To the Hon. N. A. Morris, Judge
of the Superior Court of said coun
ty, and to the Superior Court of said
ceunty:
Herbert Clay, Solicitor General of
the Blue Ridge Circuit, brings this,
his petition, against Buck Williams,
hereafter called the defendant, and
alleges the following facts:
(1) That on the sth day of Sept.,
1918, W. E. Swanson, Sheniff of Cobb
County, and T. M. Sanders, Deputy
Marshal of the City of Marietta, both
aresting officers, captured and took
possession of a certain Ford automo
bile, 1916 model, black body, touring
car, license No. $2,421. Said auto
mobile was on and being operated on
the public highways of the county of
Cobb on the Powder Springs public
road, and was owned, operated and
in possession of said Buck Williams,
at the time it was taken possession
of by he above mamed arresting offi
sers, said automobile contained at
the time four gallons and one quart
of intoxicating liquors (corn whis
key.
(2) Petitioner alleges that said
automobile was owned, was operated,
was in possession of said Williams
and that said intoxicating liquor (corn
whiskey) in said automobile was the
property and was in possession of
said Buck WiHiams,
(3) The above named facts were
reported to Herbert Clay, Solicitor
General of the Blue Ridge Circuit,
by the said arresting officers, W. E.
Swanson and T. M. Sanders, on_ the
12th day of Sept., 1918, and peti
tioner brings this petition under the
General Prohibition Act of Georgia,
approved March 29, 1917.
Wherefore petitioner prays that:
(A) That Said automobile be sold
under autherity of said Prohibition
Act;
(B) That said Buck Williams be
served with 2 copy of this petition,
and event no legal claim is filed to‘
said automobile, or no legal defense
to same within 30 days after service.!

GEORGIA, COBB COUNTY.
To the Superior Court of said
County:
The petition of B. G. Brumby and
H. S. Wilingham, all of said State
and County, respectfully shows:
(1) Pettitioners desire for them
selves, their associates, successors and
assigns to be incorporated and made
body politic under the corporate
name and style of: “The Georgia Pot
ash Company.”
(2) The term for which the peti
tioners ask to be incorporated is
twenty years, with privilege of re
newal at that period.
(3) The principal office and place
of business of said corporation shall
be in the City of Marietta, Cobb ceun
ty Georgia, but petitioners desire the
right and privilege of establishing
such branch offices within this state
or elsewhere, whenever the holders of
a madgority of the steck may deem
advantageous for its business and so
determine,
(4) The object of said corporation

stockholders thereof.
(5) The particular business in
which said corporation proposes to
engage is that of the manufacture
and seling of Potash for commercial
purposes, and in the manufacture and
selling of any .other fertilizing ma
terials; and in the importing, buying
and selling of any and all materials
and accessories usual and necessary
t othe conduct of such business; and
to buy, lease and own mineral rights,
real estate and water courses for the
developement of Hydro-electric pow
er and to operate same for its own
use or for sale to the public; and to
purchase and mine materials of all
kinds necessary in the conduct ef its
business. |
(6) The Capital Stock of said Cor
poration shall be §5000.00, divided
into shares of $lOO.OO each, with thei
privilege of increasing same at any
time, and frem time to time, by a!
vote of the majority of the outstand- |
ing stock, to any sum not exceedingf
$100.000.00. As soon asg ten per
cents of the Capitol Stock has been
paid in, all of which has been sub
scribed, the Company shall have the!

(7) Petitioners desire the richt to
sue and be sued, to plead and be im- |

curred, in the conduct of the affairs
of the corporation and to secure the
same by mortgages, security deed, or
other form of lien, under existing
lays.
WHEREFORE, Petitioners pray to
be incorporated under the name and
style aforesaid with the powers, pri
vileges and immunities herein set
forth, and as are now, or may here
after be allowed a corporation of
similiar character under the laws of

IN MEMORIAM
Memorial of Hon. J. J. Northcutt
Cobb Superior Court, Oct. 28, 1918

pointed to prepare a suitable mem
orial of Hon. J. !J. Northcutt, de
ceased, late member of the Bar, beg
leave to submit the following re.
port:
Brother Northcutt was the son of
A. M. Northcutt, and was born De
c:mber 29th, 1852. He was reared
on a farm, and read law for 2 year
in the office ‘of Col. J. L. Moon, now
of Atlanta. After obtaining funds,
by teaching, to defray college expen
ses, he attended Mercer Law School,
where he graduated in 1877. Imme
diately upon completion of his course
at Mercer he began the practice of
law in Acworth, where his office was
located up to the time of his death.
His principal practice ‘'was in the
counties of Bartow, Cherokee, Cobb
and Paulding. He was elected to the
Senate in 1886 without offering him
self for the candidacy-and served one
term in that body.
He joined the church at the age of
21 years. He was superintendent of
the Acworth Baptist Sunday School
for a number of years, and was a
teacher in the Sunday School for for
ty years. At the time of his death
he was teaching the Bible Class in
that School.
He is survived by his wife, three
children: James A. Northcutt, of At
lanta, and two children at home, Eve
lyn Northcutt and Stokely Nothcutt;
one brother, George P. Northcutt, of
Cedartown, as well as “numerous
nephews and nieces.
He was taken sick on Sunday, May
26, 1918, while studying his Sunday
Sehool lesson and died at six o’clock
p. m., June 7, 1918. When his desk
vras opened everything was put away
in order with 'the exception of his
Sunday School Quarterly, which was
open on the desk at the lesson for
May 26th. The study of this lesson
was undoubtedly the last thing he did
at his office.
& can truly be said of our Broth
er that he was upright and indus
trious. He multiplied his talents and
achieved distinetion at the Bar. His
standing among the lawyers of the
Blue Ridge Circuit was m the front
rank. He was an able, careful, pain
staking and thoroughly reliable law
yer. He was a good man.
