Busby pointed out that he
wears a hearing aid and hadn’t
heard the flames crackling
before he was awakened while
coughing.
“If he'd been sound asleep,
he wouldn't have woke up,” his
wife said. Her husband had
delivered a television set to the
Lyerly home of her mother,
Mrs. Gladys Hartline, that
morning and, as a consequence,

at Riegel Textile Corp., Trion.
FACTOR
Another factor that may
have saved Busby's life was
the fact that he had closed his
bedroom door, keeping most of
the smoke and the flames away
from the inside of the bedroom.
The interior of the house,
except for the utility room, was
gutted by the blaze.
Busby and his wife said
they were renting the dwelling.
They didn’t have insurance on
the contents and they didn't
know whether the owner, now
in Florida, had fire insurance
on the building itself. They
have three children.
A number of Lyerly and
Summerville volunteer firemen
responded to the alarm. The
Summerville trucks were back
at the station by 1:57 p.m.
Tuesday.
PENNVILLE FIRE
The Summerville Fire
Department responded to a fire
at the home of Mr. and Mrs.
Don Wright, Pennville, at 2:51
a.m. Tuesday. Fireman James
Archer said the couple was
awakened by frantic barking
from their dog. They
discovered that most of the
house was afire. They have one
child.
And fireman Eddie Hender
son, who was off duty and
asleep at his nearby home, said
his (S)og also began barking
madly, causing him to look out
side and see efforts being made
to extinguish the blaze. He
pulled on clothing and ran to
the fire scene to assist.
Extensive damage was
reported to the house. Firemen
were back at the station by
4:12 a.m.
VACANT HOUSE
An apparently vacant
house on Sf)ring Street in West
Summerville was destroyed by
fire Monday night. Firemen
responded to an alarm at the
blazing house at 7:50 p.m. and
were on duty until 8:50 p.m.
. The house was owned by
Jeff Betts, Berryton, according
to Chattooga County Dep.
Richard Gifford. A possib?e
case of arson was being in
vestigated, he added.
Firemen also responded to
a fire in a trash dumpster at
Chattooga County Higg School
at 6:50 dp.m. Sunday, reports in
dicated. They were back at the
station by 7:07 p.m.

Extensive Damage Caused To Residence
Grand Jury
Gets Ring
Theft Case
Two suspects in the theft of
a $5,900 ring were bound over
to the February term Grand

ly Wednesday evening follow
ing a day of preliminary hear
ings on various cases.
Bound over to the jury were
Timothy Brian Hamilton, 23,
and John Wayne Donalson,
both of Rome agdresses. Payne
reduced Hamilton's bond from
$40,000 to $30,000 and
Donalson’s bond from $50,000
to $25,000. Assistant District
Attorney James Franklin had
no objection to the reduction.
Hamilton and Donalson are
both charged in connection
with the theft of a ring valued
at $5,900 from Fuller Jewelry
Co., 12 Commerce St., Sum
merville, last Oct. 29.

day. They iad been charged in
early December. Payne said the
charges were dismissed due to
a lack of evidence, plus the fact
that the state does not have a
“*breaking and entering”’ viola
tion listed in its laws.
A hearing on a bad check
charge against Mid Allen IV
was continued to a later date
by Payne.
In a related case, Payne
bound Billy Joe Dooley, 20,
Summervilfi; Rte. 3, over to the
Grand Jury on theft by conver
sion charges. Similar charges
against Larry Joe Dooley, 49,
Summerville Rte. 3, were
dismissed Wednesday by
Payne. Mid Allen IV had filed
the charges against the
Dooleys.
John William Reynolds, 49,
Lyerly Rte. 1, was bound over
to the Grand Jury Wednesday
on charges of aggravated child
molestation. He was charged
last Oct. 29. Warrants said
Reynolds was charged with
commiting “‘immoral and inde
cent acts to a 13-year-old girl,
which involved sodomy . .."
OTHER HEARINGS
In other preliminary hear
ings before Payne earlier this
week, Dewayne Bentley was
bound over to the February
term Grand Jury on charges of
aggravated assault and simple
battery.
Donna Jo Chapman, charg
ed with writing a bad check,
was also bound over to the
Grand Jury.
A hearing for Tim Evans,
charged with burglary, will be
rescheduled.
Johnny Freeman, charged
with burglary, was bound over
to the Grand Jury.
Aggravated assault
charges against Cedric Price
were dismissed when his alleg
ed victim failed to prosecute
the case.
Tony Wooten, charged with
aggravated assault, also was
bound over to the Grand Jury.
The aggravated assau{t
charge against Johnny
Youngblood was dismissed for
lack of evidence.
The burglary charge
against David R. Smith was
dismissed for lack of evidence.
And charges of criminal
damage to property in the se
cond degree against Larry
Steele were dismissed due to
failure of the alleged victim to
prosecute.
A hearing for Jane
Totherow, charged with first
degree forgery, will be
rescheduled.
Clara Walker, charged with
two counts of writing bad
checks, was bound over to the
Grand Jury.
Max V\yilson Jr., charged
with aggravated assault, was
bound over to the Grand Jury.

