CAP CADETS SEEK SOURCE OF SIGNAL

White Gap area of Taylors
Ridge shortly after 7 am.

The Federal Aviation Ad
ministration notified the CAP
that an Emell'gency Locator
Transmitter (ELT) was sen
ding a signal to a satellite
somewhere in that area. Most
aircraft contain an ELT which
is supposed to help searchers
locate downed aircraft.
The sheriff’s office, Chat
tooga County Emergenc¥
Management Agency, CA
and a number of citizen
volunteers mounted a search of
the area.
The source of the signal was
found about 4:15 p.m. Satur
day at the home of Dale
Fowler, Summerville Rte. 4,
Inv. Whitley said. Fowler is a
helicopter Eilot who had land
ed at his home, and had ac
cidentally left the emergeeg
signal in operation, he added.
Comeco
Seeks
Relief
An insurance company bas
ed in Texas is seeking a sum
mary judgment that it
shouldn’t have to defend the
Chattooga County ogerators of
a private club in a sl.l million
lawsuit.
Comco Insurance Co. is
seeking the judgment in U. S.
District Court at Rome. It has
contended that it shouldn’t
have to defend Sonny and Lin
da Reece in a suit filed against
them in Chattooga County
Superior Court. That suit was
filed by Jeanette C. Shore,
Trion, in the allefed beating of
her son, Roy Clifton Shore, at
the club on May 26, 1990.
The Shore man, 20, died
shortly after the alleged
beating incident in a traffic ac
cident in Trion.
Mrs. Shore filed the original
suit against the Reeces as well
as against Danny RIRI Bryant,
Barry Thomas, aymond
Bethune, and Mike Mec-
Whorter. They have denied any
resglonsibility in connection
with the alleged incident.

JUDGMENT%
A declaratory ju ent

the case without a trial. It is
generally used when there isn’t
any dispute about the facts of
a case and one party is entitl
ed to judgment as a matter of
law.

posts. The insurance company
also stated that the Reeces had
rented part of the building
from Amvets Post 92 for their
club, but that the Amvets post

ment of the Reeces’ private

do with it. The insurance,

the suit indicated.
Comco contended that it is
not obligated to defend the
Reeces against the lawsuit by
Mrs. Shore.
Adams Sues Selective
Over WSAF Insurance
A second counter-suit has

counter-suit in U. S. District
Court at Rome against Selec-,
tive Insurance Co.
Denise and Tommy Fisher
the owners of WSAF-AM, had
earlier filed a countersuit
ainst Selective Insurance in
aattooga County Superior
Court.
Both suits indicated that
the Federal Communications

Adams. RTC allesed that
Selective should tpay t instead
of the owners of the station.
The RTC said it had assum
ed reaponsibilitly for assuring
payment of a loan originally
made by First Federal Savings
and Loan Assn. First Federal
became insolvent and the RTC
assumed control of the
operation.
RTC said ‘‘a mistake” had

RTC had agreed to allow them
to discontinue further
payments on the loan until the
insurance ggg)ceeds were
distributed. They said they
notified Guffin & Eleam, a
Summerville insurance agency,
that the motr:gage holders
should be lis as the loss
payees on the policy.
They also countersued
Selective, charging that the
company had refused to gay
the insurance proceeds. The
Fishers and WSAF also charg
ed that the insurance company
had failed to state its inten
tions on whether it intended to
pay the proceeds.
They asked for $354,386,
plus punitive damages and at
torney’s fees.
FEDERAL COURT
Selective then went into
federal court at Rome, asking
that it issue a declarnborg'dudg
ment on which party should be
given the insurance proceeds.
Adams and Safe, in their
resPonse to the Selective suit
in federal court, said there was
no disagreement between all
the parties over distribution of
the insurance proceeds from
Selective.
Selective refused to pay the
proceeds within 30 days from
the time the sworn notice of
loss was filed, the countersuit
asserted. Selective had not
ng(t)iufied Adams or the Fishers
about its intentions on payin,
the proceeds, Adams chnrge(f.
He asked for payment of
$354,386, dplus punitive
dam and the expense of
the I‘i’gzsation.
