Hon, K. T. Brown Mayor elect.
Mayor Brown then 'administered the
oath of office to the new aldermen,
elected via: W. C. Orr. J. H. Rueker,
[ W. A. McDowell, and II. Byers.
The mayor then delivered an address
givinghi^ views in regard to the ad
ministration ol city affairs, after which
heannnuuced the new board properly
organized and ready for business with
a full board present.
The first business in order being the
fixing of salaries, they were on motion
of Alderman Dootson taken up and
Council be fixed at 4 o’clock p. m., on
the first Monday in each month.

unanimously elected.

verdict of two hundred dollars against
the city. The city made a motion for a
new trial which waa overruled in Oc
tober and the case wae then settled,
shown by the treasurer’s report.
The case of Miss E. A. Carlton ct. al.
against the city, claiming damages to
lot on corner of Thomas and Clayton
street growing out of change of grade
of Clarion stmt, was submitted to or-
bitration. fhe arbitrators chosen were
Messrs. F. Fbinizr, B. K. Reaves. C.W.
Baldwin, A. L. Hull and E. S. Lyndon.
They made an award requiring the city
to pay one thousand dollars. The case

On motion of Alderman Booth, the
question of a change in the market laws
was referred to committee on market,
to investigate and consider, and .report

Alderman McDowell stated that the
retiring flnan.-e committee in their re
port te council recommended that on
account of the various and responsible
duties performed by the clerk of coun
cil that his salary be raised to $1,800,
and he moved that the s-lary of clerk
of council be fixed at $1,800.
Alderman Rueker stated that while
he recognized the facts stated by the
committee he did not think the city
able to pay a higher salary, and moved
as a substitute that the salary he fixed
at 31,500. Substitue adopted anti sala
ry ol clerk of council fixed at $1,500 per
annum.
Salary of Chief of Police was fixed at
of the defective condition of a small
bridge on Rock Spring avenue was tried
at the Octoiler term of the Superior
Court and resulted in a verdict against
the city for two thousand dollars. Thia
verdict was set aside by the court aud
the case was then settled, for the
amount shown in the treasurer’s re
port.
While all the forgoing cases were dis
posed of during the year just past, the
cause of action in each case originated
in previous years.
The case of the city against the
Water Works Company to compel them
to comply with their contract as to
pressure in certain parts nj the city was
settled during the year and the case or
dered to he dismissed,

gation between the Georgia Railroad

Section. That all aiuiuul licenses for
hacks, omnibuses and drays shall run
from the second Saturday in January in
each year and shall be paid in full at
tjie time the license is issued, and the
license shall expire on the second Sat
urday in January followiug the date of
issue.
Sec. All vehicles having seats for
more than four passengers are declared
to be omnibuses, and are subject to om
nibus license. AU vehicles having
seats for four passengers or less are
hacks and subject to hack license.
Sec. 3. All ordinances and parts of
ordinances in,conflict herewith are re
ported.
Dray, buss and omnibus business
was then fixed as follows:
One horse dray, $5; two horse dray,
$15; four horse dray, $20; one horse
hack, $5; two horse hack, $10; two
horse ouinibus,$15;four horse omnibus,
$20.
Alderman Orr moved that the night-
watchman, Mr. J. E. Hayes be paid
the same as last year, viz: $10 per
month for his services as night watch
man. Adopted.
The following ordinance was read
and adopted;
Be it ordained by the Mayor and
conncil of the city of Athens:
Sec. 1. That no person shall operate
in the city of Athens any flyiug jen-
ney, flying horses, merry go-around, or
similar contrivance without a license
from the clerk of council, for which the
applicant shall pay such sum as the
Mayor shall fix.
Sec. 2. Any person violating the
provisions of the above ordinance shall
be punished upon conviction as pre
scribed in section 56 of the published
ordinances.
The council then proceeded to the
election of officers, and the following
officers were then elected:
For city attorney, A, J. Cobh, Esq.,
clerk of oouncil, W. A. „GillelanU,
chief of police, D. Cran Oliver.
Alderman Rucker moved that six reg
ular policemen be elected. Adopted.
The following names were placed in
nomination for position on police force:

