AIW TRIAL
Granted Capt. T. J. Peeples
of Bohannonville.
DECISION HANDED DOWN
By The Supreme Court on
Yesterday.
Says last night’s Atlanta
Journal : ,
The supreme court today
handed down a decision grant
ing a new trial to T. J. Peeples,
of Dalton, who was convicted of
receiving stolen goods at the
time of the exposure of the fa
mous freight robberies perpetra
ted by the Bohannon gang.
Capt. Peeples was local agent
of the Western & Atlantic rail
road and one of the most prom
inent men of Whitfield county.
He was charged with buying a
fine carpet from Bohannon which
the latter had stolen. Captain
Peeples insisted that the carpet
had been purchased from a deal
er in Chattanooga.
On the evidence presented to
the court Capt. Peeples was con
victec’. The'case was appealed
to the supreme court and a de
cision was rendered today re
versing the judgment of the
lower court as follows :
“Peeples vs. The State. Before
Judge Fite, Whitfield superior
court.
“Lumpkin, P. J.—l. It is
legitimate and proper, when
examining witnesses called to
prove the g iod character of one
on trial for crime, to inquire of
them how long they have known
him, for what length of lime
they have resided in the same
community with him, and as to
other like matters. Their an
swers to questions of this nature
are relevant as tending to show
their opportunities for acquiring
a knowledge of the general char
acter of the accused.
“2. The testimony of an ac
complice cannot, in legal con
templation. be corroborated by
that of another. It was therefore,
in the present case, erroneous to
charge the jury that if three
named witnesses were accom
plices, “still they may corrobor
ate eacTi other.”
“3. Except as above pointed
out, the charge of the court in
so far as it dealt with legal prin
cinles was free from material
error, but it was in some respects
argumentative, and for that rea
son subject to criticism ; some of
the remarks made by the judge
when ruling upon questionsaris
ing during the trial were objec
tionable ; a minor error was
committed in permitting the in
troduction of hearsay testimony,
but aside from this, it does not
affirmatively appear that any
other illegal evidence was ad
mitted.
