Atlanta, Ga.—Today It la expected
that the legal cheaa game of the Frank
case will be renewed when the remit
titur of the aupreme ceurt refusing a
rehearing of the *-aas arrlvea a* tha
desk of the clerk of tha superior court.

that the defense will petition the Judge,
under section *1 of the pencol coda,
asking that he pronounce a sentence
of life Imprisonment instead of the
dettih sentence. Section 63 givea tha
presiding Judge the privilege of pro
nouncing a life Imprisonment sentence

Extraordinary Motion.
Whllo the attorneys for the defense
have made no statement as to what
their next move would be, the fact that
many new affidavits which were not
presented In the trial have been ac
cumulated It Is regarded as not Im
probable that they will file a motion

A failure in this move would leave
open the recourse of an appeal to the
United mates supreme court upon

tion of the defoliant for at least three
years, one year being allowed for the
haring before the federal court, an
other year being allowed for considera
tion and a third year for the render
ing of an opinion.

man with the state prison board and
the governor.

Ferguson's Testimony.
Attorneys for the defense had no

the trial was that she had called upon
the superintendent of the pencil fac

for both the defense and the prosecu
tion agree that she did not testify
that Frank told her he expected Mary
I’hngun to call for her pay on the
next day. and that the brief of the
evidence doee not show such testi
mony.
The Fergueon affidavit Is one of
several more that It Is rumored are In
the hands of the defense, upon which

Dalton, Ga. —Tom Hembree commit
ted suicide at a local hotel Sunday
night hy taking morphine. He had
just returned from the state farm,
where he had served a sentence, and
was despondent over domestic affair*.
He left a note directing the disposition
of his body and asking that his rela
tive* be notitfed.
Hembree was addicted to the nse of
the drug whteh he used to end his ex
istence. He had sought to take his
life In the same way on a former oc
casion.

Killing of ‘Peeping Tom’
Stray Bullet From Pursuers
Causes Death of Young
Man.
Mount Vsrnon, lowa. —Four Cornell
students were relieved by a coronet’s
jury horo of blame for the death of
Howard Manning. A bullet fired by
one of the students to frighten Man
ning. caught peeping Into the win
dows of the girl’s dormitory last night,
killed him. The four students, Owen
Lovett. Homer Trimble, Paul Rusen
bark and Albert Andrea,’recently were
deputised by town officials to watch
for men who had been annoying the
young women.

had left his hiding place only at night.

man Girls at basketball Is that of the
Woman’s College, Due Went, 8. C. The
game will be played here Wednesday
afternoon, March 4th, at 4 o'clock, on
Tubman’s court, provided the w r eather
Is good. Otherwise tha gains will be
plaed at the appointed hour at the Y.

Wednesday’s contest will be a re
turn game, the Tubman having played
Due West Woman’s College at Due
West the early part of the season. It
was the first game for this year’s var
sity team and the Augusta girls won
easily. The game was not as hard
fought as that with Savannah Satur
day In which Tubman’s team was vic
torious.
Friday the local girls’ team goes to
Spartanburg, 8. C„ to play Converse.
This will be one of the pretiea games
season. It is unfortunate that it can
not be seen In Augusta.

covered yesterday by John T. Boifeui.-
let, clerk of th# senate foreign rela
tions committee, and will be preserv
ed. One is tha copper plate from Sen
ator Bacon's old desk bearing the in
scription, "Mr. Bacon;" the other la a
glass nameplate from the locker In the
democratic cloakroom In the senate,
where Senator Bacon for many years
kept his hat and the long cloak which
made him such a distinctive figure on
the streets of Washington.
Mr. Boifeuillet is busy winding up
the affairs of Senator Bacon and
straightening out his papers and per
sonal effects. During twenty years of
publio life, Senator Bacon rendered
valuable services to no less than 5,000
Georgians. The correspondence bear
ing on these cases has been preserved,
os well os some twenty or thirty thou
sand other letters and rsplles.

an Atlantan named Wright, but short
ly aecured a divorce from him.
Now, after a separation of wall nigh
five years, she returns to Oliver, ‘ *
whom she was really legally married at
Climax, he having since proven that
he was In fact A. D. Oliver, and that
It was In truth his twin brother, Hard -
Ing. who had married In Mississippi
and had since gone to unknown parts
in South Americus. He is reputed to
be very wealthy.
