Has Many Affidavits to Offer Atlanta, Ga.—Solicitor Hugh M. Domey appeared before Judge Ben Hill this morning at 10 o’clock, when the hearing for a retrial for Leo M j Frank was resumed, and began his fight, to baffle the move of the con- j victed man’s attorneys to gain for him a second trial. A strong fight will be made to have Judge Hill revoke the order he gave! Frank’s defense cancelling the amend ment which wa« presented last Frl- j day, and in which Rev. C. B. Hags dale made an affidavit to the efTect that he had overheard Jim Conley con fess to Mary Phagan’s murder. Rags dale has repudiated this alfidavit in a confession to the solicitor. It is also reported that Mr. Dorsey has obtained an aflidavit from Anna Maud Carter, the negro woman who has made an affidavit for the defense, swearing that Conley—while she was In prison with him—confessed Mary Phagan’s murder to her. This report could not be verified, as Dorsey re fused to commit himself when ap proached by a Constitution reporter. State Has Affidavit. It is known, however, that the negress has made an affidavit to the detectives at police headquarters who have been Investigating the Frank case. This document, It is said, was attested by the Carter woman on Ihe day before she made the startling "Conley confession" affidavit for Frank's lawyers. Mr. Dorsey has announced that he Ih well equipped for the fight, and that he has a large amount of evi dence that will create much surprise. A brilliant legal battle Is expected when both sides clash before Judge Hill. The hearing will be held In the committee room of the state library hi the capitol. Following the story Thursday of the report of this committee of the Plum Street church, of which the Rev. Rags dale was pastor, in which Ragsdale was stated to have confessed ‘"fram- Ing up" the Conley confession story, and charging bribery, Detective Wil liam J. Burns, on his way to Oklaho ma. telephoned a ringing denial dur ing the afternoon. Calls Preacher a Liar. "This man Ragsdale,” he said “is an unmitigated liar. I never saw him jn my life. Just as soon as I heard tills outrageous story, I decided to come hack to Atlanta, and I will be there on the first train." The detective, who telephoned froir Chattanooga, turned back toward At lanta, and is now en route to the city. “All that 1 know of Ragsdale s affi davit," he continued, “Is tht he came to our office and Mr, Lehon, my as sistant. conducted him to the office of Mr. Rosser.” “MUCH OBLIGED TO YOU,” SAYS WOULD BE SUICIDE Atlanta, Ga.—"l'm much obliged to you." said John King, a business man, when the hospital internes took a stomach pump and pumped enough poison out of him to kill a horse, last night following King’s attempted sui cide. "You needn't thank us,” they re sponded "You had better thank Miss Kathleen Smith, the young lady who called us up from your boarding house. It she hadn’t, you would be a dead man now.” Kink took the poison, he said, on the spur of the moment, in a fit of despondency, and now says he will be glapl of the opportunity to begin life over again..
