Jurors Created a Sensa tion ir the City Court JUDGE HARRIS IS JUDGE And by This Time the Lawyers Know it and the Witnesses are Finding it out. At tachments Issued This Morning. There was quite a sensation cre ated in the City Court room thia morning, and for a while Judge Harris,had his hands full straight ening the kinks out of the tangle hut he did it in a masterly way,a d soon all was serene and running smoothly, hen court convened this morn ing, the trial of the case of F. J. Shannon vs Ike Berry concerning an imported jack, was resumed, when Col. C. Thornwell, represen ted plaintiff, complained to the court hat Mr. Ike Rerry the de f‘ tent, had taken some of the Jury into Stoffragan's and “sit ’em up’’ to an oyster supper. The complaint fell like a bomb in the camp, and had the effect of of bringing a half dozen lawyers to their feet at once. Os course some of them had to be seated by his Honor until others could be heard, and some of them were so far off their cazipps that they had to be seated and refused a further hearing. The court finally disposed of the matter by issuing an attachment for Mr. Ike Berry for contempt of court. Then the case proceeded. This attachment will be argued before the next motion court and Mr. Barry will lie given a 'chance to show cause. In the meantime he will hardly invite His H ero to . an Oyster dinner. Mr. Berry was seen by a Hust ler or Rovg reporter and said that in inviting the jurors tea at a few oysters with him he did not invite them as jurors but as personal friends. He laughs at the efforts of the other side to make a stone I mountain oat of oyster shells. Mr. Shannon, the complainant, is ably represented by Col. C. A. Thorn well and Judge Joel Bran ham, while Mr. Berry has retain ed Messrs. Hal Wright and Wright & Hamilton who are fighting every inch of the ground. Medical Building THE BLAME ON THE CLUB Andy Bowen's Death Attributed to His Head Hitting the Floor. Naw Orleans, La., Dec. 19. Coroner Lawrasou this afternoon ! held an inquest into the death of Andy Bowen, who was killed dur ing his fight with Lavigne last Friday night at the Auditorium Club. Dr. Finney was the first witness heard. He witnessed the fight and saw Bowen when he received the blow. Bowen did not fall like a man who had just received a knock out blow and Lavigne was not in a condition to deliver such a blow “In my opinion,” he said, “the < eath was purely aecitb nt il.’Neith er of the principals made objec tion to the condition of the ring.’’ Dr. Lawrason explained to the jury that the undigested food in Bowen’s stomach had a bad effect on the nerves leading to the huart. The brain and vp’ns were also af fected. Mr. Joseph Sporl, of the Audi torium Club, stated that he saw Bowen fall, but did not see the blow struck. Police Sergeant McCabe and Tom Anderson, backer of Bowen, also testified. Captain Frank Williams, of the Auditorium Club, made the start ling announcement that he was not aware of the fact that there was no padding on the floor of the contest. It had been reported to him previous to the day of the contest that the covering was loose and he ordered it fastened, but through mistake of the carpenters ths pidding was removed. The jury returned a verdict that the death of Bowen was due to concussion of the brain and that the fatality was due to the neglect of the club in not padding the floor of the ring. CURED THE DIPHTHERIA Anti Toxine Proves a Success in St Lottis. St. Louie, Dec. 19.—The first practical test of the benefits of the recently discovered anti-toxin** as a cure for diphtheria, was made here yesterday and proved a suc cess. The subject uporn which tin experiment was made is a three year old child of Floyd Shock. The child's condit.on wan such that tracheotomy had been decid ed upon as a last resort to save its life. The parents, however, con sented ’o an experiment with anti - toxine, and its effect was instantly apparent. The child breathed easi er and in twelve hours ab diph theric sym poms had passed away. FIGHT IN THE COURTS New York. Merchants Employ Coun sei to Test the Income tax. New York, Dec. 19.—The Sun this morning prints the following in its editorial columns: “We are enabled on the highest authority to state that Messrs.Jos. 11. Choate, and Clarence A. Se ward regard the new income tax as unconstitutional, andtha' these eminent lawyers will represent a large body of public-spirited New York merchants and business men who propose t* test the constitu tionality of the law in the courts.” _ if—rtt Fitzsimmons is Willing. Indianapolis, Ind., Dec. 19. Robert Fi'zsinimons, speaking of the proposed meeting with Cor bett, said yesterday: “I fear the fight may not come »ff. lam sure not at Jacksonville. I do not see why Corbett does not accept the Kinetoscope company’s offer and let the fight occur in New Mexico. It would be $50,000 sure mopey. Adingdon, 111., December 19. The Town Council, on the recom* mendation of Mayor Helderfast, has passed an ordinance prohibit* ing the practice of hypnotism on penalty of $25 fino. Three weeks ago “Professor” Roche began a course of lectures on hypnotism. In the course of a week he had hypnotized every subject in the county, including the professors of the College of the Christian Church. Then the people began to practise hypnotism on one another—the school children! upon their teach ers, debtors upon their creditore and young men upon their sweet hearts, In fact, the whole village gave up work for hypnotism.
