Grand Jury Considered That
Case This Morning. Arm
strong Case Probably to be
Taken Up in a Day or Two.
The grand jury considered the
Samuel Norris case this morning
and speedily found an indictment, as
was predicted by The Herald. Only
a few witnesses were examined. The
grand jury has considered between
40 and 50 cases during the past two
days.
The Armstrong case will probably
be considered within the next day
or two. The grand jury will un
questionably finish its deliberations
before the end of the week.
LANKFORD LEFT.
New York—Nearly half the estate
of Richard D. Lankford, vice-presi
dent of the Southern Railway, who
tvas asphyxiated by gas last week at
his home in Brooklyn, goes to Miss
Nellie 3. Patterson to whom he was
engaged. The will does not give the
value ot the estate.

Increase In Capital Union Savings
Bank From $30,000 to SIOO,OOO
Annual Meeting of Stockholders Held Today. All Additional
Capital Stock Subscribed for by Stockholders Present.
Bank in Flourishing Condition.
The annual meeting of the stock
holders of the Union Savings Bank
was held at the building of the
Union Savings Bank this morning.
The report of the officers of the
institution showed a most prosperous
year just ended. The capital stock of
the bank was increased from $30,000
to SIOO,OOO, whioh was all subscribed
for by the stockholders present.
The entire old board of directors
were unanimously re-elected, and all
the old officers of the bank also
elected to their same positions.
THE MORNING WITH THE RECORDER

ton this time, was found guilty under

Hester Norris, colored, said she was

Jim Smith, who was charged with
brandishing firearms, murder in eye,
i had to acknowledge reluctantly one by
one that they had not seen the pis
tol. Each one thought the others had
seen it no doubt. The facts were tiiat
Jim had lent a mule to one of the wit
nesses who had allowed it to limp
] along with a nail in its foot until it
I died of lockjaw. Whereupon Jim had
] threatened him rvith death. And panic
! ensued in the vicinity. Judge Irvin
j observed with the wisdom of Solomon
i that anybody would hat’e done the
| same, and dismissed him. There seem
ed to be a number of people in the
court who were sorry Jim had not
carried out his design in some par
ticularly foul and bloody way.
A case in point was that against

maia. J. H. Roleder, who made the
report, had evidently lost interest for

Process Alleging Illegal Mort
gage of Land Brought by J.
P. Mulherin Trustee for the
Industrial Lumber Company.
With the serving today of pape rs by
an officer of the United States court,
it developed that suit has been brought
against James P. Armstrong, G. Worth
Andrews, as receiver in bankruptcy
of James P. Armstrong, and the Citi
zens and Southern Bank by J. P. Mul
herin, trustee in bankruptcy of the In
dustrial Lumber Company, to decide
who is the owner of a certain lot of
land, amounting to more than three
acres, on the north side of Railroad
avenue, near Georgia avenue which the
plaintiff alleges was mortgaged by
Armstrong on December 2nd, 1913 to
the Citizens and Southern Bank, for
the purpose of meeting certain alleged
obligations to the Irish American
Bank, of which Armstrong was cashier.
The plaintiff further prays in the bill
in equity that court records in Aiken,
S. C., showed nominally that the lot of
land in question was the property of
James P. Armstrong, but that in truth
it belonged to the Industrial Lumber
Company, and also prays that the
mortgage instituted in Aiken on De
cember 2nd by Armstrong be declared
null and void, and be cancelled by the
court. It is asked by the plaintiff that
the court pass an order requiring the
sale of the said land.
The bill was filed for Mr. Mulherin,
trustee for the Industrial, in Charles
ton January 14th by Attorneys D. S.,
K. P. and P. F. Henderson, at the of
fice of U. S. Commissioner A. W. Hut
son.
The original hill as well as two
copies were forwarded to Augusta to
be served each of the three defendants
in the matter.
The bill is returnable in Charleston
February 10th.
DAUGHTERS OF ISABELLA
TO GIVE DANCE TOMORROW
The Daughters of Isabella, will en
tertain with a dance, at Bt. Patrick's
Hall, tomorrow evening, commencing
at 9 o'clock, there will be an orchestra
present, and a most enjoyable time is
promised The Daughters will also
meet at their club rooms, on Broad
street, Thursday afternoon.

