THURSDAY, MAY 28. Messrs. Pierce Make Statement Regard ing Mr. I. S. Peebles and the Offset Matter To the Editor of The Herald, Sir: As the press has not carried all the surrounding facts and circumstances in connection with the friendly suit brought by Hon. I. S. Peebles, Jr., against Irvin Alexander, Esq., receiver of the Irish American Hank, we deem it proper to set forth the same. This suit was brought by Mr. Pee bles at the suggestion of Mr. Alexan der, as receiver of the Irish American Bank, in order to determine whether or not Mr. Alexander could allow as a set off, certain bank deposits assigned to Mr. Peebles. A short time after the Irish Am erican Bank was placed in the hands of a state bank examiner. Mr. Pee bles purchased dollar for dollar a claim of $295.44 from a widow with a little child, who works every day in a cotton mill, and who had plaqed her money in this bank at his suggestion when he had recovered the same for her in certain litigation. While he was under no legal pr moral duty to assume the bank’s liability by pur chasing her account against it at its face value, still there were circum stances in connection with the matter which caused him to purchase this ac count dollar for dollar. Mr. Peebles also took an assignmenl from another widow who had placed her money in this bank at his sugges tion, out of which he made not one cent of profit. And these assignments, together with an assignment of his wife’s deposit, he urged as a set off other medicines. I am now working on the farm, 12 hours a day, my muscle is as hard as iron and I think that is going some for a man who was in my condition. Mr. Peebles notified Mr. Alexander, the receiver, immediately after his ap pointment, that he would pay in cash the $750.00 before he would be sued, but that he felt that these assignments were good. Mr. Alexander stated that he would be glad to have the matter determined as to whether or not he could properly allow the use of the as signments as a set off, ami that when a test case.should be made the matter could then be adjusted. It was at the suggestion of Mr. Ir van Alexander, receiver, that Mr. Pee bles filed a bill against him, a bill to determine whether or not these set offs were allowable. After Mr. Pee bles and ourselves investigated thor oughly the law, we came to the con clusion that the first assignment made him l y the widow who works In the factory could be legally used as a set of!, as it was made prior to the filing of the bill for the receivership, and tha: the other assignments could not be used as they were made after the filing of the bill for the receivership. Ir. this position Mr. Peebles and our selves were sustained by the court, and he was allowed a set off of $298.44. In hehalf of Mr. Peebles, prior to the hearing before Judge Hammond, we tendered to Mr. Illackshoar, at torney for the receiver, the difference between $298.44 and the balance due by him to the hanks, which he refused Mr. Peebles' position was sustained by Judge Hammond under the ruling of Nixon vs. Ellis, receiver. 118 Ga., page 345, in which Mr. Justice Jos. R. Lamar rendered the opinion. We mention these facts in connec tion with this litigation that the pub lic may understand that this was not a case of Mr. Peebles buying up ac counts with which to settle the bal ance he was duo this bank for his own benefit, but to protect others who had placed mony in this institution at his suggestion. Is a man to he impugned for as serting his legal rights, when, es pecially by asserting them, he benefits not himself, hut one who had followed his advice and deposited her money in a hank, which to the litter surprise of Mr. Peebles, went defunct shortly thereafter? Can It be said by any one, in view of the facts above enumerated, that "there had been any trafficking In the deposits of a failed hank?” ? Respectfully, PIERCE BROS. Augusta, Ga., May 27th, 1914. POPE BESTOWS THE RED HITS Public Consistory For the New Cardinals Now in Rome. Many Americans Attend. Rome.—A public consistory at which the red hat was conferred on those of the thirteen r.ew cardinals who are now in Rome, was held today at the Vatican. It was attended by several thousand people most of Whom were Americans and other foreigners. The papal procession which followed the ceremony was conducted with great pomp. The passage of the pontiff, surrounded and folowed by many ec clesiastic, military and civil dignita ries both going to and returning from the consistory, was most impressive. After the consistory the cardinals, both old and new. gathered in the Sis tlne chapel to return thanks and then met, presided over by the Pope, in the consistorial hall, where Pius X be stowed the cardinal’s ring, granted them the privileges of their position and named their titular churches.
