It was a novel departure one day
recmtly when Justice Lem Early,
o ’ North Carolina district, sent out
and by the strong arm of the law,
held up a Rome & Deeature pas
senger train, and ordered conduc
tor, engineer, fireman and brake
man to court, leaving the passen
gers in possession of the deserted
train. It seems that an R. <fc D.
train had struck a “Jersy” cow,
the property of a Mr. Asa Avery
and slewd her, and Mr. A vary had
sued the Southern Railway Co ,
for her value etal.

The road made a kick about the
pedigrees of the creamery and Col.
C W. Underwood, the road's At
torney went down to defend. The
train was held up by the law but
while it remained in the old field,
md the employees went to court,
the plaintant managed to get
caught on a jury and went out with
the jury, which hung and hung un
til the train crew had to leave to
bring tbe train with its passengers
on to the city. Then the jury
promptly un-hung and made and
returned a verdict.
