Mountain Echoes
their crying.
There were Cherokees here 140 years
ago. This place of trees and mountains
was not merely their home. It was their
universe. The ruthless villainy that was
for so long our national policy toward the
Indians has now been replaced with an of
ficial benevolence and contrition that is
almost excessive. But money will not cor
rect the wrong that was done in 1838. I
am not naive enough to believe that there
is any way to correct the wrongs done to
the Indian,
It is, of course, a comedy, the
Passamaquoddy Indians laying claim to
half the state of Maine. Or a
Massachusetts court pondering whether
a group of Mashpee Indians are Mashpee
enough to legally press a claim for all the
undeveloped land in Mashpee, Mass.
It is all for nothing. What might be
given back in Maine would have to be
given back in all the states. Such action
would only result in riots and revolution.
The courts that desegregated the white
man’s schools are not powerful enough to
dispossess the white man from his home.
There was, you see, another court deci
sion, in 1830. It could have and should
have resolved the Indian-rights conflict
for all the decades that followed. It was
equal to the Supreme Court’s decision in
Brown vs. Board of Education in 1954.
4 Before that decision in 1830, the
i{ Cherokees had adapted to the white
! man’s ways. They created their own writ
{ ten language, opened schools and began
! their own newspaper in North Georgia,
{ The Phoenix. They took up farming, built
| plantations and even adopted their white
! neighbors’ infamous institution —
i slavery.
For the whites of Georgia, this was
not enough and never would be. The white

man still considered the Cherokees
savages, Laws were passed giving the
state sovereignty over the Cherokees, and
this opened the way to steal from them
and rape their squaws without persecu
tion, The whites stole much of the In
dians’ land.
Being civilized men, the Cherokees
took their land cases all the way up to the
Supreme Court. In two decisions,
Cherokee Nation vs. Georgia and Wor
chester vs. Georgia, Chief Justice John
Marshall and his court ruled for the In
dians.
If those rulings had been honored, and
if those rulings had been followed as
precedent, the history of the developing
United States would have been less
violent. The Passamaquoddies and the
Mashpees would now be content.
But it fell to President Andrew
Jackson, the Indian fighter and Indian
hater, to enforce those rulings. He is
reported to have said, ‘‘John Marshall
can go to hell!”’
Jackson was a bully, mean enough to
have dogfights and cockfights at the
White House. He scared Congress into
passing his Indian Removal Act. The Ar
my, at Jackson’s order, dispatched troops
to North Georgia. The Cherokees were
dragged from their homes and driven like
cattle through the wilderness to what is
now Oklahoma. The path they followed
came to be known as the ‘‘Trail of Tears.”
Indians were beaten and bull-whipped
along the way. They were half starved to
death. Some of the men were hanged
when they protested the rape of their
women by the soldiers.
It all began in the North Georgia
mountains around Calhoun and Talking
Rock. Such injustice is reason enough for
ghosts and troubled spirits.
