Several local video rental
businesses are agparently
unaware of state laws pro
hibiting the rental or posses
sion of video ta'ses containing
X-rated material, accordtiei:ig to
a phone survey conducted by
The Summerville News this
week.
When queried by The News,
managers at the majority of
businesses stated that they did
not carry any X-rated
materials because such video
tag‘e: are illegal in Georiia.
Others freel){ admitted that
they carry X-rated tapes for
rental to adults; tapes which
are disgiayed in rooms
separate from the qeneral au
dience and children’s sections
of their stores. One sales per
son stated that his location
rented only X-rated t(a{l:es to
persons over 21, and did not
rent R or general audience
tapes.
Another merchant stated
that the tfie limit for X-rated
tape rental is 18.
Still other merchants stated
that it is against state codes

have stated that the issue is a
very ex‘plosive one for Georgia
law enforcement officials and
local governments at present.

and cities have cracked down
on the sale and rental of the
pornographic materials.
“Every county handles it
different.lx." stated an Atlanta
video distributor whose
business operates state wide.
“This issue is so unclear. The
onll?: thing I can tell you is that
in Fulton County they will ab
solutely put you under the jail
for rental of X-rated video
tapes. It's generally whatever
zhe local community pushes

Fort Oglethorfie business
man Butch Cordell, who owns
a chain of video rental stores,
stated that the law against por
nographic materials of an)e'
kind, including the rental of X
rated video tapes, is strictly en
forced in his community.
“There used to be a problem
with this sort of thian in Fort
Ofilethorpe," Cordell stated.
“However, local civic and
church groups, and the tide of
fublic opinion have stopped it.
t is against the law here to sell
any tZPe of pornographic
material, even magazines like
Playboy. It is a matter of the
community’s interest and in
volvement that makes the dif
ference.”
Cordell stated that
although rental of X-rated
tapes is allowed just across the
Tennessee state line, it is
against the law in Georgia, and
in Fort Oglethorpe it is
enforced.
According to the Official
Code of Georgia, selling or
loaning for monetary con
sideration to a so%mn:

nudity, or sexual conduct is
unlawful.
Section 16-12-80 of the
OCGA states: A fperson com
mits the offense of distributing
obscene materials when he
sells, lends, rents, leases;fl'ves,

any person any obscene
material of anK description,
knowing the obscene nature
thereof, or possesses such
material with the intent to do