A negro named Joe Burnett tried
persuasion and then warnings and fi
nally violence to get his wife away
from the house of a certain Katie
Hansen. The last resort was a brick,
which one of the witnesses said, "if
I hadn’t a fell down side de fence and
dodged, would a busted my head wide
open.” It crashed its way through a
window and so enraged the inmates
that one of them rushed out clad in
a corset. She then set up a screaming
that rent the air like a steam caliope.
It paralyzed the neighborhood. After
hearing all the evidence, the judge de
cided that Joe had exhausted every
fair means of getting his wife out of
Katie’s bad influence, and suspended
tils sentence of fifteen dollars to costs
of 75c.
Two white men were pulled in the
West End last night for misbehavior
of one nature and another. Drunk,
disorderly, cursing each other and ev
erybody else and fighting the police.
One had misconducted himself to such
an extent that when they got him in
the wagon they decided to hand-cuff
him. Tlie other then swarmed up the
side and collared Officer Williams by
the neck. They were both full of con
trition this morning and the former
pleaded awfully guilty. Number two,
however, ah no. He demurely and cun
ningly stated that his part in the
fighting had been entirely on the side
of the police, in behalf of order and
law. This clever wile met with such
loud cheering, however, that he retir
ed out of countenance to the guard
room, remonstrating against a sen
tence of $15.0n or thirty days. His
virtue was only exceeded by his hard
ludk.
Ed Gains and Will Smith put a ro
mantic close to the proceedings by
being too drunk for trial.

Meeting of Arbitrators for the
Railway Company and the
Trainmen to be Held This Af
ternoon.
There will be a meeting held this
afternoon of the four arbitrators se
lected in the street railway and train
men's dispute over wages and hours
and an effort made to select the fifth.
Messrs. A. W. Anderson and J. P.
Wood are arbitrators for the Atigusta-
Aiken Railway & Electric Corporation
and Rev. R. E. I>. Harris and Dr. J.
M. Caldwell are the arbitrators for
the trainmen.
The trainmen are asking for addi
tional wages and shorter hours. The
company contends that it cannot pay
the additional wages because it is not
making enough money at present to
warrant it

43 years of service, Mr. J. H. Wat
ters, master mechanic of the Geor
gia Railroad, has tendered his
resignation, efective at the con
venience of General Manager
Wiekersham. He has been with
the Georgia since 1901, and was
the inventor of a number of appli
ances now in use on locomotives,
lie began as trainman on the old
K. R. & D. in 1369. He leaves
the road, to devote his time to the
sale of his patented devices.

Child Hurt in Fall.—John, the
eight-year-old son of Dr. Rallie,
of Summertown, Ga., is at the
Wilhenford Children’s Hospital
sufffering lrom a fractured arm,
sustained by a fall to the ground
from' his horse yesterday. Many

the little patient while at Wilhen
ford.

BODY OF A. P. GATES IS
HELD FOR HIS DAUGHTER
Mr. A. P. Gates, a traveling repre
sentative of Collier Kr Sons, of Atlan
ta, Ga., died last Friday morning at
a local hoarding house, while paHHing
through this city, from heart failure.
Mr. Gates’ daughter ltj expected to
arrive today in Augusta to perfect the
funeral arrangements. The remains
are at present at the R. E. Elliott
private chapel. The deceased Is wide
ly known throughout the country and
was in the 65th year of his age.

January 20—Tuesday night—at the
Grand, the San Carlo Grand Opera
Company will inaugurate a one night
engagement of Italian opera, present
ing "II Trovatore,” selected from the
best examples of the old standard, and
the more modern of operatic works.
