The Summerville-Trion Optimist Club has
presented a check to the Northwest
Georgia Mental Health Center for the
center’s special projects. Presenting the
Legality Of Tax Exempt
Proposal Still Unknown
Lyerly's city attorney had
not been contacted by town of
ficials as of Monday afternoon
for an opinion on whether it
could grant tax-free status to
Bigelow-Sanford Inc. if it were
annexed.
Ed Surles, Lyerly’s at
torney, said late Monday after
noon that he had not been ask
ed by city officials whether the
gropo_sal was legal under
eorgia's state constitution.
PROPOSAL
Although no official action
was taken at Lyerly's Dec. 8
Council meeting, city officials
indicated that they planned to
draft a proposed Ketter to the
carpet company promising not
to levy property taxes against
the Lyerly plant if it were an
nexed into the town.
Mayor Danny Wyatt and
clerk Gwen Benti;ey said at the

Dec. 8 session that the letter
would be presented to a later
meeting of the Council.
Surles said church property
used for religious services and
§>rograms would be exems)t
rom propertg taxes, as would
property used for a public pur
pose but “I don’t know about
a private corporation.”
The city attorney said he
planned to research the issue
and make contact with Lyerly
officials.
DOUBTS
Another Summerville
lawyer expressed doubt as to
the legality of the proposal. He
said other property owners in
Lyerly couft)i probably file suit
against the measure if it were
enacted, saying that they were
being treated differently than
the industry.
Lyerly officials said on Dec.
check to Center official Sharon Narey
were Ogtimists Fondren Wright, left, and
Mark Sentell. (Staff Photo).
8 that the city would receive a
franchise fee from Georgia
Power Co., which serves the
plant, and the town would
charge business license fees to
vendors which serve the com
f)any, eliminating the need for
evying a property tax against
the mill.
The town on Dec. 8 agreed
to sell water to Bigelow after
purchasing it from
Summerville.
TUESDAY NIGHT
At Tuesday night's
meetiné of the Lyerly Council,
city officials confirmed that
they hadn’t gotten in touch
with Surles on the issue.
Councilman William Ander
son said one Lyerly property
ov«xlger had already approached
hifi to complain about the ci
ty offerin% to exempt the mill
property from taxation.
Councilwoman Ann
Jackson mentioned the
possibility of abolishing all ci
ty taxes ify Bigelow would agree
to be annexed. Wyatt saigr he
felt the cit shoulgl be sure the
mill wouldy come into the city
before abolishing taxes.
Anderson predicted that
the mill wouldn't agree to be
annexed regardless of the ci
ty's offers.
