E. J. Olddings, chief of counsel for
Mrs. Bond, stated tonight that an ap
peal to the supreme court would be
taken on the grounds that applause
and demonstrations In the courtroom
during the trial had Influenced the
Jury.
Senator Gore stated that he would
remain In Oklahoma City until Satur
day when he will go to Hot Springs
for a short vacation before returning
to Washington.
The termination of the trial which
has attracted more attention and has
been more vigorously contested than
any held in Oklahoma In recent years,
came at the end of a day devoted to
argument by opposing counsel In
which words were not spared lu de
nouncing witnesses and opposing par
ties to the suit.
Planned Conspiracy.
Robert L. Rogers, of Little Rock,
Ark., of counsel for Senator Gore,
made the direct charge that J. F. Mc-
Murray, a prominent Oklahoma law
yer, now living in Washington, plan
ned the alleged conspiracy which the
defense declared resulted in tho

charges that tha senator attempted to
assault Mrs Bond In a Washington
hotel last March, the basis for the
suit.
Attorney W M. Straight, of Mor.
rlllton, Ark., spoke for the plaintiff
and defended the character of Mrs.
Bund.
C. B Stuart and 8. M. Rutherford,
of Oklahoma City, made the final ar
guments for the defense.
Women's Charge.
Trial of the suit, began la*t Wed
nesday. In her declaration, Mrs.
Bond alleged that the senator attack
ed bar while she was In conference
with him at a hotel In Washington
last March, In connection with the
possible appointment of her husbani.
Julian Bond, aa Internal revenue col
lector at Oklahoma City. Gore sei*-
ed her, she alleged, throwing her vio
lently across a bed and freed herself
only after several men appeared In
the doorway of the room. In the
scuffle Mrs. Bond asserted, her face
was scratched and hand lacerated by
fragments of her broken eye glasses.
In his answer Senator Gore made
general denial of the charges and as
a counter charge alleged that the suit
was Instigated by a coterie oT his po
litical opponents who had failed In
their efforts to secure federal patron
age.
The Jury.
The Jury, composed of nine far
mers, a grocer, a banker and a broker
was aecured on the first day of th*
trial. Mrs. Bond was called as the
first witness after opening statements
were made Thursday. Repeating her
allegations, she denied any knowledge
of the plot alleged by the senator,
who is a candidate for re-nomluatlon
at the Oklahoma primaries next Au
gust. Efforts to have read deposi
tions dealing with alleged incidents
in connection with the past of both
parties to the suit was prevented by
a ruling of Judge Clark, who held:
such evidence not vital to the suit.
T. E. Robertson. Kirby Fitzpatrick
and Dr. J. H Earp. Oklahomans, in
Washington at tbe time of the hotel
episode as applicants for federal po
sitions, appeared as the principal wit
nesses Tor Mrs. Bond. All were un
successful in their candidacies. Rob
ertson and Fitzpatrick claimed to
have been eye witnesses to the al
leged assault while Eary asserted
that he had been importuned by Gore
to have Mrs. Bond leave Washington
and "hush the matter up.”
Result of Plot.
Testifying In his own defense Sen
ator Gore characterized the allega
tions as “infamous lies,” and asserted
that the whole affair was the result
of the pilotting of his political ene
mies intended to embarrass him in
his campaign for re-nomination. He
declared that Mrs. Bond seized him
and at an opportune moment Robert
son and Fitzpatrick appeared in the
room. Other witnesses for the de
fense quoted witnesses for the plain
tiff as admiteing that a “frame-up'
| against Senator Gore had been ar
ranged and quoted eeveral as having
made threats to “get" the senator.