Cowan joined the U.S.
Chamber staff as Texas
district manager in the
southwestern division in May,
1966 and was named
Southwestern Regional
Manager in February, 1971.
Prior to 1966, Cowan serv
ed as executive vice president
of four local chambers of com
merce, all in Texas.
Cowan is a graduate of
McMurray Colle%e in Abilene,
Texas and complete graduate
studies at the University of
Texas. Cowan served in the
U. S. Army during the Korean
conflict.
He is married and has two
sons.

Widening Of Town Creek Bridge
Widening of the Town Creek Bridge on
U.S. Highway 27 at First Avenue in
Summerville continued this week. Addi
tional work is being done on the east side
of the initial bridge expansion. The bridge
also is scheduleg to ge widened on the

16 Face DUI Charges
Sixteen people were ar
rested during the past week on
charges of driving under the in
fluence of intoxicants (DUI),
most of them on New Year's
Day.
They include:
Jackie Wayne Ellis, 42,
Summerville Rte. 5, was also
charged with driving on the
wrong side of the road, with a
suspended license and leaving
the scene of an accident. He
was still in jail near noon
Wednesday.
Terry Russell Green, 23, ad
dress not available, was also
charged with fleeing and at
tempting to elude officers,
obstructing officers and on a
bench warrant on habitual
violator charges. He was
released to the Walker County
Sheriff’s Office.
Alton Henry Roan, 25,
Thieves Take
Car Supplies
The Chattooga County
Sheriff’'s Department is in
vestigating the theft of almost
SI,OOO in tools and supplies
from Ideal Used Cars, Sum
merville Rte. 3, late last week.
Dep. P.R. Hill said Billy
Joe Dooley, Summerville Rte.
3, listed as missing a grinder,
grinder brush, 24 cans of paint,
36 cans of silicone spray, five
gallons of wheel cleaner, two
gallons of tire dressing and a
gallon of interior dressing, and
a tool box and tools owned by
an employee. Value of all the
items was estimated at $957.
Hill said the items were
reported stolen last Friday
night.
Someone also took a bat
tery and tool box for a small
pickup truck from a barn near
the home of Gerald Dempsey,
Bolling Road, last Friday
night, said Dep. Richard Gif
ford. Two cases of oil and a
chainsaw had been taken from
the barn in earlier unreported
incidents, said Gifford.
Two firearms were stolen
from homes in separate in
cidents at the beginning of
1987.
Dep. Ken Anderson said a
.38 cafiber revolver owned by
Thomas Wofford, Menlo, was
stolen last Friday. It was

.22 caliber magnum pistol was
stolen from the home of Leroy
Hunter, Summerville Rte. 2, on
Jan. 1. Entry was gained
through a rear door, she said.
Someone shot through the
windshield and hood of a 1972
pickup truck owned by Mike
Middleton, Summerville Rte. 5,
while he was driving east on
Highway 48 near Menlo early
Tuesday morning, said Dep.
Tammy Owings.
The shots were fired from
the passenger side of a black
pickup truck passed by Mid
dleton, reports indicated.
A man picked up two
12-can packs of beer from Dis
count Food Mart, Central
Avenue, Trion, on New Year's
Day and walked out without
paying for the items, said Dep.
