of the corporation had been used In
speculation aa alleged by creditors who
aeek to have a receiver appointed for
the corporation. The president de
clared that while he tmught cotton for
future delivery, and made a profit of
f 100.000 for the corporation, the
transaction was not n seculatlon.
An Item of 12E.000 said to have been
paid to H. II Pell a Company of New
York, was center of the Investiga
tion today.
W. T. Anderson, vice president, also
testified In contradiction of the alle
gations set forth In the Involuntary
bankruptcy and receivership petition
filed last FYlday hy four rredltor* who
claim $20,000 as due them on cotton
turned over to the corporation. The
hearing was not concluded today.
The Southern States Cotton Corpor
ation, an Alabama concern, was or
ganised with an authorised capital of
11,000,0000 for the purpose of securing
a uniform price of fifteen cents for cot
ton by the holding nnd systematic
marketing of the staple.

Washington.—John T. Boifeuillet,
who is here winding up the affairs
of Senator Bacon and his connection
with the foreign relations commit
tee, is daily receiving telegrams from
ail over Georgia advising him of cor
dial Indorsements being filed by his
friends with <he governor in behalf
of his appointment at United States
senator for the short term.
Mr Boifeuillet sent out a call to
day for a meeting of the foreign rela
tions committee tomorrow. This will
probably be the last notice he will
give, as the new chairman of the com
mittee will be named within a few
days.
The large and handsomely furnish
ed apartment of Senator Bacon In
the Netherlands was today leased by
Mr. Boifeuillet to Judge nnd Mrs.
William Bailey I<amar, of Atlanta,
who have heretofore been living at
tho Hotel Grafton.

For Locker Clubs Now
Investigation at Present Not
to Best Interest of Public,
Says Statement.
Atlanta, Ga.—After having called
numbers of prominent Atlanta men
to testify as witnesses on bills of
indictment against the Capital City
Club, the Fiodmont Driving Club, the
University Club and the Atlanta Ath
letic Club Tuesday, the grand jury
conferred for more than an hour and
then dismissed all witnesses with the
following public statement:
“The grand Jury decided by & ma
jority vote that It was not to the best
public interest to enter into an in
vestigation of the club question at
this time."
The four clubs In question were
charged with violating the state pro
hibition law.
All of the witnesses will have to
he re-subpoenaed should the grand
Jury decide to take up the bills of
indictment at a future session.

Formby, the adventuress. ,who is said
to have swortn In an affidavit that she
wss Inveigled by the police Into swear
ing to a scandalous story on Deo
Frank, and who Is sold by pollca of
ficials to have disappeared.
A city-wide hunt was made for her
Tuesday nnd Tuesday night. Hh« had
not been seen for days In the vicinity
of her familiar rendexvous, and. at her
former addresses over th* city, no on*
I could he found who had seen her sines
■ early before th* famous Frank trial.
Her most Intimate confidante, a wo
man living on Fort street. Is said to
have told the sleuths that she knew
absolutely nothing of the woman'*
whereabout*.
For the past several month*, the po
lice say, Mra. Formby hn* been resid
ing in New York In an apartment
house, where she kept to herself. The
police Indleve that she has vanished
from Atlnnt*. leaving knowledge of her
whereabouts with only a few, having
left at once upon making the reported
affidavit. v
Contents a Mystery.
The content* of this document are
still a mystery. Counsel for the de
fense have thrown great secrecy
around It, but It Is said to be sensa
tional nnd to contain a shocking ac
cuaation of alleged methods employed
hy the police and detectives In work
ing up their case agaiat the convicted
man. Chief lainford, In a conference
Tuesday afternoon, said he was un
able to account for the woman's mys
terious disappearance, because of the
fact that If she had sworn to a state
ment she should he willing to corrobo--
rate It at any time and to anybody.
The chief also intimated strongly
that he was directing his tjien to seek
explanations of an amount of new evi
dence, said to have been collected by
the defense, including the Albert Mc-
Knight affidavit, In which th* negro
witness repudiates his testimony made
on the stand, and the alleged charges
made against Detective Bass Itosser,
a foremost figure In the Frank Inves
tigation. Also, the rumored affidavits
made by character witnesses, who tes
tified in behalf of the prosecution.
Plan for Rehearing.
New developments In the noted
case were the filing Tuesday of a plea
for rehearing by the defense. The su
preme court is expected to hand down
its decision next Saturday. The ver
dict of guilty rendered by the jury In
the elonley trial required only twelve
minutes. -An Interesting to t he
negro sweeper’s trial arose when So
licitor Dorsey strove to show to the
court that the hair found upon the
lathe was that of Mary Fhagan.

ICE BOUND OFF CHICAGO
Chicago.- Four passenger steam
ships, carrying crews of 135 and
an unknown number of pasengers were
ice-bound today In Lake Michigan,
two miles from the Chicago harbor.
The boats are the Kansas, Milwaukee
to Chicago; the Alabama, Chicago to
Muskegon, Mich; the lowa, Chicago to
Milwaukee and Pere Marquette ferry
No. 6.
