Birmingham, Ala., Nov. 17. ( hurley Foster, a negro, who was arre.-ted in this city yesterday on suspicion of being the one who committed an assault upon Mrs. Fom Payne, near Bessemer, in this county, 1 uesday night, and after ward attempted to take her life. Yesterday he was taken by Dep uty Sherifls Cole and McKinney to the scene of the crime and identi fied instantly bv the woman and her young brother-in-law. 1 he mot; which gathered at one , caught the negro from the officers and attempted to lynch him. Tbs officers by diut of persuasion pre vailed on the men to let the law take its course. Mrs Payne then seized a shotgun and attempted to shoot her assailant, hut was pre vented by the sheriff. EIGHT The husband and father of the woman also attempted to shoot him, but were prevented. By hard work and cool bravery the negro was brought to this city and placed in jail. The penalty in this state is death. HORRILLE CRIMES. Confessed by a Fiend, who Nar rowly Escapes Lynching. Fargo, N. D. Nov.l7.—N.J.Vil lars was brought to Cass County Jail today by Sheriff Eddy, of Stutsman County. Eddy left Jamestown with his prisoner just in advance of a mob, which was ou its way to take him from jail and h nch him. On the way here Villars confess icd the horrible crime with which he is charged. 'lu'-iday tv ning Villar weal to the farm of Mr . Fromer, in Montpelier Townswip Stutsman Comity. Mrs. Fromer saw him in the barn and went out to see what he wanted. When she approached \ il lars knocked her down with a club end heat her into insensibility He dragged hir into a bars and assaulted her, then he thiew h-r into a well in the barn, set the burn ol fire and left. The barn burned to the ground bus Mrs. Fromer, who was still alive, escaped death in the well, t owards ruing she managed to climb out and got to the housa. Taking her children with her, she crawled on her hands and knees to a neighbor’s, two.miles away and died alter telling her story. Villars was captured at Hadley City, and taken to Jsmestown by Sheriff' Stenshoel. He is one of the oldeei farmers in Stutsman County, and has a highly respectable fam ily. A large mob gathered at Mon tpelier and started for Jamestowu to lynch him, but Sheriff Eddy heard of their coming in time to scape . Villars to-night confessed another crime. A month ago Mr. Fromer. husband of the woman he murdered, mysteriously disappear ►d. Villars says he killed Fromer and that his body will be found burfod in a pile of manure back of the barn.
