serious, wound in the arm.
Lucas was yet alive when Ten

said he wanted no barm to come

Sheridan was his best friend, and
would not have killed him had he
known what he was do.ng.
John Lucas is the man who
killed James North, the desper

NEW PAPER
I'o BE STARTED AT ONCE IN
ATLXN I A
JUDGE JOEL BRANHAM
Fief.d the Petition p.>r C harter.
Won't Talk.
Regarding the new afternoon
paper to he started in Atlanta
soon, .'u 'ge Joel Branhnm was
seen by the Hustler of Romb this
morning.
Judge Branhnm is the attorney
for the new company, and as at
torney, the judge sustained hit
reputation for never talking to
newspapers about his professional
business.
Yesterday’s Constitution eaye of
the new paper:
“A petition for charter for a
new Ailanta newspaper was filed
in the office of the superior court
ytsterday by Judge Joel Branham,
of Rome, charter privileges being
asked for the Phoenix Publishing
Company. The names of the incor
porators are J. S. Appleton, D. R.
Morgan and Joel Branham. It ap
pear! that it is the desire of the
company to publish an afternoon
paper with the privilege of other
publications bei g conditioned up
on the wishes of its managemen..
The capital stock it placed at
#200.000, the right being reserved
to increase same to 11,000,000
No definite information could
be obtained in reference to the
company. Judge Branham making
uo statement. The announcement
made yesterday afternoon that
Mr. J . 3. Appleton is a son in-law
of Judge Branham is a mistake.
Mr. D. S. Appleton, of New York,
having mairied Judge Branham’s
daughter. It is said, however,
that Mr. J. S Appleton it con
nected with the Appleton family
of New York, and that Mr. D. R.
Morgan is also an associate, though
of this no information could be
obtained.
The announcement published
yesterday afternoon that it was
rumored that “Captain Evi n P.
Howell was also interested in the
movement” is pronounced as ab
solutely without foundation by
Captain Howell.
“I know nothing whatever about
it,” said Captain Howell, yester
day. “I am not and do not expect
to be, intereslsd ia any newspiper
lusiuessin Atlanta or anywhere
else; for if it had been rny inten
tion to continue in journalism, J
cer ainly would not have with-!
drawn fr.m the Constitution It
seems, howe”er, that every time a
new paper is mentioned from
Maine to California, my name is
connected with it. Ido not know
and never heard of either of the
three incorporators mentioned in
the charter referred te, •< cept
Judge Branham, and I h >ve uot

Valdosta, Ga. , Nov. 29.—A
li'tie hut three miles West of Lake
Park was the scene of a batt’e be
tween the ofliceis of the law and a
fugitive desperado, which almost
equals the fusilade that oncurr d
at the time of Sheltcn Dampier’s
arrest.
A sheriff’s posse, consisti' g of
Sheriff Hawkins of Suanee coun
ty, Florida. D> puty Sheriff James
of Hamilton c >uuty, Fla., Depuly'
Sheriff Chisho’m, of Lowndes
county, Ga., Marshal Flirl Hine
ly, of Lake Park, and a ypung
white man named Kelly, who vol
unteered to join, started in . the
hunt for a desperate fugitive.
A young man named Henry,
with his wife, mother-in-law and
three sisters-in-law, has been liv.

Lake Park, was the objec 1 sought-
The posse was accompanied to
the place this morning by a ne

hood. The officers were armed

they met at Lake Park about

arrest.
immates open fire.
As they approached the house
where Henry was staying, he open
ed fire upon them Deputy James
fell to the| ground with a’bu let
hole in his thigh. The fire was
kept up on the officers, but he
managed to crawl behind a tree,
and thus saved himself.
Then the desperado tur led his
weapon upon Marshal Hit ley and
sent a bullet crashing by the offi
cer’s head grazing the forehead
and producing a serious fL>sh
wound. I’he officers fir'd upon the
house, and a bullet from one of
the guns struck Mrs. Roe, Henry’s
mother-in-law, crippling her.
A number of shots were fired by
both sides, and the officers were
kept iroin a general fusilade by
fear of killing the women. After
two hours’ time, Henry was pre
vailed upon to give up. A crowd
from Luke Park started to the
scene in the meantime, bent on
measuring swift punishment to the
desperado, but the ofllicers man
aged to get him before they ar
rived,
Henry was brought here and
lodged in jail, while the wound d
officers were given attention.
Sheriff Hawkins returned to Lake
Park tnis evening to at'e .d t
Deputy James, and will return
tomorrow and get Henry and
carry him to Florida.
Henry is charged with assault
with intent to murder and there
ie a strong suspicion that he
murdered a man and wife near
White Spring in the spring of
this year.’A man aad his wife
went off from home on a visit to
town and have never been heard
of since then.
It was believed that they were
killed,and now Henry is believed
to know sometbhing about that
killing. He was armed to the
teeth and was prepved to con
tinue bis war for some time. He
says that the women did the
shjoting at the cfficers.
