DIVORCE LAWS
Reform Urged in Bill by
M’Neil. Prohibits Verdicts in
Undefended Suits. Electric

Atlanta, Ga—Sweeping changes in
Georgia’s divorce lows are advocated In
a hill Introduced Monday by Senator W.
If. McNeil, of the Twenty-second dis
trict. Chief among these Is that wit
nesses must testify in most of the cases,
and that no eases shall he undefended.
In the past more than two-thirds of the
divorce suits in Georgia have been un
defended.
Although the senate was in session
only fifteen minutes. adjourning until
Tuesday because of the death In Savan
nah Sunday of Mrs. Edward C. Ande-son,

son. several important bills were Intro
duced.

the electric chair shall be used In the
execution of all felons In Georgia, and
that all executions shall take place at the
state farm in Mllledgeville.
Men al Incapacity.
Senator W. O. McNe'ls divorce hill
provides that evidence of witnesses other
than parties Involved has to be given
before the granting of a divorce on the
grounds of adultery; at present, testi
mony of the husband or wife s suffi
cient. Also, mental incapacity must be
proven by at least two witnesses.
A radical change In the grounds of
cruel treatment Is made. The bill pro
vides that cruel treatment shall consist
of actual violence uncondoned by the
other party. Witnesses other than the
parties Involved must testify.
Habitual intoxication has to be proven
by at least three witnesses.
A radical change Is that there shall be
no more undefended cases; the Judge
shall designate lawyers to represent tne
defendants In each case, wlither the de
fendants can pay attorneys fees or not
Hut the defendant shall pay feeß and his
share of costs If he Is able to do so.
The old divorce laws shall stand ex
cept when In conflict with this act.
Penalty for Desertion.
Other charges provided for In Senator
McNeil’s hill an- that Intermarriage of
persons within the prohibited degrees of
consangulty shall he no grounds for di
vorce If there shall he living Issue of Ills
marriage at the time the suit Is filed; In
suits on the grounds of force, menace,
devices or frauds at the time of the mar
riage, action must he Instituted within
three months after marriage; In cases
of wilful desertion, the party shown to
have deserted the other without Justifi
cation shall not he given a divorce for
at least five years after the final degree
granting the o’her party the divorce
This Is a punishment for desertion.

Passes Resolution Favoring
Substitution of the Municipal
Court.
The following are the resolution*
passed by the Augusta Federation of
Trades on the abolishment of Justice
of the Peace Courts In Augusta:
In view of the fact that there are
steps being taken to abolish the so
called Justice of Peace Courts In the
city of Augusta, Oa., and provide as
a substitute a Munlcpal Court. and
Whereas, the Justice Courts have
been since their existence a nuisance
to the laboring class, using their of
fice to unlawfully garnishee laborers'
wages, demanding strong bond for
release of wages exempt by law from
garnishment, falling to comply with
the recommendations of the grand
Jury, not being familiar w: b the laws,
their guess work declsolns which
