The fine was paid and Neal
left the state.

Subsequently, when it appear
ed that the grandjury had in
dicted the prisoner for a repeti
tion of the same offense, Judge
Fite ordered that the sentence
of six months’ imprisonment be
carried out
This order was resisted on
several grounds, one of them
being that the judge could not
suspend a sentence and then en
force it. Another was that six
months had elapsed after pay
ment of the fine.
AGAINST PUBLIC POLICY.
This is interesting mainly for
two reasons. First, it is by
many considered against public
policy to have alternative fine
penalties where the officers of
court get the fees. This question
was presented to the legislature
by Gov. Northen, who said that
alternative penalties were the
source of much rottenness.
Second, there are under con
viction with suspended sentences
a number of prominent people
at Dalton, indicted of complici
ty in the systematic train rob
bery at that place. Under this
decision their sentences will
have to be executed and a num
ber may go to the penitentiary.

been the subject of much politi

paign of 1896 and their position
