James Melvin Smith, 35, 127
Byrd Station Rd., Silver Creek,
was arrested following the in
cident. He was released on
$50,000 bail bond.
When they arrived at the
mobile home of Donna Jean
Brown, Tennessee Street, Lyer
ly, Sheriff Kellett said, Deps.
Ken Anderson and Stan Smith
found that Brannon Brown, 38,
Summerville Rte. 5, had been
shot. He suffered two 9mm
caliber fiistol wounds to his

Brown was reported in
“satisfactory’’ condition at
Floyd Medical Center at 9 a.m.
Wednesday.
Sheriff {(ellet;t said the bone
in Brown’s right thigh had
been shattered by one of the
shots.
Brown and Ms. Brown had
been divorced since November,
1993, Sheriff Kellett said.
Brown walked into his ex
wife’'s mobile home shortly
before 8:30 a.m. Sunday, the
sheriff continued, and allefied
ly threatened to kill Smith.
Smith fled to the kitchen on
the opposite end of the mobile
home, Kellett said. Brown
chased him and grabbed Smith
in a “bear hug” around his
arms and chest, the sheriff
added.
Smith then bent over with
Brown, still holding him and
pulled out a 9mm semi
automatic pistol and fired bet
ween his legs into Brown
thighs, the sheriff said. Brown
was not armed, Kellett said.
Smith and Ms. Brown had
been on a date, the sheriff said,
when her former husband walk
ed into the mobile home.
Both Smith and Ms. Brown
gave a statement at the
sheriff’s offiee after the
shooting, he said.
The Chattooga County
Emet:%ency Medical Service
treated Brown at the scene and
took him to the FMC trauma
center, Sheriff Kellett said.
Major Drug Ring Busted Here
Two Cloudland residents
have been arrested in what
Sheriff Ralph Kellett called the
breakiné up of a major drug
rin%in hattooga County.

Myron Abby Spencer, 47, and
Frances D. Bafii%er, 31, Old
Gilreath Mill Road, Cloudland.
They were charged with felony
violations of the state’s drug
laws, including possessins
marijuana for resale, an
possessing more than one
ounce of marijuana.
Spencer was also charged
with criminal damage to pro
%erty in an unrelatetf incident.

The arrests were made on
Wednesday evening, Feb. 9, at
the Spencer residence.

Spencer's home to serve the
criminal damage warrant.
Spencer hag been charged
with tearing down a gate and

was estimated at $1,510.
Campbell said he saw
Spencer snuff out what ap
peared to be a marijuana
cigarette through the window
of the home when deputies ar
rived. When Spencer was ar
rested on the criminal damage
warrant, Campbell said, he saw
enouih evidence to obtain a
search warrant for Spencer’s
house.
Ms. Ballinger and a man
were arrested at the time but
the man was freed without
charges being filed, Campbell
said.

A Trion man has been ar
rested on aggravated assault
charges after he allegedly
broke the arm of a woman at
his home about 12:30 p.m. Sun
day. A warrant identified him
as Bobby Wayne Slglyton. 36,
1034 Jason Dr., Trion. It
stated that Slayton allegedly
trapped Melinda Slayton bet
ween a door and the
refrigerator and slammed the
door on her, breaking her left
shoulder. She was treated at
Chattooga County Hospital.
In other matters, Dep. Pam
Lesperance reported that John
Nix, Allen Street, Summerville,
loaned his car to a man “for a
couple of hours” but the car
was never returned Friday or
Saturday. One report indicated
that the 1976 model car may
have been sold in Rome.
A 1978 model car owned by
Lisa Brown, Trion Rte. 1, was
reported stolen from her yard
lS)unday afternoon, according to
ep. Lesperance.
A .22 caliber pistol valued
at S2OO was reported stolen
from the home of Brent
Whaley, Summerville Rte. 4, at
an unknown time, she said. The
report was dated Feb. 8.

Moses, Trion Rte. 1, when it
was shot from a BB gun, Dep.
Stan Smith said. The incident
occurred sometime Sunday, he

ARRESTS
Among arrests made this
past week were the following:
— Fred L. Wright Jr., 38,
Parham Lane, Summerville
Rte. 1, was arrested Saturday
on terroristic threats and acts
charges. He was also being
held for the Georgia Board of
Pardons and Paroles.
— Terry L. Teems, 37,
Sidney Street, Summerville,
was charged Saturday with
theft by conversion.
— Byron E. Hines, 56, Sum
merville Rte. 5, was charged
with simlfi{e batteg Saturday.
— Willie Patrick White, 36,
Scoggins Street, Summerville,
was charged with disorderlly
conduct and violation of parole
