PERJURY AND
TRIAL OF FRANK
Investigation of Charges is to
Be Taken Up Ly the Grand
Jury Today.

Jury charges made In connection with
efforts to obtain a new trial for Leo
M. Frank, under sentence of death for
the murder of Mary Phagan, the fac
tory girl, iH expected to he made by
the Pulton county grand jury which
convenee here today.
It w:>« understood last night that
Huprrior Court Judge Benjamin H.
Mill would instruct the jury to thor
oughly look into the charges. The
material evidence will Include the
many affidavits made by witnesses re
pudiating their testimony, some of
which also are counter repudiations.
Hearing of arguments on the de
fense's motion to annul the verdict
against: Frank is scheduled to begin
Wednesday. The motion }h based on
the absence of the defendant from the
courtroom at the time of the verdict,
which, it is claimed, constituted a vio
lation of his constitutional rights.
Two of Frank’s attorneys agreed to
the absence; which wa» suggested by
the presiding judge on account of the
reported feeling of the public against
the defendant. Their right to take
this action is involved in the legal
proceedings.

After suffering from feeble health
for neveml months. Mr. John F.
Sturman, 7(1 years old, passed away at
his home on F.llla street early Sunday
morning.
The funeral was conducted from the
First Baptist church at 11 o’clock this
morning. Rev. (1. Sherwood Whitney,
of the St. Raul's Kplscopal church, of
ficiating The Interment was made
In the t’lty cemetery.
The deceased was horn March 21st,
1838 at Baltimore, Md. At the be
ginning of the Civil War he enlisted
as first lieutenant in Company C,
Second Maryland, under Captain Ross.
H was for the most time in the army
of Northern Virginia.
Mr. Sturrnan. at the close of the
war. came to this city where he was
connected with his uncle, Mr. FI. B.
I,onn. in the wholesale dry goods busi
ness. On September 22. 1860 he was
married to Miss Bettle Hard, daugh
ter of a Baptist minister
Me Is survived by his five sons.
Messrs W. H., J. F., Jr., R. W, and
R. N Sturmnn, of Augusta, nnd R. B.
Sturninn. of Manila. P 1., and also one
sister, Mrs M. J. Nolley, of Baltimore.
