Gray. •
Judge Charlton handed down a de¬
cision in favor of the deposed former
chairman of the railroad commission.
Tnis means that the judge upholds
McLeuodn's claim to the office.
In deciding the case, Judge Char!
ten said. “If an officer Is proceeded
against for cause, he is entitled to no
tice and a hearing, and if he is not
given notice and a hearing the action
against him is as if it had never been,
in this connection it is pertinent to
observe that so far front a discretion¬
ary power of removal having been
conferred upon hearer, lie had no pow¬
er to remove. He suspended and it
was tlie general assembly that re¬
moved. The method employed was
not that of impreachment and was
therefore not that required by the
laws of Georgia.
“Under impeachment proceedings
the senate could not have removed
the relator without a two-thirds vote.
The vote it actually gave was a ma¬
jority of three and of the eighteen
men who voted in the negative sev¬
enteen put themselves on record as
entertaining views on the unconsti¬
tutionality of the act of 1879, which,
if persisted in, would have made the
impeachment impossible.” •

ters in tlie Shaksperean festival
which will be given hy Mr. Miiiilell
and his famous company at the Grand
opera house in Atlanta during auto¬
mobile week. This engagement will
bo, it is promised, the most impor¬
tant. event of the theatrical season,
for it is the first time in the history
of Atlanta theatricals that an artist
of iho first rank has devoted an 011 -
tire week to the classis drama. The
Mantell productions are given on the
most elaborate scale; in fact, they
are precisely the same as presented
hy tliis distinguished player during
his long metropolitan engagement.
Mr. Man toll, who is now America’s
foremost actor, will present no few¬
er than eight different plays during
the week, which, will embrace six
night performances and two fnalinees,
the matinees being given on Wednes¬
day and Saturday.
The repertoire for the week is as
follows; Monday night, “Macbeth;”
Tuesday night, “Hamlet;” Wednes
day matinee, “Romeo and Juliet;’’
Wednesday night, “iticlielleu,” (hy
