
mine the low bid by comparing
bids, selecting alternatives, making
deductions, if provided for on the
Proposal form.
The Correct total amount of the
bid will be determining as the sum
of she amounts bid for individual
items in the proposal. The correct
amount bid for individual items
shall be the product of quantity
listed tune the unit price bid for the
item The Owner reserves the right
to make corrections in the multipli
cation to determine the correct bid
for individual items.
Any unauthorized conditions,
limitations, or provisions attached
to the proposal, except as provided
for herein, will render it Informal
and may cause its rejection.
Unbalanced bids will be subject
to rejection.
The Owner reserves the right to
reject any or all bids, or to waive
any informality, or to accept any
bid or combination of bids, which,
• n the Owner’s judgement, will best
serve his interest.

Justice. Said conveyance was made
