This proposal changes the title of
the office of State School Superin
tendent to the office of commis
sioner of education and provides
that the commissioner shall be ap
pointed by the State Board of Ed
ucation. The proposal changes the
method of selecting the executive
officer of the State Board of Educa
tion, which method is currently
election by the entire voters of the
state to a four-year term concurrent
with the term of the Governor. The
new method of selection provided
by the proposal is appointment by
the State Board of Education for
such term of office as the board
shall determine but not exceeding
four years. The proposal includes
certain technical changes in various
constitutional provisions necessary
and consistent with the proposed
change in the method of selection
for this public office.

of public funds for the purpose of
compensating innocent victims of
crimes and for the administration of
laws enacted for such purpose.

This proposal provides that sov
ereign immunity of the state ex
tends to all state boards, commis
sions, and authorities as well as
state departments and agencies.
The proposal provides that the
waiver of sovereign immunity for
counties, municipalities, and school
districts shall be separate from the
waiver of sovereign immunity of
state entities and shall be as pro
vided in Article IX, Section 11, Par
agraph IX of the Constitution. The
proposal provides for the waiver of
the defense of sovereign immunity
to any action for recovery of actual
damages arising from the breach of
any written contract entered into by
the state or a state entity. The pro
posal authorizes the General As
sembly to extend liability insurance
coverage to all state entities and
provides for a limited waiver of
sovereign immunity where liability
insurance is so provided. The pro
posal provides that the defense of
sovereign immunity is not waived
as to any claim for punitive, vin
dictive, or exemplary damages
regardless of insurance. Official
immunity is extended to state of
ficers and employees in the per
formance of their discretionary
functions, and the General Assem
bly is authorized to purchase liabil
ity insurance protection for state
officers and employees so that they
shall not be subject to personal lia
bility to the extent they are not oth
erwise immune from liability. The
proposal provides that the sover
eign immunity of the state or any of
its departments, agencies, boards,
commissions, or authorities may
hereafter be waived further by the
General Assembly but only to the
extent explicitly provided by law.
Finally, the waiver of sovereign
immunity or official immunity
provided under this constitutional
provision shall apply only to actions
brought in the courts of Georgia and
shall not constitute a waiver of any
immunity provided to the state by
the Constitution of the United
States.

disbursement of the fund in the
form of loans or investments and
directed to provide for repayment,
rents, dividends, royalties, or
other forms of return on in
vestments as provided for by law.
The General Assembly is author
ized to appropriate money to the
fund and the money in the fund
which remains unexpended at the
end of the state fiscal year will
remain in the fund rather than be
returned to the state’s general
fund. Moneys received from
returns on loans or investments
will be deposited in the fund for
further disbursement.

and become incorporated into the
Constitution by the first day of
January following each general
election or upon the effective date
of the provision affected, which
everis later.

property located on an island and
within the boundaries of an indus
trial area created pursuant to an
amendment to the Constitution of
1877 or 1945. The proposal provides
that the owner of such property
may remove the property from the
industrial area, together with
certain included or adjacent public
streets and rights of way. Any
property so removed from an in
dustrial area may thereafter be
annexed into the corporate limits
of any adjacent municipality.

poses in order to encourage the
preservation of historic property
and the revitalization of historic
areas.

This proposal authorizes the
General Assembly to provide by
general law for the creation of an
Indigent Care Trust Fund. Any
hospital, hospital authority,
county, or municipality is author
ized to contribute to the fund and
any other person or entity speci
fied by the General Assembly may
also contribute to the fund. Moneys
in the fund shall be exclusively
appropriated to expand Medicaid
eligibility to persons and for serv
ices which would otherwise not be
eligible for Medicaid coverage to
provide for indigent care with
programs for rural and dis
proportionate indigent care pro
viders, and primary care health
programs for indigent citizens of
this state. Contributions to the fund
shall not lapse to the general fund
of the state treasury and shall not
be subject to the requirement that
revenue be paid into the general
fund. Moneys in the fund which are
not apmo%:iated as provided
above shall be refunded pro rata to
the contributors thereof.

This proposal authorizes any
municipality having a population
of 400,000 or more to issue in any
one year not more than $8 million
in general obligation bonds for
other than school purposes without
a referendum but subject to
certain limitations. The issuance
of the bonds must be authorized at
a public hearing, and any person
may prepare and circulate a peti
tion for a referendum. If at least 5
percent of the city’s voters sign a
petition within specified time lim
its a referendum will be held
unless the city withdraws the pro
posal from further consideration.
This authorization for bonded in
debtedness is in addition to the
amount of bonds which may be
issued without a referendum under
any authority previously
possessed by the city. Theissuance
of such additional indebtedness is
subject to existing constitutional
limitations applicable to said city
concerning the aggregate amount
of all outstanding bonds.

Craft-Fest
On Oct. 29
The second craft-fest will be
held Saturday, Oct. 29, at the
entrance to Big Texas Valley
High Country, north of Rome.
Craft exhibitors from all
over Georgia and Alabama will
display their wares from 10
a.m. until 6 p.m. In case of rain,
the craft-fest will be held Sun
day, Oct. 30.
Admission to the event will
be $2 per dperson with
youngsters under 12 years of
age admitted free to the all-day
activities.
Area residents wanting to
exhibit their crafts may do so
by calling 857-5711 before 6
%.m. or 234-1424 after 6 p.m.

There will be a S2O set-up fee
for each booth, but no commis
sion will be charged.
The day-long event will be
held at the entrance to the Big
Texas Valley High Country
recreation resort, located on
Big Texas Valley Road in nor
thern Floyd County. Motorists
should take Sike Storey Road
off U. S. Highway 27, turn on
to Big Texas Valley Road and
travel approximately six miles
to the site.
Signs will be set up along
Highway 27 to direct motorists
to the fest. Additional signs
will also be displayed along the
route to assist motorists to the
resort area.
A vast array of crafts will
be on display throughout the
fest. A concession stand will
also be set up featuring ham
burgers, hot gogs, soft firinks,
chips and baked goods.

‘Tears’
Descendants of native
Americans will return to New
Echota on Oct. 29 to mark the
150th anniversary of their
removal from their North
Georgia homeland to the west
on the Trail of Tears.
New Echota, the former
ca{)ital of the Cherokee Nation,
will host commemorative ac
tivities beginning at 10 a.m.
with a Cherokee flag raising.
The keynote speaker at the
commemoration will be Dfé)u
ti Principal Chief John Ket
cher of the Cherokee Nation of
Oklahoma. Several represen
tatives of the Eastern Igand of
Cherokees from North Carolina
and officials of the National
Park Service and the State of
Georgia will also speak during
the ceremonies.

Cherokee Phoenix newspaper,
Yrinted at New Echota from
828-1834, and some of the
original lead printing type us
ed at the Phoenix printing of
fice, will be given to Chief %(et
cher during thgr }clommemora
tion program. e t was
cast specially in the gl‘\):rokee
language by a factory in
Boston in 1827. In 1954, this
type was uncovered at New
Echota during archaeological
excavations. The Phoenix and
the type will be placed in the
Cherokee National Museum in
Tahlequah, Okla.
In addition, a 25-foot
granite monument will be
dedicated and a tree planting
will take place in memory of
the 4,000 Cherokees who died
on the Trail of Tears. Other ac
tivities taking place from 11
a.m. to 4:30 p.m. include: tradi
tional dances by Cherokees of
North Carolina, blowgun
shooting, ball play, cooking
and demonstrations of several
Indian crafts such as basket
weaving and pottery.
