To The Herald: In his book on “Foreigners in Tur key: Their Juridical Rights," pub lished today, (Princeton University I'tess), Prof. Phillip Marshall Brown shows that the extraterritorial rights for foreigners which Turkey la about to abrogate have their base In the capitulations granted to the French in 1685 and 1740. England and Holland obtained the benefits of these capitulations in 1679, Austria in 1615, Russia in 1711, Swe den In 1737, Denmark In 1756. Prussia In 1761, Spain In 1782, the United Slates In 1830, Belgium in 1838, Portu gal In 1843, Greece In 1854, Brazil Ui 1868; other nations In later yenrs. Professor Brown, who was former ly secretary and charge d’affaires of the American embassy at Constanti nople, feels that. Turkey has given "evidence of a more enlightened and morn liberal Interpretation of the law of nations than has yet been granted In Europe, the place of its origin.” She has been restive at various times under strict or extreme interpreta tions of the capitulatlonu, and In Jan uary, 1867, through a law granting foreigners the right to own real estate seh made serious breaches tn the con ventions. The property was to be held, In all respects of title, landlord ism, charges, taxes, litigations, mort gages, inheritances, etc., under the terms of Ottoman law, the only re serve of personal nationality being with respect to persons and to mov able goods. As the eapltulatlons stand, consular tribunals have exclusive jurisdiction In cases involving foreigners of the same nationality: the consular tribu nal of the defendant has jurisdiction In cases between foreigners of dif ferent nationalities. In practice, the consuls being inclined to laxness to ward the Ottoman low. foreigners of ten enjoy greater freedom of conduct than they would have in their native lands. Writing with no Idea of the coming step of abrogation by Turkey, Prof, ltrown proposes a solution of the dif ficulties and a removal of ernharraas ments In Turkey by bringing all the Issues Involved under the provisions of International law and treaties. Such action by all nations would leave to the Ottoman courts exclusive Jurisdiction over matters affecting public law and order In the empire. This would dispose of the elements of Indifference and conflict In crimi nal cases. To the consular courts exclusively would he left the questions between foreigners which were personal and particular, affecting In no wny the public law and order. W. W. T. Averett was married Monday to Miss Emma Jones and she appeared before the city council Monday night In behalf of her husband, pleading that ts he were given another chance he would do better.
