Mat W;ide. the young white man who
wns tried for murder In th«» October
term of superior court, convicted of
manslaughter and sentenced to one year
at hard labor, escaped on Monday from
the McDuffie county chatngang, and
was recaptured Wednesday morning.
Wade was assigned to the McDuffie
counay gang In the early part of last
week and remained on y four or five
days before effecting his escape Word
was sent at once to Augusta that he
was at large and Sheriff Plunkett has
had his men on the lookout for him ever
slnoe. Special Deputy Clark found the
fugitive a♦ W« home Ift miles out the
Wrights boro Hoad at four o'clock Wed
nesday morning. Wade found his way
back home early Tuesday monring and
evidently must have been In hiding all
day Tuesday. Deputy Clark made a
surprise visit to the house at 4 a. in. on
Wednesday and found ids quest sitting
in a chair in the kitchen, with his face
buried in his hands
He was immediately brought in to the
court house and will be sent back to
McDuffie county late In the afternoon.
Wade was sentenced for the killing of
Will Goodwin, in self-defense, last sum
mer.

100 CERTIORARI
CASES IN COURT
Wednesday in the Superior Court
was dedicated to hearing the certior
arles that had been appealed frotn the
Recorder's Court and art* now pending
Some hundred cases were disposed
of.
Jt is not an uncommon practice, as
it was made to appear at the hearing,
for lawyers to go to the Recorder's
Court and nflet Judgment of guilty has
been rendered, to notify the police au
thorities of the Intention to certiorari
and give bond, and the law allows
them thirty days In which to get the
Judge to sanction the certiorari. No
other action is ever taken
In some forty-odd cases, it develop
ed, during the year, notices had been
given of tbe intention to certiorari, but
no subsequent action was ever taken,
and upon the statement that they were
not filed in the Superior Court they
were dismissed, and the parties who
have avoided the enforcement of the
sentence will now he re-arrested, or
(he sentences whatever they he, he en
forced.
In addition, a large number were
heard and disposed of the exact, num
ber approximating one hundred.
Nearly all of the certlorarles now
pending by the action of today, from
Ihe Recorder’s Court, have been tried,
and the Recorder's Court and (he Chief
of Police will start off with practically
a ' loan sheet on Ihe first of January.
The law on certlorarles Is one of the
peculiar laws on (he hooks. A party
has thirty days In which to ask for a
certiorari, and ninety days In which
to file It after It Is sanctioned. Efforts
have been made to change the law. and
the city council recommended to the
legislature about three years ago, that
this law he changed, and require the
filing of the certiorari ns soon as It Is
sanctioned, hut the legislature failed to
pass It, and Ihe ancient law remains,
and is one of Ihe evidences of the de
lays of the law which arc frequently
referred to as bringing the law In dis
repute.
