IN BURNS GRILL
Only on Certain Conditions Will
Detective Be Permitted to
Talk With Prisoner in Cell.
Atlanta, Ga.— lt Is decidedly prob
atile that Detective William J. Burns
will not be permitted to qtilzz Jim
Conley, the convicted accomplice in
the Krank case.
This was evident in an interview
given out by William M. Smith, the
negro's counsel. Smith stated posi
tively to rc | orters that he would not
allow the famous detective to put his
client under a sweating interrogation.
Also thut Horns would not he per
mitted to interview Conley except in
the presence of the prisoner's attor
ney. Besides this, it is said that the
detective will have to agree to other
conditions before he will even be ad
mitted to the negro sweeper’s cell.
Wants to Know Atttitude.
“Before I permit Burns to see'Con
l*jr," Mr. Smith said last night, "1
will have to satisfy myself that he is
sincerely seeking to unearth the truth
—and nothing but it. I will have to
determine whether or not he is work
ing to aid Krank alone. Also, whether
or not he will' act in absolute good
faith."
Asked point-blank whether or not he
would allow Horns to see the negro,
Mr. Smith said he could not say one
way or the other at present. It would
be altogether according to circum
stances, he declared.
Burns could not be reached for a
staement last night. According to a
staement which he sent to The Consti
tution Tuesday night, he will be in
this city some time this week—prob
ably within the next day or so. Upon
his return this time he will remain
in town until his investigation s com
plete.
Conference Is Held.
An Interesting angle of recent devel
opments in the Krank situation was a
secret conference held Tuesday after
noon between Solicitor Dorsey and At
torney Smith It is said to have lasted
throughout the afternoon. Neither
man would divulge its nature, refus
ing to discuss the subject.
It Is said, however, that the two
were going over certain phases of the
newly discovered evidence in the hands
of the defense, which is to be con
tained in the application for a new
trial to be submitted somewhere in the
neighborhood of April 10.

derstood, members of his counsel —are
said to be responsible for the proposed
interview of Burns with Conley. Burns’
past record for obtaining confessions

Conley is guarded zealously in his
cell in the Tower—which is located
near Krank's—and no one but his at
torney, Solicitor Dorsey and Detec
tives Starnes and Campbell are per
mitted to see him.

BATTEY HELD TODAY

The funeral services over the re
mains of Dr. W. VV. Battey, Sr., who
passed away early yesterday morn
ing in the tiCth year of his age, were
conducted by the Right Reverend
Bishop Benj. J. Keiley, of Savannan,
from the St. Patrick Church at 4
o'clock this afternoon. The burial
followed at the City Cemetery in the
presence of relatives and a number
of sorrow-stricken friends of the de
ceased aud of tlie family, many of
whom also witnessed the church ser
vices also. Tiie tioral contributions
were extraordinarily beautiful and
were many in number and design.

general grief to the entire community
and the heart-felt, sympathies of hun

The Aiken Polo Team
Wins Over the Tigers
Aiken, S. C.—Yesterday afternoon a
polo match was played between the
Aiken team and the Tigers, which re
sulted in a victory for the Aiken team
by a score of 9 3-4 to 8. The game was
very fast and exciting from start to
finish. It would be difficult to say
who starred for the playing of all was
excellent. Quite a large chrowd wit
nessed the tame, several of the tour
ists from Augusta coming over to see
the game.
