tence imposed upon liim by Judge
Hutchins.
There is a motion for a new trial
pending in his cast; that may not bo set
tled before the day set for the execution
arrives,
Ool. Brown, as counsel for Brooks,
will argue the motion before Judge
Hutchins at an early date, and if Judge
Hutchins ovcrules the motion, the wise
will in all probability be carried to the
Supreme court.
This will all require time and hence
the slayer of Hunt will not mount the
gallows on the 24th.
The main ground relies! upon to secure
a new trial for Brooks is the objection
to certain evidence that was admitted.
The chief hope of Brooks, if lie should
get a new trial, is to secure a recom
mendation to mercy and save his neck.
It is not known what disposition will
1h- made of the Reynolds ease. Reynolds
will not ask for a new trial, but it may
Is) that he, too, will not bang on tlie
24th inst., as he is a material witness in
the case against Brooks.
His testimony in the trial recently at
Jefferson has been preserved and it may
lie that instead of keeping him alive to
testify in any possible future trial of
Brooks, he will be sent to the scaffold
on the 24th inst.

PRINCE AVENUE SEWERS.
Work on That Line Will be Commenced Sep
tember Fifteenth.
Capt. J. W. Barnett is now getting
everything in readiness to commence
the work of laying the new sewer mains
on Prince avenue.
This work will 1m- started on the 16th
inst., and will Is- pushed rapidly to com
pletion.
The new sewer line will extend from
Pulaski street to a point on Prince ave-
nue opposite the residence of Col. Ste
phen Upson.
It will cost about <52,200 and the in
come from the line will amount to about
11 per cent, on the investment.
Next week at the regular meeting of
the council it will be determined wheth
er or not the Hill street sewer is to be

There seems to be on all sides

The feeling among the merchants of
Athens is that the fall trade this year

brought forth;
They have accordingly laid in elegant
lines of goods and propose to do a rush
ing business.
While it is not likely that cotton will
make auy sensational advances, it is be
lieved that throughout the season the
fleecy staple in Athens will average
seveu cents.
If such should be the average condi
tion of the cotton market, prosperity
will come w T ith that condition.
Several Athens merchants have re
cently visited New York and other east
ern markets, and they say that the bus
iness men of that section are convinced
that the backbone of the jKUiic lias been
broken and that the return of prosperity
throughout the entire country is at
hand.
The sales of goods have been enor
mous, and both western and southern
firms are heavy buyers.
It is the universal opinion in New
York among the business men that the
southern farmer will receive good prices
for his cotton this season.
There are forty families now living in
Jackson county who are desirous of be
coming citizens of Clarke.
They live jnst along the line of Clarke
county, and are satisfied that it would
be to their best interests to be citizens of
this county.
They are now having drafted a bill to
be presented to the General Assembly
this fall, oskiifg that the county line be
changed.
This will no doubt be opposed by the
representatives from Jackson county.
There is no political reason for the
change as these forty families are about
equally divided between the Democratic
and Populist parties.
The seasons assigned are that Athens
is nearer to their homes than Jefferson,
that their interests are more closely con
nected with Clarke county, that the tax
rate in this county is lighter and that
this county is giving better roads over
which the farmers can bring their crops
to market.
The proposes! new line starts on the
estate of the late J. R. Nichols, inns to
the river, then up the river to Chand
ler's bridge, and then buck to the Clarke
county line.

LAYING SECOND COURSE.
A Countryman's Experience on College Avenue
Macadam.
Yesterday a countryman came driving
along College avenue and suddenly
came upon that portion of the avenue
now being macadamized.
The first layer of stones arc rough and
jugged, but that countryman had evi
dently been used to rough roads.
He drove right ou to the rough rocks,
but his horse was rather careful. He
picked his way along at a snails gait,
and as he went the darkies along the
street gazed at the strange sight with
wonder.
That didn’t phase tlie driver or the
horse in the least aud after about fifteen
minutes the feat was accomplished and
they emerged into Clayton street.
TO WHOM IT MAY CONCERN
The Macadamizing ol College Avenue Will
Progress Rapidly Now.
Yesterday morning the work of laying
the second course of stone ou College
avenue begun.
This course is of stone about the size
of a goose egg and will be two inches
.thick, being placed on top of the large
rock recently laid there.
As soon as this second layer is finished,
■ the work of putting -on the third layer
will begin. *
The third layer will be of stones about
as large as a hickory nut and when the
layer is finished the heavy roller will be
rolled over the street and the newly
macadamized avenue will be ready for
traffic.

