A Chattooga County con
tractor has filed a half-million
dollar damage suit in Superior
Court against a local tree
qunsg]antini operation. The
suit charges that the firm caus
ed a fire that destroyed the
contractor’s residence and all
his equipment.
It was filed by Lebron
Beene, Dry Valley Road, Sum
merville Rte. 3, against Larry
Simpson, Victor §impson and
Quinn Simpson, doing business
as Simpson Brothers Tree
Transplanting Service and
Simpson Brothers Farm, the
lawsuit said.
Summerville attorney
Carlton Vines represents Beene
in the case.
While transplanting trees
on Beene's property on March
17, 1986, the suit says, Victor
Simpson ‘... negligently
allowed a tree transplanting
machine that he was driving to
collide with (Beene's) residence.
Said collision caused a fire to
ignite at said residence and
totally destroyed the residence
and all contents therein.”
The property “‘was covered
with dead vegetation all of
which were highly combustible
due to the dry season,” the suit
continued. The fire spread and
destroyed a mobile home, out
buildings, numerous motor
vehicles and tools and other
items, all valued in excess of
$250,000, it added.
Beene was a self-employed
contractor at the time and due
to the loss of his equipment, he
has been unable to conduct
business, causing him to lose
$60,000 in profits, the suit said.
It asks for a total of
$500,000 in damages, plus
costs.

For Trion
April 1 is the deadline for
Trion homeowners to apply for
various homestead or school
tax exemptions, Mayor J. C.
Woods announced this week.
Residents 65 years of age
and older who own their own
home may apply for a $2,000
homestead exemption from the
city by that date. Proof of age
is required, the mayor said, and
may include a birth certificate,
delayed birth certificate,
driver's license, birth cer
tificate of children, marriage
certificate, military service
discharge papers or an in
surance policy at least five
years old showing the date of
birth.
Residents who received a
homestead exemption from
Trion in 1986 don't need to
apply again this year, Mayor
Woods said. Anyone who
became 65 during last year and
meets the other requirements
should apply for homestead ex
emption prior to the deadline,
he said.
In addition, homeowners 62
years of age or older by Jan. 1
of this year may also qualify by
April 1 for a school tax exemp
tion, the mayor said. To
qualify, a person must own his
own house and live in the
residence and total household
income can't exceed SB,OOO, the
mayor said. That means in
come from all sources, in
cluding Social Security, and
from anyone in the household,
whether any money is received
from that party, Woods said.
No homestead or school tax
exemption afpplications will be
accepted after the April 1
