at 2 pm today in the Hill
Chapeg of Lane f‘"uneral Home
with the Rev. Willie Bearden
officiating.
Interment will be in West
Hill Cemetery.
Judge Upholds Powell Defense
A federal court judge in
Rome has denied 2 motion by
the attorney of 2 Summerville
man to strike four defenses
raised by Chattooga County
Commissioner Harry Powell in
a lawsuit against the official
Judge Harold Murphy
denied the motion filed by at
torney John Sawhill on behalf
of John England. a former
county employee.
Sawhill had sought to have
four defensive responses filed
by Powell stricken by the
judge. Those defenses were
that the commissioner had
acted in good faith and in a
manner believed by him to be
lawful. that E d’s claim
wasn't presented in a timely
manner, that the action was
barred by an applicable statute
of limitations and that
recovery was barred by a legal
doctrine. They were filed on
Powell s behalf by Summerville
attorney Bobby Lee Cook Sr.
DENIED
“Upon reviewing the com
plaint as well as t.hegbriefs sub
mitted by the parties . . . the
court finds that substantial
questions of fact and law exist
as to the defenses raised by
Powell,”” Judge Murphy wrote
in his order. At this stage of
the litigation, the alleged insuf
ficiency of the defenses is not
clearly apparent. Moreover, it
