Dr. Wheeler, the medical expert who
was sent aboard to supervise the inspec
tion of immigrants, has just made a very
encouraging report as to the danger of
cholera visi'ing this country this year. Tbe
port from which the plague is most likely
to be brought here is Hamburg. Dr
Wheeler reports that there is no cholera
there, and he expresses strong hopes that
it will not break out again this summer.
The system of inspection of immigrants
he regards as so thorough that even if tbe
disease does ravage Hamburg it can be
kept from crossing the ocean. There is no
less need for the adoption of sanitary
measures in exposed cities on this side of
the water, however. Such measures will
save life and conduce to the health of
communities. Whether cholera comes or
not, aid it is beat to be prepared for an
invar ion in any event.
The question whether a tomato is a fruit
or vegetable has finally been decided by
the Supreme Court of the United States
Several years ago a line imported tomatoes
came through the custom house in New
York city,when the collector classified
them as vegetables and collected duty ac
cordingly. Toe importers diaputed this
point and claimed tomatoes to be fruit
and entitled to come in free. The matter
was taken into court which decided in
favor of tbe collector’s claim that the
tomato is a vegetable.

1871. He appealed to Minister
Grant, who brought the case to the at
tention of Count Kalnoky. protesting
that this treatment of Spitzer was
iolation of the treaty of 1870 between
Austria-Hnugary and tne Uuited States
guaranteeing certain rights and the
protection thereof to the citizens of the
respective countries.
Replying to Minister Grant’s com
plaint, Count Welsersciieimb, said that
Spitzer’s emigration to the United
States was manifestly for the purposeof
evading the military duty, that the ex
pulsion of such individuals is based
upon considerations of public order and
“that every state has a right to expel
foreigners from its territory for reasons
as above stated, and that the question
whether and when reasons for such ex
pulsion can be judged only by an inter
nal point of view.”
Minister Grant notified Count Kal
noky that this government could not
accept that interpretation of the treaty,
a position in which he was supported
by Secretary Foster, who, in a dispatch
dated Jtily 2S, 1692, said, after declar
ing that the Uuited States would enter
tain a proposition for a modification of
the treaty in question:
But so long as the treaty remains in
force the United States government will
insist upon a strict compliance with its
terms, and after a careful examination of
the cuse in point it is reluctantly obliged
to dissent from the views expressed by
the’ Austria-Hungarian government. *
* * As Spitzer was expelled on the
vague and indefinite grouuds of “the in
terests of public order,” Bud as no valid
and explicit reasous in support of the or
der are alleged, your action iu making a
formal protest Is approved by the depart
ment.
This ended the correspondence made
public, and as Spitzer’s departure for
the United States was intimated in one
of Minister Grant’s letters, it probably
closed the incident.
