WAS AT STAKE
HARRY L. SPENCER MAKES A
STATEMENT TO HOUSTON RE
PORTER AND TELLS WHY HE
WAS FORCED TO SHOOT.
Mr. C. G. Spencer has received a
copy of the Houston Chronicle dated
March 13, which gives further details
relative to the killing of Harry Avey,
a black faced comedian, at the Empire
theatre by Harry L. Spncer, stage
manager of the Orpheum theatre, and
an old Dalton boy.
The story says the shooting occur
red in front of the Empire theatre
and that Avey died on the way to
the hospital.
Mr. Spencer’s statement is a plain,
simple one, and his Dalton friends
will be glad to know that he was
forced into his actions.
The Chronicle says:
Police Officer Reagan was standing
nearby at the time of the shooting
and he made a rush for Spencer, ar
rested him and took him to police
headquarters, where he was locked up
on a charge of assault to murder. On
receipt of the news that Avery was
dead, however, the charge was then
changed to that of murder.
Spencer was interviewed behind
the bars by a reporter for The Chron
icle. “I don’t know’ that I ought to
say anything without consulting a
lawyer, but after all I can only tell
one story. It was family trouble.
Avery had interfered between my
wife and myself, I had begged him to
cease, had humbled myself to keep
him away and to keep the peace, but
he drove me to it.
“He has ruined my little home, has
brought dishonor upon me, upon my
wife and upon my little three-year
old baby. I never carried a gun in my
life, never owmed one until two hours
before this shooting and then Avery
forced me to get it.”
Spencer did not hesitate in telling
his story, but was overcome by his
emotions, tears filled his eyes and
choked his voice. “I had done all
that any man could do to preserve my
home and my honor, had gone on my
knees and entreated, but it had no
effect. Was there anything else for
me to do?” was Spencer's appeal to
the newspaper man.
H. L. Spencer is stage manager at
the Orpheum theatre. He is married
and has a baby three years old.Harry
Avery, it is said, is about 28 years old
and has been playing a blackface role
at the Empire theatre. It is under
stood that Avery was married and
that he bad been living at the Woods
hotel.
Officer Reagan made the arrest.
Justice McDonald was called upon
to hold the inquest.

AGED LADY DIES AT
ROCKY FACE HOME
Mrs. Mollie C. Roach, aged 76 years,
wife of Mr. Sam Roach, of Rocky
Face, passed away at her home today
her death being due to lagrippe.
She leaves four children who are as
follows: John Roads, a son by her
first husband; Mrs. Sallie Robertson,
Mrs. Alice Pope and Mr. Charles
Roach. The funeral will take place
at Rocky Face Friday.

IS MARRIED

John Shumate, one of the most
popular young men who ever lived
in Dalton, has become a married
man.
Councilman Frank E. Shumate re
ceived a letter from him this morn
ing, mailed at Columbia, S. C., where
Mr. Shumate is in business, stating
that by the time the letter was re
ceived the knot would be quietly tied.
No further details are known at pre
sent except that the fortunate young
lady was a Miss Bailey, of Columbia.
Mr. Shumate is a member of the
firm of J. L. Tapp and is one of the
most prominent dry goods men in the
Carolinas. As far as Dalton is con
cerned, the whole town is John Shu
mate’s personal friend and he will
receive the congratulations of every
body

Apropos to the recent meeting of
the Southern Commercial Congress
which occurred in Atlanta, there ap
pears to be evidences of a beneficial
character eminating therefrom that
may be helpful even to Dalton, be
cause since that meeting the Dalton
□oard of trade has received numerous
communications from the North and
North-west seeking information about
Dalton and vicinity.
Among the inquiries which have
been received by Secretary Foster
Seebold, of the Dalton Board of Trade
is one from an American-English
Syndicate desiring a 5,000 acre tract
of land for colinization purposes; a
shoe manufacturer of Rochester, N.
Y., solicits particulars regarding his
line of business starting a small plant
with modern machinery; and a gradu
ate of a Vetinary college of Kansas
City seeks information about pros
pects in his avocation.
Parties from South Carolina have
about decided to institute an automo
bile general delivery, freight and pas
senger service here.

CAUSE OF FIRE HAS NOT BEEN ASCERTAINED.
Shortly after six o'clock this moan
ing, fire broke out in room 221 on the
third floor of the Hotel Dalton and
for a few minutes there was almost a
panic among those of the guests who
were in the vicinity of the flames.
The fire w r as promptly extinguish
ed by the department and the loss
may not run over SIOO. The damaged
property is covered by insurance.
Room 221 has no fire place and was
not occupied last night. Next to the
room is a linen room and the fire
caught in some mysterious way, be
tween the walls of these two apart
ments, starting at a point near the
floor. No one has been able so far
to ascertain just how it originated.
Shortly after six o’clock a man
rooming on the floor saw smoke and
gave the alarm to Captain and Mrs.
Powell, who were on the next floor
below' and the fire alarm was imme
diately turned in.
The department did effective work
and prevented the flames from gain
ing headway. Only a portion of the
partition between the two rooms was
burned and there was naturally con
siderable water damage as it was nec-

Couple Weds in Dalton
Yesterday afternoon shortly before
4 o’clock a hack drove up in front
of Judge S. B. Felker’s office on King
street containing a handsome but ag
itated young man and a pretty and
blushing young woman.
Thecouple had driven to Dalton
from Rome and it was a case of the
old ,old story or love, which laughs
at all obstacles.
The young man was Mr. Thomas P.
Stone and the girl was Miss Clara
Carver. The young couple, it is said,
ran away from the city of hills so

Council met last night in a brief
and uneventful session. In addition
Io the appointment of the new board
of health, which was the most im
portant item of business transacted,
several other matters were taken up.
The mayor was authorized to have
the sidewalks on King street from
Hamilton to Pentz street lowered.
Some time ago the propertv owners
on the south side of King street put
in tiled walks, and now that King
street has heen graded, the walks are
much higher than the curbing. The
city will have this condition remedied.
The committee which has in hand
the locaton of a sewerage disposal
plant asked for further time, which
was granted.

When the excitement was at its
height, several women, some of them
carrying babies, came out into the cor
ridors apparently with a view to es
caping. No one knew exactly what

Mrs. Powell who knew that the
danger was not immediate, quieted

lated in an effort to have the proper
coats and trousers returned to them.
Had the fire started in the middle
of the night, it might have had a dis
asterous ending as the flames might
have gained considerable headway
before discovered.

A petition which is being circulated
in Dalton today and which was sign
ed by a number of prominent citizens,
has for its object the establishment
of proper cattle quarantine regula
tions for Whitfield county.
The petition is addressed to Com
missioner of Agriculture Hudson, and
requests that he take the matter up
and) institute a quarantine against
certain cattle. It is claimed that
such measures would do much toward
the eradication of cattle ticks among
the cows of this immediate section
and the commissioner is asked to ar
range for this quarantine during the
present season.