April term of the Superior Court. To
this suit the city filed a general demur
rer, claiming that the contract sought

to be enforced was ultra vires and void.
The Judge of the Superior Court sus
tained the demurrer and dismissed the
suit The railroad company excepted
to tne decision and the case is now
pending in the Supreme Court and will
be heard during the March term.
The General Assembly at its last ses
sion conferred upon the corporate au
thorities of the city the power to compel
the abutting real estate owners to pay
for sidewalks placed in front of their
lots. Three citizens and taxpayers of
the city, Messrs. E. W. Speer, R. L.
Moss and John Bird, applied for an In
junction to prevent the city from col
lecting from them the assessments, for
sidewalks in front of their respective
lots. The application was heard on the
18th day or December last and the
Judge refused to grant an injunction,
holding that the act was constitutional
and valid. To this decision an excep
tion was taken by the parties applying
foi an Injunction, and the clerk is now
preparing the record tor the Supreme
Court, where the case will be heard
during the present term.
Georgia Baldwin was convicted in the
Mayor’s Caurt for a violation of the
Prohibition ordinance. Upon appeal
to Council the Mayor’s decision was
affirmed and the case is now pending in
thf.JSnperior Court on a certiorari to
the decision of Council
j. Mell Couch was convicted in May
or’s Court of a similar offense, and the
decision affirmed by Council on appeal
and the case is now pending in the
Superior Court on a certiorari to the
decision of Council.

Alderman Barrow arose on a ques
tion of privilege, and explained in be
half of Mayor Hunnicutt that his ab
sence was caused by the illness of Mrs.
Hunnicutt.
At request of Mayor Hunnicutt, Mr.
Barrow extended the thanks of that of
fice to members of the council for their
cordial and efficient aid during the past
year. The mayor also expressed his
thanks for the efficient manner in which
the various officers^)! the city have dis
charged their duties, and commend them
to the incoming Council.
The monthly and annual reports of
the treasurer and chief of police were
read and received and annual reports
ordered spread on the minutes.
The following bills were ordered paid
when properly approved.

The various expenditures are shown
by the treasurers report, which also
shows that the amount of cash on hand
is seventeen thousand and forty one
36-100 dollars.
The bank bock of the treasurer and
cash in hand agree with this amount.
We refer to the report of the treasurer
for a statement of the indebtedness of
the city which it will be seen is very
small.
The committee call attention to the
unusually small amount of taxo; earned
over, which we suppose is due to the
fact that the Council mentioned the
officers in a strict enforcement of the
laws regulating the collection of taxes.
In conclusion we desire to commend
the care,'ability and faithfulness of our
city treasurer. It seems to us that an
offioer who has such various duties and
heavy responsibility should be paid a
somewhat larger salary; and we recom
mend to the incoming Council that this
salary be made eighteen hundred dol
lars. Respectfully submitted,

REPORT OF HI1ALTH COMMITTEE.
Your committee desire to call the
attention briefly to the health of past
year.
Great progress has been made in the
direction of securing better sanitary
regulations.
Our law provides for the establish
ment of a Board cf Health. The Coun
cil has given efleet to this law by elect
ing the following gentlemen: Dr. J.
A. Hunnicutt, Dr. Jno. Gerdine, Dr.
L. H. Charbonnicr, Capt. R. Nickerson,
Capt. W. A. McDowell.
This board have made valuable re
commendations which the Council
adopted and enforced.
The Council early in the year elected
Dr. J. C. Orr sanitary inspector.
It affords us great pleasure to com
mend the faithful, impartial and effi
cient manner in which Dr. Orr has dis
charged the difficult and .oftentimes
delicate duties of his office.
In retiring we venture to urge upon

Alderman McDowell stated that it
had been customary heretofore to ad
vance the officers of the Fire Depart
ment every two or three years, and, in
accordance with that custom, he would
place in nomination the following;

Second Assistant,. C. D. Flanigen;
Secretary and Treasurer Fire Brigade,
R. Nickerson.
On motion of Alderman Rucker, the
Chief of Police was authorized to em
ploy lamplighters.
The election of two members of the
Board of. Education to fill vacancies,
was postponed until next regular mcet-

of Chief of Police at two thousand dol

Alderman McDowell moved that the