Atlanta, Ga., Sept. 1.—H. S. Perry is
now chained in his cell and no one is
allowed to visit him.
This precaution is taken because it is
believed Perry will attempt to commit
suicide if poesible a .
Perry declares that he has been per
secuted, that Judge Candler has tried to
have him hang and that Gov. Atkinson
has just carried out the wishes of
Judge Candler.
Perry says he did wliat any true man
would have done and that he was glad
Lanier was dead.
Perry wrote a note to Gov. Atkinson
today asking him to visit him in bis cell,
bnt the chief executive of the state de
clined to do so.
Mrs. Perry is now hunting for Judge
Candler, thinking he can have some in
fluence in saving her husband’s neck.

Speaking to a prominent citizen yes
terday, a Banner reporter learned that
quite a number of citizens living in the
np-toM'n district of tlie city arc very
uixious that the city provide a high
grade school in their section of the city.
This gentleman said that scores of cit
izens M’ere forced to send their children
a mile and a half to Washington or Bax
ter street schools, much to their incon
venience, and at a risk of great exposure
during bad M'eather.
-The county court house M’assuggested
as a good place for a new high grade
school to be established.

The State Normal
boom.
The teachers are now coming in at a
rate of six or eight per day.
The actual attendance now is some
thing over two hundred and the total
enrollment up to date is three hundred
and twenty-nine.
These teachers hail from ninety differ
ent counties in the State and conse
quently Georgia is M-ell - represen ted at
the Normal School.
Decatur county, the county farthest
away from Athens hasten representa
tives and thns leads all other - comities
except Clarke.
There is one student at the State Nor
mal School who is evidently in dead
earnest about his work. That student
is Mr. W. G. Avera, a middle-aged man
living in Berrien county.
Mr. Avera has a wife and eight little
children. The good wife is at home in
Berrien county looking after the little
ones, and Mr. Avera is here determined
to secure a good Normal School training
that will aid him very much in his
work.
The last ten M’eeks term at the Nor
mal School opens on the 29th and then
the attendance is expected to reach its
maximum.

OAK TREES ARE DYING.
HU ledge Avenue Being Robbed of Some of Its
Beauties.
Several residents of Athens on Mil-
ledge avenue are in a quandary as to
how they will be able to preserve a num
ber of the large oak trees in their front
yards.
Recently a number of these large oaks
have shoM-n signs of decay and are slow
ly but surely dying.
These trees are of such value to the
properties of these citizens that they
M-ill at once endeavor to take snch steps
as will preserve them from decay.
Any suggestion as fo the proper reme
dy will be received with thanks.

Another New Citizen.
Mr. Arthur Haire, formerly* of Ogle
thorpe connty and recently a resident of
Asheville, N. C., has decided to make
Athens his home. Mr. Haire is one of
the most conservative and highly es-
led citizens of Northeast. Georgia.
Ladles Garden Club.
The large attendance at the regular
meeting of the Garden Club yesterday
showed that interest M’as revived, now
that the. time for action had come. Great
enthusiasm prevailed, and much work
was mapped ont. Dues were collected,
new members received, and premium
lists were distributed. The chrysanthe
mum show was talked over, ways and
means freely discussed, committees
formed, and refreshments promised, and
everything promises of the most elab
orate and brilliant chrysanthemum show
that the club has ever given. The chair
man has secured the entire second floor
of ehe Y. M. C. A., and those who have
for two years admired the artistic abili
ty of Mrs. T. P. Vincent in the beauti
ful decorations of bamboos, will know
another treat .is in store for them this
fall when they hear that Mrs. Vincent
has kindly consented to take charge of
this work again.
