Lomenick Disputes
Account By Powell

count established last June by
Sheriff Gary McConnell.
Powell told The News in
mid-September that he had
fi/llven a copy of a check from
cConnell to the county, to
the foreman of the August
term Chattooga Grand ftlllry
and that the check had then
been turned over to Lomenick.
In a handwritten letter to
McConnell dated Sept. 17,
Powell said he was referring
the matter to Lomenick, coun
ty attorney Ed Surles and
Georgia Attorney General
Michael Bowers.

Last week, Powell told
Summerville radio station
WGTA that he had given the
check to Lomenick and the
district attorney acted like he
wanted to make fun of the
matter.

However, Lomenick strong
ly denied that Powell had given
him a check written by the
sheriff or asked him to in
vestigate the account opened
by McConnell.
“I don't recall Mr. Powell
giving me any kind of check or
copy of a check or requesting
any investigation. An% I deny
laughing in his face!
“I'm not in any position to
give advice on county mat
ters,” the district attorney
said. “'l'm not aware of what
Mr. Powell's talking about. To
mdy knowledge, he's never turn
ed a check or copy of a check
over to me. Those matters are
something between Mr. Powell
and the sheriff.”
The district attorney seem
baffled about Powell's com
ments. “‘l'm just not aware of
what Mr. Powell's problem is.
If he had turned anything over
to me or my assistants, it
would be in our files in Sum
merville and it's not there."”
It is not the district at
torney's responsibility to con
duct criminal investigations,
Lomenick said, adding that
such matters are left up to law
enforcement personnel, such as
the sheriff or Geo’rfi‘ia Bureau
of Investigation. The district
attorney’s office can't proceed
in a case until it has a warrant
in his office, Lomenick
indicated.

Commissioner Powell has
called the account a ‘“‘personal
account’’ of Sheriff McConnell
and said the sheriff can't legal
ly handle money.
The sheriff said about a
month ago that he established
the jail account last June to
hancile deposits of checks from
cities and counties and the
state for boarding prisoners at
the county jail. He wrote one
check to Powell July 7 for
$26,367.50 (apparently the
check Powell was referring to
last month and last week) for
deposit in the county's general
fund. No check was written In
August. In mid-September,
McConnell wrote Powell
another check for $46,015 for
deposit in the countls)"s general
fund. Checks will be written
monthly, McConnell said.
The News has viewed all
the bank statements since the
account was opened, as well as
stubs and copies of all the
checks written by the state,
cities and counties to McCon
nell as sheriff that were
deposited in the account. iny
two checks have been written
on the account — both to
Powell. The account is in the
name of McConnell as sheriff of
Chattooga County. It is
located at First Federal Sav
ings and Loan Association,
Summerville, and it is an
interest-drawing monei’
market account. McConnell
has said — and the cancelled
checks bear him out — that the
interest also is being paid to
Chattooga County. :
The account is not in the
name of McConnell personally,
but rather in his capacity as
sheriff of the county. Checks
made out by cities and counties
and the state for boarding of
prisoners are not made out to
Chattooga County but rather
to McConnell as sheriff.

it is illegal for the sheriff to
handle county funds. In an un
dated letter sent to McConnell
in September, Powell quoted a |
1964 state law applicable to
Chattooga which said, *‘All
fees, costs, fines and other pre
quisites of whatever kindp as
are now or may hereafter be
allowed by law to be received
or collected by the sheriff shall
be collected by him for the sole
use of Chattooga County and
shall be the property of Chat

appear to prohibit the sheriff
from having an official jail ac
count and paying those funds
to the county each month.
In Georgia, many sheriffs
collect cash bonds and other
monies and turn the funds over
to the county once a month.

'POWELL REFUSES DATA

| the final installment of the
] county's federal revenue shar
ing check. However, amount of
the check was $41,185.
Asked Tuesday about the
amount of the check, Powell
said, *“That ain't none of your
business because you don't get
' none of the revenue sharing!
' That ain't none of your
business!"'
However, the federal Office
~of Revenue Sharing,
Washington, D.C., said the
amount of Chattooqa County's
check was $41,185. 1t was mail
ed to the county on Sept. 30.
