By its platform upon which it swept
k the country November Bth, the demo
cratic congress stands pledged to repeal
the law taxing state banks 10 per cent.,
and if congress does repeal that tax,
Georgia will be in shape to get the benefits
- f it at once; i. e.,if the following bill, in-
Xrt n, iced by Martin Calvin, of Richmond
,count* is passed by the present legis
lature.
Mr Calvin is certainly confident that
the democratic congress will fulfill the
party | ilJdge by repealing the prohibito
ry 10 per cent, tax on state banks, and
many prominent democrats are of a sim
ilar opinion. Mr. Calvin has introduced
this bill because he believes that the
Georgia banks should be put in position
at once to avail themselves of enlarged
banking facilities in a safely-guarded cir
culating medium.
Mr. Calvin says that the bill intro
duced is not as perfect as he would have
it, but the committee on banks and the
legislature will remedy any and all of its
t defects. It is a measure in whica the
F whole state is conceriped, Dalton, Whit
field county and North Georgia as much
ns any other section, and The Argus
gives the bill to its readers that they may
know what is being done on the line of
‘more money,” and may have a chance
of protesting against or endorsing the
proposed legislation.
The bill is entitled an act to authorize
ami provide for the preparation ami is
suance to the banks and banking asso
ciation of the state of circulating notes;
to fully protect the sanje and for other
purposes. Briefly the purposes of the
bill Ae ennumerated as follows:
1. The governor, the treasurer and the
comptroller general of the state are con
stituted a commission authorized and re
quired to cause to be printed and en
graved such quantity of circulating notes,
pn blank, of denominations not greater
than one thousand dollars and less than
(One dollar, as they may deem necessary.
2. These notes, lirst nutpbered, regis
tered and countersigned by the comp
troller g moral, are tu be issued to any
bank in an amount not less than fifty
thousand dollars, or more than 75 per
■ cent, of its capital upon said bank, depos
p iting with the treasurer of the state,
Georgia state bonds, or United States
bonds, or Georgia municipal bonds, in
an aiqount equal to the amount of circu
lating notes for which they apply.
3. If any bank receiving such notes
refuses or delays payment in gold, silver
or lawful money of the United States of
any such note put into circulation by it
and presented for payment in the usual

hours of business, it shall pay damage to
the holder of such note at the rate of 24
per cent, per annum during the period
of delay, and the holder may cause said
notes to be protested. Upon receipt of
notice of protest the commissioners shall
notify the bank, and if it neglects to re
deem the same in gold or silver or law
ful money for ten days after such notice,
the commissioners shall proceed to re
deem all circulating notes of such bank
out of the trust funds in the hands of the
state treasurer.
4. The plates, dies and material for
printing the circulating notes, are to je
main in the custody of the comptroller
general, under the control and direction

5. 'lt is made unlawiul for the comp
troller general to countersign such au
thorized circulating note, for any bank,
to an ; mount in excess of the amount of
bonds deposited by such banks to secure
said notes. If the comptroller violates
provisions of this sec tion, he shad be
punished by a tine oi mA, less than five
thousand dollars, or imprisoned for not
| less than five year.-, or bom, in the dis
, cretion of the court.
6. These note-, before bring put into
! circulation by a bank, shall be signed by
! the president or vice pi—-i lent and the
I cashier of said bank. That any bank,
j which shall lend or place any of these
circulating notes with an agieen ent or
understanding that they shall not be put
into immediate and unrestricted circula
tion, or shall not be returned to said
bank within a limited time, shall forfeit
a sum not exceeding one-half, or less
than one-fourth of the a mount so loaned
or placed,
7. Any bank may, at any time, return
any portion of its circulating notes to its
commissioners, and said notes shall, in
the presence of the commissi mcr and
the cashier of the directors of the bank,
be forthwith destroyed, and a certificate
showing the facts, entered upon the
proper books in the comptroller s office.
Thereupon, bonds deposited by said bank
shall be surrendered and Kstroyed.

8. The share holders in banks, taking
any one time more notes in denomina
tion under live dollars, to an amount ex
ceeding one-fourth ot its capital stock
actually paid in.

advantage of this act, in addition to lia- .
bilities already imposed by the laws of;
this state, made liable to the full amount j
of their shares for such notes.
Stockholders having reason to believe
that a bank is about to stop payment, or
surrender its franchises, cannot avoid
this liability.
10. The provisions of this act shall be
come operative as soon as practicable
after the receipt by the governor of this
state of official information, that the pro
visions of the act of the federal congress,
approved Marvh 3, 1805, which levies a
tax of 10 per cent, per annum on the cij
culbtion of all banks, chartered under,
state laws, has been repealed.
