No Monopoly of R’way Positions Rules Court Washington.—The Texas statute providing that a person should not act as a freight railway conductor without having had two years’ experi ence as a freight brakeman except in cases of emergency was Monday annulled as unconstitutional by the supreme court. Justice Lamar announced the de cision. stating that while the public had a right to fix the standards and tests for tho.-:e serving in a semi public position, it coudl not establish rules which gave to certain classes a monopoly of positions. He declared the law in question gave freight brakemen a monopoly of the right to succeed to the losit.ion of freight conductor. Procured $30,000 Policy on Life Fraudulently Washington. The supreme court Monday granted the request of the Mutual Life Insurance Company of New York Tor the review of the judg ment for $30,000 against it in favor of the estate of C. L. Wiggins, of Florida, deceased. The company claimed Wiggins procured , insurance on his life for this amount fraudu lently and that the federal courts of Florida erred In holding that the knowledge of a medical and Insurance solicitor should be regard ed as the knowledge of the Insurance company. Florida Personal Injury Law Not Valid in N. Y. Washington—The right of the state of New York to refuse to enforce the Florida personal injuries law as against the public policy of New York was upheld Monday by the supreme court, dismissing an appeal to it from the New York federal courts. The Florida law allowed ftnininia trators to recover for creditors of a man killed by negligence where the man left no dependent per -ions. The New York courts have held that the public policy of that state was against recovery except for the benefit of de pendents and the federal district court of southern New York refused to allow the administrator of the estate of John (lallugher, killed In 1909 by the explosion of dynamite being used in the construction of the Florida West Coast Ilaiiway, to sue the railway for damages.
