The City Council of Augusta hereby
ordain*:
Section I—That Section 541 of the
City Code of 1909 an heretofore
amended be so amended an to strike
therefrom the following language, fo

CONTRACTED TO BE DELIVER
ED; TO PROVIDE FOR THE IN
SPECTION OF WEIGHTS OF
COAL DELIVERED IN THE CITY
OF AUGUSTA; AND FOR OTHER
PURPOSES.
The City Council of Augusta hereby
ordains;
Section I—That the Inspector of Li
cense of the City of Auguata ahall not
less than three times a month inspect
the weights of coal being furnished
by a seller of coal In the City of Au
-iista to their customers, also that the
scales of the seller of coal shall he
tested twice each month as to ac
curacy. Inspection Bhall he as fol
lows: The License Inspector and any
persons appointed thereafter by the
Majror to inspect weights of coal shall
stop any coal wagon, truck or any
other vehicle loaded with coal for de
livery to a buyer In the City of Au
gusta and take the driver and coal to
the most convenient scale, properly
inspected by the City authorities and
■weigh the same, he shall then pro
ceed with the driver to the point of
delivery, after the coal has been de
livered he shall proceed back to the
same scale* on which the coal and ve
hicle were weighed and weigh the
wagon or truck or other vehicle, arid
thus ascertain the net weight pf the
coal. Should such inspector or any
one appointed hy the Mayor as here
inafter provided, find that the seller
of coal is furnishing less by weight of
coal than he has contracted to fur
nish to the customer, he shall docket
a case in the City Court against the
seller of coal, and he ahall he prose
cuted for a ."demeanor In said City
Court under .Section 706 of the penal
Code of 1910. If the same seller is
convicted for a second offense, his
license shall be revoked by the Mayor.
In the event there Is a variation of
not more than two 12) per cent In
weight as shown hy delivery ticket,
there shall he no case docketed
against the seller.
Section 2—That all sellers of coal in
the City of Augusta shall provide
tickets and furnish the person deliv
ering the coal with tickets showing
the gross, tare aiy net weights of
coal to be delivered, and no person de
livering coal in the City of Augusta
shall leave the place where the same
Is located into the vehicle for delivery
without a ticket Rhowlng the gross,
tare and net weights of the coal, in
the event any persons delivering coal
is found with a load of coal for de
livery without such ticket, he shall
upon conviction thereof in the Recor
der’s Court, be fined not more than
one hundred ($1110.00) dollars. When
ever the Inspector shall find a person
delivering less by weight of coal than
is herein provided, he shall take the
tic.tet from the person delivering less
hy weight of coal than is herein pro
vided. he shall take the ticket from
the person delivering the coal and
give him a receipt therefor. This
ticket shall be introduced In evidence
on the trial of the seller of the coal,
as evidence of the intention of the
seller to sell less coal than he con
tracted to sell.
Section 3—The Mayor of the City of
Augusta Is hereby authorized and di
rected from time to time to appoint
from among the employes of the Citv
of Augusta employed as the Central
City Offices not less than Two em
ployees and they and each of them,
are hereby clothed with all of the
powers of the inspector of licenses
with reference to the delivery of coal.
Section 4—Any person who shall re
sist * license inspector, or anyone au
thorized to inspect coal, nnd who
shall not co-operate with him in every
way to ascertain the net weight of
coal, shall he guilty of resisting nn
officer, and upon conviction he pun
ished hy the Recorder by a fine of
not more than one hundred ($100.00)
dollars.
Section s—All ordinances and parts
of ordinances in conflict herewith are
hereby repealed.

sary and proper, there shall be con

The day brought no upset worthy
of the name.
Entrance of Senator LaFollette
Into the race lor the presidency was
not an influence apparently and no
follower of the Wisconsin senator
has been shown elected to office in
the South, if available returns are
to be regarded as an indication of
the final compilation.
With the party In power given a
new lease on life in state offices,
Tennessee seeming to offer the
only engagement characterized as
more than a scrimmage interest
was focused on constitafional
amendments before the people of
half a dozen Southern states for
ratification.
Florida gave an emphatic stamo
of approval to the plan for placing
an everlasting ban on inheritance
and'income taxes for its residents.
An amendment pledging the penin
sula estate, its heirs and assignees
not to impose such taxes was pars
ed.
South Carolina is listed on the
face of incomplete but convincing
returns as willing to stand pat on
its annual legislative sessions, the
amendment to inaugurate biennial
sessions being reported as running
behind. Doomed to defeat with this
amendment were the companion
plan to have state officials servp
four years and a bond issue for
educational purposes.
North Carolina’s spirited fight on
the question of referendum meas
ures for a state bond issue for the
installation of a state owned steam
ship line and port terminals de
veloped a close contest at the polls
with the result reported in doubt
the day after election. The pro
ponents and opponents of the meas
ures were almost neck and neck for
a part of the night but early morn
ing returns permitted the advocates
of the plan to draw slightly ahead.
Georgia voters ratified a measure
along similar lines lines but of less
significance when they approved a
constitutional amendment permit
ting the port city of Brunswick to
issue bonds for improvement of its
facilities.

HUGE PLURALITY
IN PENNSYLVANIA
PHILADELPHIA —Pennsylvania
returned a plurality for the repub
lican national ticket in Tuesday’s
election which on the basis of re
turns compiled early Wednesday,
exceed the largest ever recorded for
a presidential candidate in the state.

COOLIDGE LEADS
IN KANSAS
TOPEKA, Kan*.—With more than
half of the 2,591 precincts of Kan
sas reported from all but two of the
state’s 105 counties, president Cool
idge had a plurality of 130,000 over
John W. Davis.
On the face of this count the
president had carried with him all
republican candidate for state of
fice and all but two congressmen.
Senator Capper’s plurality was al
most as great as that of the presi
dent.
INDIANA GOES
FOR COOLIDGE
INDIANAPOLIS— Only the mar
gin by which President Coolidge
ca/ried Indiana remained to be de
termined Wednesday as late returns
continued to increase his plurality
over his democratic opponent. Tn
1.554 of the 3.418 precincts Cool
idge’s vote was 355,643 against 245 -
762 for Davis and 28,427 for Sena
tor LaFollette.
