The woods are on fire and the wind is certainly in our favor. Gen, Evans charged Mr, Seifert of the Macon Telegraph with be ing a Wall street Republican, and with having served in a negro regi mentduring the war. Mr. Sdfert promptly and in excellent tern per and taste showed that he had voted the straight Democratic ticket for years past, and had nev er seen a negro regiment during the war. TUESDAY APRIL 10. 1894. WITH THE JORY. ! (Continued from first page) law accords no man the right to defend himself against a lawful attach” He then briefly reviewed some of the evidence and showed how the defense had by money or oth erwise found witness to track the line of defense as set out as prac ticable by the supreme court. And such witnesses, the rag t<.g and bob-tail, the ekum of creation the defense had found them ready tor S2O, for gray horses, for board money and otherwise to come in and track that line of defense, and the defense was trying to make it appear that while Mr. Stephens was on most intimate relaitous with'and only visited with the best people, that he had hunted up, wii'ten for and confided toe shame of hie wife and hie own dishonor to such cattle. And here were these creatures now, after the decision of the Su preme Court, coming forward at this opportune hour, because thei felt it their duty to Frank ; they swear they were Franks friends before the killing why did they not go to him then and warn him that Stephens was trying to trap him? He handled Penny without gloves. He showed up Mrs. Steph ens feeling in the matter, how she leaned towards the defendant. He peeled Wm Pyle and curried Ma: i uu Chastain and the gray hoise in the case. He showed how biased mayor Hargrove’s mind was, so much so that he would not change his opin ion about the shot in the door even when clearly demonstrated that he was wrong. He showed up toe persistency with which the Rev. Fester, col, had refused to remember certain things set forth in affidavits. He said that every development in this case showed what great prep aration of evidei.ee had been made by the the defense. Why the de fend int had even hi the night time gone to Will Ann Foster, col, and tried to corrupt her evi dence. He showed the coat said to have been worn by Wilkerson as testi fied to by his brother-in-law Huff man, and asked “In the name of common sense, how was Wilkerson shot in the left arm and the pistol 1 all holes show in the right sleeve. How could he have been »hot in the breast and the ball never have pierced the inside pocket of the coat and where is the vest and the bullet riddled shirt, he wore on that occasion? Mr. Nunnally do ed by fearless ly charging, and booking the charge by the records in the trial, that the defense had presented a great array of perjured testimony, and that rottenness and coirup tion was cropping out all through and over the defense. Caps. John Reese then opened for the defense, and in a telling and powerful argument began clipping away on the ground werk of solici tor Nunnallys edifice. I Capt Reese took the stand that Mr. Stephens knew for months and months of the intimacy bg* ween bis wife and the defendant and used the evidence to show that such was the case. That knowing this, Mr. Steph ens had forfeited his rights under the law and that he had set a trap and had fallen in it. Capt. Reese made a powerful Argument. Speaking nearly two hours. At 2:40 o’clyck this pm. Judge Branham, for the defense, began speaking and at three ©’clock was still speaking in vindication ©f his rights, as an attorney to man age his case aud to find out from his witnesses what they know. The prospects now are that Judge Branham and Seab Wright will consume all the balance of the evening and that Col, Wa t Harris will close for the State to morrow morning. LOST.
