The Herald is not of that class who regird the code duello as a “barbarous relic of the past,’ Among gentlemen, it adjusted mors differences and righted more grievauces, real ami imaginary, and upon terms honorable to all parties,than ever resulted m blood shed under its practice. But the code duello has been outlawed in Georgia, and no citi zen cau resort to it without mak ing an alii n of himself. No patriotic citizen wants to disfranchise himself and at the same time subject himself to being extradited and placed on trial for bis life in a State of which he is not a citiz-m. And then it is almost impossi b!e, especially where the uotonetv of newspaper publication has been given to pending trouble between .wo men in Georgia, for them to successfully plan a meeting and reach the designated point with out being intercepted by officers or through the intervention of friends Such has been the experience of those who have tried it, and it is a notorious fact that of late years those who have attempted to re sort to the code duello in this State have only made then.se I’e 1 ’e ridiculous. Nixon respectfully show : first That they are the owners of the entire capitol stock of the “Terhune, Berry Hardware com pany,” a corporation chartered a ‘cording to the laws of the State. second That petitioners are now < ngaged in, and propose continu i ig business under said charter and | the privileges therein conferred, ! hut they desire to change the n une of said corporation to that of “Terhune Nixon Company.” third That all the rights, powers, and privileges granted in the char ter of the “Terhune, Berry Hard ware Company” may be conferred, exercised, enjoyed and continued under the corporate name of “Ter hune Nixon Company. Wm Tyson had been buried 31 years and Jane Tyson 16 years, very little remained of Wm. Ty son, but the lady's remains were in a complete state of preserva tion.
