AGREE ON CASE
DENMARK WILL
End of Famous Litigation
When U. of G. Trustees
Vote to Accept $30,000 on
Widow’s Death.
Athens, Ga.—The famous Denmark
will litigation, which has been in th*j
courts for several years and to which
the I nivernlty of Georgia is a parts,
will probably he settled as the resuit
of action taken by the trustees of the
university hi a meeting held in the
state library Thursday.
The trustees by a close vote deter
mined to acept a proposition made by
Mrs. George A. Denmark, widow of the
prominent Savannah business man
whose w!l! carried a large legacy to
the university. Mrs. Denmark proposed
that one-third of her late husbands
estate should, upon her death, go to
the university, an*] it was estimated
that the estate is valued at $90,000,
which would mean that the university
will get $30,000.
In his will Mr. Denmark left a larga
portion of Ids estate to the university,
the n.uount to be contingent upon
whether his son, then a youth’ died
without issue. The son died and Mrs.
Denmark contested the will on the
ground that the state law prohibited a
testator from leaving more than one
third of his estate to a philanthropic,
benevolent or educational institution
tiie exclusion of his immediate family.
Through their attorneys the trustees
of the university demurred to Mrs.
Denmark’s petition and the demurrer
was sustained. Then the supreme
court reversed the superior court of
Chatham county, holding that the case
should haw* been heard ori its merits.
The case then came to trial and the
university lost again. Its attorneys
took another appeal to the supreme
court, which Is pending
Mrs. Denmark's proposal to allow
one-third of her husband’s estate to go
to the university upon her death,
which was accepted by the trustees
Thursday morning, will doubtless end
the litigation which has been in pro
gress several years.

Georgia Senate Passes Bill.
Also Votes For the Addi
tional Procedure Act.
Atlanta, Gfc~Two bills of state-wide
importance were passed in the senate
Thursday. One was a constitutional
amendment to provide for the national
abolition of tYie payment of county offi
cers by foes, substituting Instead sala
ries paid by the counties. The other
was the uditiomil judicial procedure act.
drawn by a special commission headed
by Judge Andrew Cobb, of Athens.
The addtional procedure act, intro
duced by .Senators Elkins and Irwin,
passed by 23 to 18. To make the 23
votes necessary for a majority, Presi
dent Randolph Anderson voted in favor
of the measure. This act passed With
many minor amendments. It lias been
indorsed by the entire bar association of
Georgia.
The constitutional amendment provid
ing for the abolition of the ft*e system at
the option of ttie oountiea* was Intro
duced by Senators Rusldn and McNeil.
The vote was taken after a heated de
bate. Under the act, solicitors cannot
be placed on a salary basis, because they
are state and not county officers.
By tiie adoption of a resolution by
Senator Tarver by the rules committee
Thursday morning, the bars of the boy
cott on house bills were somewhat low
ered by the senate, and a very largo
number of house bills came up for first
and second reading Among those on
first reading was the Shepard child la
bor bill.
Readers of the boycott, ho'wever, state
that there Is a big gap between first and
second readings and the final vote on
bills, and say they will prevent. If pos
sible, these house bills coming up for
p.iS/iige. The boycott will l»f lifted,
however, they say, as soon as the house
gt\es proper attention to senate bills.
Opposed to th«* action of the temper
ance committee in recommending that
the McNeil bill to alatlish locker clubs
”do pass.” Senators Converse, AUen and
Sweat submitted Thursday a minority
report asking that it "do not pass '
These senators stated in the minority
report that they believed the McNeil bill
was unwise In that it abolshed the $..00
a year tax on locker clubs. The state
shtwld not be deprived of this money,
the monorlty report said.
